This IP authorizes impacts totaling 1,460 feet of stream, 4.14 acres of wetlands, and 8.62 acres of ponds along the drainages of Long Branch, Reddicks Creek and its unnamed tributaries, unnamed tributaries of Bull Run, South Buffalo Creek, and Hickory Creek. The purpose of this letter is to request a modification of the IP for additional stream impacts as well as the 401 Water Quality Certification (WQC) for stream and buffer impacts from the relocation of a lift station and sewer resulting from construction of the road project. The NCDOT also requests a modification of the 401 WQC involving Condition 14. Relocation of~I_ift Station and Sewer Line The proposed relocation of the lift station and sewer lines is needed due to the construction of the proposed road project. Relocating the sewer lines will involve temporary impacts a two stream crossings, one at Long Branch and another crossing of an unnamed tributary of Long Branch. Buffer impacts to Zone 1 and 2 will also result. The NCDOT has modified the proposed sewer crossings to make the crossings parallel to the streams. The NCDOT will install pervious brick as a minimization measure at the lift station in the area noted as Zone 2 buffer. The NCDOT proposes to mitigate for impacts to the Randleman Buffer by paying into the NC Wetland Restoration Program. Based on a cost of 0.96 cents per square foot, the NCDOT will pay $17, 145.60 to the WRP to provide the necessary buffer mitigation for this project. Condition 14 of the 401 WQC There are several subparts of this condition of the 401 WQC which NCDOT requests be to modified. The NCDOT would like to modify parts of the ~flrst and fourth notation. Greensboro Western Urban Loop April 30, ?004 section 404/401 Permit Modification Page 2 of 4 TIP Nn i I_~S~d AR/AC' • Within the first notation, the following statement is found: "The channels must be allowed to stabilize for an entire growing season." The NCDOT believes the intent of this statement is for the stream channels to be stable prior to water being turned into the stream. Typically, new channels are constructed in the "dry" with a pump around, on new location or with a diversion channel. If a pump around is being use, the contractor can only perform construction on the stream which can be stabilized that day. The new channel must be stabilized, with matting and/or other measures, by the end of the construction day prior to the contractor being able to release water into the constructed channel. The NCDOT believes the condition is not practicable as stated in the 401 WQC. At the pre-construction review with the NCDOT, the road constuction contractor, USAGE (Mr. John Thomas) and DWQ (Ms. Beth Barnes), it was agreed that water would not be turned into the relocated channels until the NCDOT had contacted the USACE and DWQ about reviewing the stream channels instead of waiting an entire growing season to turn the water into the relocated channels. Furthermore, at the pre-construction meeting for TIP No. U-2524 AB/AC on January 6, 2004, the issue of approving stream relocations was discussed. At that time, Mr. John Thomas of the US Army Corps of Engineers and Ms. Beth Barnes of the NCDWQ agreed that, after long channel relocations had been constructed and stabilized with matting, NCDOT Division 7 personnel would contact them for a site visit. At that site visit, the USAGE and NCDWQ would review the stream relocations and, if deemed stable during the site visit, allow water to be turned to the newly constructed channel. • The fourth notation under this condition involves NCDWQ requiring the NCDOT to conduct biological monitoring on its relocated channels. The NCDOT has reviewed the policy noted in the 401 WQC about biological monitoring. The NCDOT asks that this condition be deleted from the 401 WQC because all the needed biological monitoring sites have been selected and studied per the eight eco-regions (per conversation with Mr. Dave Penrose of NCDWQ staff and Mr. Phillip Todd on November 20, 2003). The NCDOT understands Mr. Dave Penrose of NCDWQ has sufficient sites for the EPA grant studying biological monitoring and that he has recently completed the EPA grant funding this review. The NCDOT asks NCDWQ to debit electronically $475.00 to act as payment for modifying the 401 WQC as previously noted in this application (see subject line). In summary, the NCDOT asks the USAGE to modify the existing IP for the Western Greensboro Outer Loop to accommodate the construction of a lift station.
