Chad,
I do not think you need a written 401 for this. You checked "permanent" impact on the PCN
but I talked with others around here and it seems the consensus is that this is temporary
impact. That is, removing accumulated sediment, but not excavating below what would be the
normal streambed. If that's all you do; and there's no buffer impact, it's definitely a
temporary impact. If you follow all other conditions of the 6C 3687, you're good to go. This
is good news for you if you need to get this done quickly.

SUBJECT: ,Stream Cleanout of UT to Juniper Swamp between US 301 and E. Woodall St. in
Four Oaks, Johnston County.
Dear Sus:
The North Carolina Department of Transportation (NCDOT) proposes to clean out a reach of
jurisdictional stream located between US 301 and East Woodall Street in Four Oaks, Johnston County.
The purpose of this stream cleanout is to facilitate normal flow of the stream and allow for the proper
functioning of existing stormwater infrastructure irrarlediately upstream of the subject reach. This action
is in response to the fa>7ure of the existing crossline under US 301 due to the excessive and recurn;nt
impoundment of sediment and stormwater within the crossline. There will be 232' ofjwisdictional
stream impacts associated with this project. There w>71 be no buffer impacts as the buffer in this azea
consists of existing ut>pervious surfaces and existing maintained residential lawns that extend to top of
bank along the length of the subject reach. This feature is an unnamed tnbutary of Juniper Swamp. It
does appear as an intermittent stream ott the USDA Soft Survey of Johnston County, however it does not
appear on the corresponding USGS Topographic Map. The stream is highly urbanized and is piped for a
significant distance downstream of the project area
NCDOT anticipates that this project will be authorized under a NWP 3 as this activity is related to
the maintenance of existing transportation infrastructure. This application is also intended as a request
for written authorization from the NC Division of Water Quality to proceed with a pipe replacement
under General Water Quality Certificate # 3687. For our files, please provide written notice that this
activity is authorized.
