She copied DWQ on the application as a courtesy only since impacts were under 0.10 acre. DWQ returned the application and stated that written notification was necessary because there was a Notice of Violation on the site. However, this NOV was issued by the ACOE only. Since no violation was issued by DWQ or DLR, it is our understanding that no written concurrence is required from DWQ for these wetland impacts. We are re-submitting the application as a courtesy. Please note that proposed wetland impacts have been reduced to 0.06 acre and that the previous violation has been resolved. Please don't hesitate to contact me if you have any questions. Environmental Consultants August 9, 2011 TO: Ms. Christy Wicker U.S. Army Corps of Engineers 69 Darlington Avenue Wilmington, NC 28403 RE: NWP 18 Application; 424 Shoreside Drive; Carteret County, NC Action ID# SAW-2011-00653 Dear Christy: Thank you for your letter dated July 29"', 2011 in which you request additional information for the NWP 18 application that was submitted by Shelley Stevenson Smith for the residential lot located off of Shoreside Drive in Swansboro, NC. Below is a response to each of your comments. 1. Please provide a map of the new placement of the house in relation to the wetlands. Enclosed is the site plan showing the new placement of the house. Please note that the site plan has been revised since our on-site meeting. Wetland impacts have been reduced further to 0.06 acre. 2. Please provide information from the builder/engineer explaining the least amount of fill slope needed from the house in order to insure the foundation does not fail. Also, please provide drawings with the fill pad in relation to the house and wetland. According to the builder, the house will need to be raised at least 8.5 feet above the current grade in order to be located above flood level. The builder recommends that an additional 10' of fill extend outward at the same elevation as the house pad to provide support to the exterior load-bearing walls and foundation corners. From this point, a gradual slope of 6:1 from the fill pad is needed to ensure structural stability and to direct drainage away from the house. This lot has a great deal of topographic relief from Shoreside Drive down towards the White Oak River. The lot is the collection point for runoff from the road as well as the houses in the cul-de-sac since the natural grade of the land slopes toward the lot. During rain events, water flows down this lot at considerable speed. A gradual slope will allow water to drain around the house and will reduce its velocity as it reaches the wetlands. Please see the attached site plan that shows proposed wetland impacts. Box 2522, Wilmington, NC 28402 Ms. Smith has attempted to avoid and minimize wetland impacts as much as possible in the site design. She originally attempted to avoid all wetlands on the site and spent a considerable amount of money constructing a house pad completely in uplands. Unfortunately, she could not position both the house and the septic system within uplands so the house had to be shifted further south. Ms. Smith also considered the construction of a retaining wall as a way to reduce wetland impacts. Both the builder and the engineer prefer using a gradual slope instead of a retaining wall because if offers more stability. In addition, it would create additional costs for the applicant because the house would need to be re- engineered (initial engineering costs for the house was $5,000). Finally, Ms. Smith has worked with the engineer and builder to reduce wetland impacts from what was originally applied for by tightening the fill slope. This has reduced impacts from 0.09 acre to 0.06 acre. 3. An explanation of why the septic system/drainf eld cannot be pushed further back on the lot in order to avoid wetland impacts. The septic system/drainfield was located where the soils met the Carteret County Health Department requirements and a permit has been issued. The system cannot be moved further north because this would put the septic system at a higher elevation than the house and would not be functional. The system needs to be either at a lower or equal elevation to ensure gravity drainage can occur. It is unlikely that the system can be placed further south on the lot because the water table rises as it gets closer to the river. Furthermore, Ms. Smith would prefer to keep the system as far away from the wetlands as possible for environmental reasons. I hope this response adequately addresses your comments.
