Dear Dr. Thorpe:
The Division of Water Quality is in receipt of your 401 Water Quality Certification Application for the subject project,
and it is in the process of being reviewed. As part of that review process, we have received comments from the US Army
Corps of Engineers indicating that the Pre-Construction Application (PCN) dated July 11, 2011 does not comply with
conditions of the Nationwide Permitting Program concerning avoidance and minimization. The USACE has indicated in
that letter that your project does not meet the conditions for use of the Nationwide Permitting Program and cannot issue a
Nationwide Permit for this project.
Until this permitting issue is resolved, we are placing this project on hold, pursuant to 15A NCAC 2H .0507(a) (5). When
the NC Division of Water Quality receives the information indicating that the permitting issues have been resolved, we
will continue processing your application.
