Director Division of Water Quality November 2, 2004 QCC~L~~~IL~ p D NOV 1 0 2004 w~w~E,~"s~os~ Subject: Greensboro Western Urban Loop State Project No: 8.U482101 TIP No: U-2524 AB/AC DWQ No: 030909 Dear Mr. Mills: On Wednesday, September 29, 2004, the Division of Water Quality received a complaint call from Mr. Bob Schultheis of Greensboro. He was concerned about the sediment and turbidity being deposited in a pond and a stream (not connected) on his property at 5010 Hilltop Rd in Greensboro. This property lies directly below ongoing construction for the Greensboro Western Urban Loop. On Thursday, September 30, 2004, Sue Homewood of our staff visually inspected the property and confirmed sediment and Cne gravel in a small stream segment, as well as turbidity in a pond and the stream feeding the pond. Both streams cross through the NCDOT construction site. Ms. Homewood contacted Mr. Chris Kirkman, Resident Engineer NCDOT Division 7 to notify him of the situation and to advise him to ensure that all sedimentation and erosion control measures were in place before the weekend. It was discussed that on September 28`I' and September 29~h, tropical storm precipitation levels were recorded at the site and may have been the cause of the sediment loss and turbidity. On Monday, October 4, 2004 the Division of Land Quality conducted an inspection of the NCDOT construction site. Minor problems were noted and recommendations made for corrective actions. The Division of Land Quality noted that there were areas that should have been temporarily seeded and mulched. They also noted that although all sedimentation and erosion control measures called for in the plans were installed, decisions made on-site during construction regarding stockpiling of fill should have wan•anted additional measures to be installed. On Monday, October 18, 2004, the Division of Land Quality conducted an annual audit of NCDOT construction sites, including this section of the Greensboro Western Urban Loop. At that time they indicated all measures were adequately in place and maintained. In addition, they indicated that NCDOT had installed additional measures in response to the recommendations made on October 4, 2004. Please note that although the sedimentation and erosion control plan was being followed in this instance, it is the NCDOT's responsibility to continue to inspect the project and note any construction modifications or actions that may call for additional measures to be taken to prevent any impacts to waters of the state. Please be sure to educate all contractors and subcontractors through appropriate training and/orpre-construction meetings and regular inspection meetings. ''s' ~~~ N. C.
