Dear Ms. Carter:
On August 9, 2011, the Division of Water Quality (DWQ) received your application dated August 4, 2011 to fill
or otherwise impact 7,115 square feet of Zone 1 Neuse River basin protected riparian buffers and 12,920 square
feet of Zone 2 Neuse River basin protected riparian buffers associated with the construction of a stormwater BMP
outlet, a sanitary sewer line, and pedestrian trail. The DWQ has determined that your application was incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional information in
order to process your application to impact protected buffers on the subject property. Therefore, unless we
receive three copies of the additional information requested below, we will place this project on hold as
incomplete until we receive this additional information. If we do not receive the requested information your
project will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. Please locate the project boundaries on the most recent bound and published Wake County soil survey and
the USGS 1:24,000 topographic map for the project.
2. Where the proposed stormwater BMP outlet buffer impact is proposed, the plans depict a wetland and the
PCN form indicates that this is a non jurisdictional stream with a buffer. Is this correct? DWQ does not
require protected buffers adjacent to wetlands.
3. Has DWQ made buffer determinations for this property? If so, please provide the DWQ letter.

4. If the proposed stormwater BMP would actually impact the Neuse River riparian buffer, will the BMP
(constructed wetland) provide 30% Nitrogen removal? Please provide calculations demonstrating how
the disspator pad is sized adequately. If these two conditions are met then this activity is considered
"allowable" according to the buffer rules and mitigation would not be required.
5. You have proposed a 10-ft wide pedestrian trail, however, the plans indicate that the pedestrian trail
impacts are for an approximately 30-ft wide construction corridor. This Office believes that a 30-ft
construction corridor is not necessary. Please explain why this is essential. If essential, update the Buffer
Impact table in the PCN (6b) to include temporary and permanent pedestrian trail impacts and provide a
planting plan for the temporary impacts associated with the pedestrian trail that fall outside of the sewer
easement.
6. This Office believes that the pedestrian trail can be moved or reconfigured to avoid and/or minimize
impacts to Zone 1 of the riparian buffer. Please explain why Zone 1 impacts are necessary.
Please submit this information within 30 calendar days of the date of this letter. Please send requested
information to DWQ Central Office, Attn: Karen Higgins, 1650 Mail Service Center, Raleigh, NC 27699-
1650. If we do not receive this requested information within 30 calendar days of the date of this letter, your
project will be returned and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at this
time) by the DWQ. Please call Ms Lauren Witherspoon at 919-791-4251 if you have any questions regarding or
