Proposed upgrades will consist of the addition of new target pads and access roads, expanding the footprints of existing target pads and access roads, expanding the footprint of an existing maintenance area, and creating a new storage area in support of operations at the range. Estimated impacts to non- tidal emergent wetlands measure 7.434-acres (323,850-sqaure feet). The Navy proposes to compensate for all wetland impacts at a 1:1 ratio through the purchase of wetland mitigation credits from an agency approved wetland mitigation bank. A wetland mitigation bank will be selected upon further coordination with the agencies. Work would be sequenced such that clean fill material would be brought on site to create the West Laydown and Maintenance Areas. Once created, these areas would be utilized to store fill material that would be used for the remainder of the project. The amount of fill material would be limited to only that amount which can be stored within the areas Laydown and Maintenance areas. In order to minimize construction impacts to training, work would be completed over the weekends when the range is not in use. It is anticipated that the proposed project would require approximately 200 days of construction completed over a 2-year period. Block 19 continued: The purposed upgrades would improve the operational capability of the range by improving access to targets and providing additional equipment storage and maintenance areas thereby increasing the overall efficiency and operational safety at the range. Completion of this effort would ensure the continued sustainability of range operations for use by combat capable forces ready to deploy worldwide. The Chief of Naval Operations is directed by Title 10 U.S.C. Section 5062 to train all naval forces for combat. The Chief of Naval Operations meets that direction, in part, by ensuring naval forces have access to ranges and airspace where they can develop and maintain skills for wartime missions. The Dare County Bombing and Electronic Combat Range is the backyard range for NAS Oceana. This range is used year round to train pilots and maintain current levels of military readiness. Improving or restoring the hard surfaces on the Navy Range would enhance the safety of grounds maintenance crew, improve range clearance efforts, and allow for the appropriate and safe storage of range equipment and materials. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The Dare County Bombing Range (DCBR) is an all-weather, U.S. Air Force (USAF) owned weapons range located on the Dare County peninsula in the coastal plain of North Carolina. The Range encompasses 46,621 acres and is utilized jointly by the USAF and the U.S. Navy. Through an Inter-Services Support Agreement, the Navy leases and operates the northern half (approximately 23,000 acres) of the range and the USAF operates the southern half of the Range. Of the 46,621 acres, approximately 5,000 acres is utilized as impact area by the two services which are divided into two separate impact areas of roughly 2,500 acres. The remaining DCBR range, approximately 41,621 acres, exists almost entirely of forested wetlands and serves as safety buffer for military operations. The Navy impact area, with the exception of the existing range control facilities and attendant features (i.e. roads, storage areas, and target pads), consists almost entirely of non-tidal emergent wetlands. The Alligator River National Wildlife Refuge, a 152,000-acre preservation area for native wildlife and forested wetlands, borders and almost completely surrounds the DCBR. The two largest surface water bodies in the vicinity of the Range are the Alligator River and the Pamlico Sound; located west and east of the DCBR, respectively. The land located to the southwest and adjacent to the DCBR is owned by White Columns Land and Timber Company. The Dare County peninsula, together with the neighboring counties of Tyrrell and Hyde, are sparsely populated rural areas. 3b. According to the consistency submission, the United States Navy (USN) proposes to implement the preferred Alternative (Alternative 1) contained in the "Draft Environmental Assessment for Improvements to the target Pads and Support Areas of the Dare County Bombing and Electronic Range, North Carolina" (October 2610). The Preferred Alternative would encompass the expansion of current target pads, the establishment of new target pads, the expansion of the maintenance area, and the creation of a new storage area. According the consistency submission, the proposed project is expected to impact 8.12 acres of wetlands. The USN proposes to mitigate wetland impacts at a ratio greater than 1:1 as required by the U5 Army Corps of Engineers, and/or by purchasing wetland bank credits. Offsite mitigation would occur within the same watershed as the proposed impacts. Land disturbing activities in excess of one acre will require that the State of North Carolina issue Erosion and Sediment Control Plan approvals prior to the land disturbing activity. Furthermore, changcs to impervious surfaces may require that a stormwater permit be obtained prior to the initiation of construction. North Carolina's coastal zone management program consists of, but is not limited to, the Coastal Area Management Act, the State's Dredge and Fill Law, Chapter 7 of Title 15A of North Carolina's Administrative Code, and the land use plan of the County and/or local municipality in which the proposed project is located. It is the objective of the Division of Coastal Management (DCM) to manage the State's coastal resources to ensure that proposed Federal activities would be compatible with safeguarding and perpetuating the biological, social, economic, and aesthetic values of the State's coastal waters. To solicit public comments, DCM circulated a description of the proposed project to State agencies that would have a regulatory interest. No comments asserting that the proposed activity would be inconsistent with the State's coastal management program were received. In the event that any rare species are encountered; the Applicant is to contact either the NC Natural Ilentage Program and/or the NC Wildlife Resources Commission to coordinate how impacts to the population and the habitat can be avoided or minimized. • Any mitigative measures or environmental commitments specifically made by the Applicant in the consistency submission for this project and in the "Draft Environmental Assessment for Improvements to the target Fads and Support Areas of the Dare County Bombing and Electronic Range, North Carolina" (October 2010) are to be implemented to the extent that they do not conflict with any of the conditions of concurrence stated above. All impacts to wetlands will be evaluated for avoidance and minimization criteria. In order for a project to be permitted, it must demonstrate that to the greatest extent practicable, steps have been taken to avoid- impacts to wetlands and other aquatic resources, potential impacts have been minimized to the greatest extent practicable, the project purpose could not be accomplished in a manner which would result in less adverse impacts. Provisions for compensation must be provided for any unavoidable impacts in accordance with mitigation requirements by the U.S. Army Corps of Engineers. Date: November 16, 2010 Consistency Determination: The two (2) improvement alternatives are consistent with/not in conflict with the Dare County 1994 Land Use Plan. Overview: The Dare County Bombing Range (DCBR) is an all weather, Air Force-owned weapons range located on the Dare County Mainland that is used jointly by the Air Force and Navy. The Alligator River National Wildlife Refuge, a 152,000-acre preservation area for native wildlife and unique forested wetlands, borders and almost completely surrounds the DCBR. NDCSR is the "backyard" range for Navy aircraft stationed at Naval Air Station (NAS) Oceana and Naval Station (NS) Norfolk. DCBR has been operational since 1965- The Air Force has owned the range since 1978 and is responsible for the overall management of the property. An Inter-Service Support Agreement (ISSA, 1999) has been established to delineate responsibilities for each of the Services for managing the land and its resources. Of the 46,600 acres, the Navy operates the northern half (called the Naval Operational Area in the ISSA), approximately 23,000 acres, and the Air Force operates the southern half. Within the Naval Operational Area is an "impact area" referred to as the "keyhole" due to its shape. All bombing targets are contained in the keyhole, which is approximately 2,500 acres. Approximately 82 acres of the impact area contain development consisting of a control tower, target pads, roads and storage area. The remaining area is utilized as a buffer for Navy operations. Only non- explosive ordnance is used within the impact area. The Navy impact area has sixteen (16) bombing targets, including three (3) "no drop" targets. These targets sit on top of gravel pads, created by filling the surrounding wetlands, or directly on top of the native vegetation. The existing pads are a combination of layered fill material, geotextile material and gravel. Expansion of five (5) target pads and associated access roads, construction of four (4) target pads and associated access roads, expansion of an existing maintenance area, and creation of a new storage area are proposed. Access roads will be widened to 15 feet. The existing maintenance area will be expanded by 2 acres for equipment storage. I have attached a copy of the policy from the 2003 Dare Counyt Land Use Plan on manmade hazards that addresses activities at the bombing range. This policy addresses the expansion of the boundaries (area) of the bombing range and is not pertinent to the activities described in the packet of information since the proposed activities are internal to the existing confines of the bombing range. I have also included a copy of the 2003 land classification map for the Mainland and the accompanying narrative for the land classification map. You will note that all federally-owned lands except for the bombing range are classified as Conservation. The bombing range was specifically excluded from this classification during the 2003 LUP update at the request of the US Navy due to the potential limitations associated with the Conservation classification and the activities that occur at the bombing range. The bombing range is depicted as "other federally owned property" on the 2003 reap and not subject to the Conservation classification that applies to the other federal lands located on the Mainland. Implementations Strategies: 1. Enforcement of sand dune protection standards in the Dare County Zoning Ordinance. -2 Draft amendments to the Dare County Zoning Ordinance to address the use of fill material on vacant sites to alter the existing natural ground elevations and drainage as the need arises. NLV MME HAZARDS Dare County's primary manmade hazards are the three airports including the Dare County Regional Airport on Roanoke Island, the Billy Mitchell Airstrip in Frisco and the First Flight Airstrip in Kill Devil HillslCoUagton. The US Air ForcelNavy bombing range on the Mainland is also recognized as a manmade hazard due to the military training activities conducted at this site. For years, the Dare County Airport Authority that oversees activities at the Dare County Regional Airport has discussed plans for an expansion ofthe infrastructure at the airport to accommodate commuter jet service. This expansion plan was strongly opposed by the residents of Roanoke Island during the 1994 Land Use Plan update process. Public sentiment remains strongly against this proposal therefore the 1994 policy has been restated in this update. The issue of expansion of the existing bombing ranges on the Mainland of Dare County was identified at the Planning Board workshops. The Planning Board agreed that such federal proposals should be evaluated on a case-by-case basis. Policy #38 Due to potential land use conflicts and hazardous conditions. Dare County does not support the expansion of the bare County Regional Airport at its current location. Policy #39 Proposals to expand the area of the existing bombing ranges on the Dare County mainland should be reviewed on a case-by-case basis with support or opposition offered depending on the terms of the proposal and its potential impacts on the local community and the importance to our Nations' national defense. MACH DRIVING/OFF-ROAD VEHICLES Beach driving and off road vehicle use is a long-standing tradition in Dare County. Before the installation of NC 12 on Hatteras Island, the residents drove on the beach on a daily basis for travel to other villages and to the northern beaches. With the installation of NC 12, driving on the beach was no longer a daily necessity, but remains an integral part of the tourist/fishing economy of Hatteras Island. Access ramps are provided along the Cape Hatteras National Seashore to accommodate four-wheel drive =ess to the Hatteras Island beaches. The National Park Service does impose restrictions on the driving areas to protect turtle nesting areas and other endangered/threatened species areas. Recently, there has been some concern that beach driving on the Calve Hatteras Seashore would be proluibited by the U.S Department of Interior. There is strong opposition to this proposal. During the Planning Board discussions, the Board members felt that f Esi 72 existing natural vegetation, drainage, topography, and sand hi"Us are not considered compatible and are discouraged. Prescriptive vegetation removal and best management practices of the NC Forests Service are encouraged where development is authorized in this classification. .Rural --'The rural class is to provide for agriculture, forestry, mineral extraction, and other allied uses traditionally associated with an agrarian region. Other land uses, due to their noxious or hazardous nature and negative impacts on adjacent uses may also be appropriate here is sited in a manner that minim es their negative effect on surrounding land uses or natural resources. In unincorporated Dare County, this classification can be applied to the remaining lands on the Mainland that are not publicly owned or included in the Community land class. Conservation -- The purpose of the Conservation Classification is to provide for the effective long- term management and protection of significant# limited, or irreplaceable areas. Management is needed due to the natural, cultural, recreational, scenic, or natural productive values of such lands from local, regional, and national perspectives. This classification includes all LAMA AEC's, such as but not limited to, coastal wetlands and all federal and state owned lands except the bombing ranges can the Mainland. Areas classified `SConservation" are depicted in the color green on the Lauri Classification Map. Development is not encouraged in lands classified "Conservation" and when authorized should be limited to residential development and traditional accessory uses permifad in CAMA AEC's such as but not limited to piers, docks, and crab-shedders. No urban-style services are considered compatible with the {Conservation classification of land use. Land disturbing activities should not occur in the Conservation classification unless in conjunction with an authorized development. Authorized development should include provisions and conditions that minimize impacts to any and all [natural, cultural, historic, and scenic values of the areas authorized for development. Limited Conservation - this is a sub-class of the Conservation class. The purpose of this sub-class is to provide for the management and long-term viability of essentially undisturbed land that is compatible with a limited range of uses under a specified set of guidelines. Land placed in the Limited Conservation sub-class includes maritime forests. Limited Conservation areas appear in shaded Veen on the land classification map. All privately owned land in Buxton Woods maritime forest has been designated as Limited Conservation. Also, the area that is included in the SED-1 buffer zone is classified as Limited 1 Conservation. Development in the Limited Conservation class should be limited to single-f roily residential structures and service-oriented commercial uses. In areas classified Limited Conservation and zoned as Special Environmental District or included in the SED-l buffer zone as described in the Dare County Zoning Ordinance, development shall be consistent with the standards of the SED-1 district. Lots sizes in the SED-I zoning district are restricted to 40,000 square feet. Laird clearing and mining activities are restricted by the County ordinance within the SED-1 toning district.
