Director Division of Water Quality April 30, 2007 DWQ Project # 07-0010, Ver. 2 Nash County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. David Combs 518 Clifton Road Rocky Mount, NC 27804 Subject Property: Wildberry Drive Stream Crossing Ut to Stony Creek [030302, 28-68, C, NSW] RETURN OF APPLICATION Dear Mr. Combs: On Apri15, 2007, the Division of Water Quality (DWQ) received your application dated Apri15, 2007, to impact 601inear feet of perennial stream, and 3,600 square feet of Zone 1Tar-Pamlico River basin protected riparian buffer, and 2,400 square feet of Zone 2Tar-Pamlico River basin protected riparian buffer, to construct the proposed residential subdivision to construct the proposed subdivision at the subject property. Your application was unacceptable due to the following items: 1. This project is being returned due to the failure to provide Item Number 3 requested in your most recent Request for Information Letter sent by the Division of Water Quality on January 30, 2007. This item required you to convert the wet detention pond to an extended detention wetland because of the Nutrient Sensitive Waters (NSW) classification in this watershed. If you submit another application on this project, please be advised that the DWQ will require plan details of each of the proposed level spreaders at a scale of 1" = 50' or , larger. These plans must show the locations of the contour lines, flow splitter devices, bypass channels and forebays. For this reason your permit application is hereby considered withdrawn. Once you have redesigned your project to address the problems and inadequacies with your application as it was submitted, you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee, and your level spreader designs must utilize the new DWQ guidelines effective January 1, 2007.
