PROJECT SUMMARY: The applicant's propose to construct a bulkhead on a natural shoreline that will align with adjacent bulkheads, backfill an area of coastal wetland vegetation, construct a pier/platform with a boatlift, relocate an existing swale and construct a single-family dwelling. Project Setting The site of the proposed development is a vacant lot located at 3938 Ivy Lane within the Kitty Hawk Landing subdivision, Kitty Hawk, Dare County. The site is adjacent to a canal (identified as Avery Pond) that leads to the Albemarle Sound. The property is ±13,202 sf in size and has ±137' of natural shoreline that has a ±3' erosion escarpment. The shoreline area contains several patches of coastal wetlands made up of black needlerush (Juncus reomerianus) and bulrush (Scirpus spp.). Two of these patches are isolated within the waters of the canal and the remaining patches are adjacent to the shoreline. The shoreline is heavily vegetated with common reed (Phragmites australis) and it is growing from below normal water level (NWL) into the highground area. It has encroached into the coastal wetland areas adjacent to the shoreline and is taking them over. Within the southern section of the shoreline,-riprap has been placed at the mouth of a drainage swale that extends from the highground. The elevation of the property is ±3.5 feet above NWL and there are currently no man-made features or uses on the property. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Psamments (PsB) and is vegetated with groundsel bushes (Baccharis halimifolia), wax myrtle (Myrica cerifera), greenbrier (Smilax rotundifolia), loblolly pines (Pious taeda) and grasses that are mowed periodically. Drainage swales exist near both the northern and southern property lines with only the southern swale draining into the canal. The adjacent property to the south of the project site has been developed with a single-family dwelling, driveway, bulkhead and dock. The adjacent property to the north of the project site has been developed with a single-family dwelling, driveway, pier, platform, boatlift and jet-ski lift. It should be noted that all other properties along this side of the canal have had their shorelines stabilized with bulkheading. Based on available information, archaeological site #Dr17 is approximately 350' to the west of this site. The Division of Environmental Management classifies the waters within this area of the Albemarle Sound as SB and it is closed to shellfish taking. The canal adjacent to the project site is ±140' wide and water depths within the project area range from -1 ft near the shoreline to -5 ft. The bottom substrate within the project area is made up of fine sands and detritus. Submerged Aquatic Vegetation (SAV) was observed in the waters adjacent to the applicant's property. Development Proposal The applicant's propose to stabilize the shoreline by constructing ±137' of wooden bulkhead with an alignment that is a straight line between the existing bulkheads to the north and south. The proposed bulkhead will tie into the existing bulkhead on the adjacent property to the north and run in a southwest direction for ±118' at which point a ±19' return wall will be constructed. A 15' opening will be left between the proposed bulkhead return wall and the existing bulkhead return on the adjacent property to the south to allow an outlet for the existing drainage swale. Edward Moeller & Steven Wendkos Field Investigation Report Page 3 The proposed bulkhead alignment will average ±4.2' waterward of NWL with a maximum distance of ±10'. Water depths within this area average -1.5 ft. The alignment will cut through two coastal wetland areas and a third coastal wetland area is located landward of the alignment. Backfill will be sand from an offsite barrow pit. The applicant indicated that there has been no shoreline erosion within the last 12 months; however, an erosion escarpment does exist and it appears that there has been erosion during that time period. A docking facility is proposed that will consist of a 6'x4' pier that will connect to a 30'x12' platform. One 15'x12 boatlift will be installed on the outside edge of the platform. Water depths within the pier and platform area range between -1' and -2.3' below NWL and water depths within the boatlift area range between -2.3' and -4.1' below NWL. The total distance that the docking facility will extend beyond NWL is 30', which is within the allowable % rule distance of 35'. The proposed docking facility will remain 18.6' from the northern property line and ±50' from an adjacent docking facility. The adjacent property to the north has a similarly designed docking facility as the proposed one. Within the highground area, a single-family dwelling will be constructed. The anticipated area that will be disturbed for grading, house construction, septic installation, swale relocation and a driveway will be ±8,400 sf. The single-family dwelling will be constructed >_37' landward of NWL and no structures are proposed within the 30' CAMA Buffer. Anticipated Impacts • The construction of the bulkhead along the proposed alignment will result in the filling of ±316 sf of PTA and EW AEC's with clean fill from an upland source (±17.6 cubic yards of fill material below NWL). • Bulkhead installation, backfill and grading will result in ±179 sf of fill placed within a CW AEC. • Bulkhead installation may result in the additional loss of ±51 sf of Coastal Wetlands immediately waterward of the alignment due to disturbances to the root mat system. . Bulkhead installation will result in ±2;500 sf of land disturbance within the ES AEC. • The proposed pier, platform and boatlift will result in one slip and the shading of ±384 sf of PTA and EW AECs. • It is anticipated that lot grading, single-family dwelling construction and swale relocation will result in ±6,400 sf of disturbance within the ES AEC. • Based on the proposed bulkhead alignment, the construction of the single-family dwelling and driveway will result in ±2,293 sf (21.9%) of impervious surface within the ES AEC. • Based on the proposed bulkhead alignment, the total impervious surface on the lot will be ±2,793 sf (20.4%). The lot has an existing swale on 3 sides with an outlet on the south west corner that is part of the Town of Kitty Hawks' drainage project for Kitty Hawk Landing that was permitted separately. There are existing bulkheads on the north and south lots of the above property and the owners would like to continue the existing line with a bulkhead on their lot except in the area of the outlet. This will create a need to fill behind the bulkhead instead of creating a catch basin if they followed the line of wetlands.
