Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: UT(1)-Peak Creek flows west to east across the property for approximately 1,180 linear feet between Highway 88 and Gaither Poe Road. The stream arrives on the property through a culvert under Highway 88 and exits the property under Highway 88 as well. The entire reach is in agricultural land, as well as the general vicinity. In addition to the culverts on Highway 88, three bridges cross the creek on Mr. Bowlin's land. These can be seen in the attached photosheets. Following a significant rain event in April 2011, severely eroded streambanks continue to contribute to bank destabilization and sediment load. 3b. Explain the purpose of the proposed project: The purpose of the Peak Creek Enhancement project is to: 1) stabilize the significantly eroded streambank in order to reduce the sediment load into Peak Creek; 2) establish a constant dimension, pattern and profile of the stream; 3) improve and increase aquatic habitat; and 4) enhance riparian buffers. 3e. Describe the overall project in detail, including the type of equipment to be used: Approximately 1,180 linear feet of UT(1)-Peak Creek flows through the Bowlin property in Laurel Springs, North Carolina. This tributary to Peak Creek is not classified; however, Peak Creek is classified as a "Class C, Trout"waters by the N.C. Division of Water Quality. Noted stressors include habitat degradation caused by agriculture or high-intensity grazing habits. Agricultural fields, which have been heavily grazed in the past, surround UT(1)-Peak Creek as it flows through the Bowlin property. The goal of the proposed stream enhancement project is to return this degraded stream reach to its stable, well-vegetated, natural condition. Main components of the proposed project are natural channel design and riparian planting. Natural channel design measures are proposed along the creek with specific measures include one cross-vane at the upstream end of the project reach to provide additional aquatic habitat; a rock toe on river right where steep banks are sloughing into the creek; minimal boulder rock armor at two small bridges where wing walls are deteriorating;and multiple boulder rock vanes and j- hooks to lessen near bank shear stress in degraded sections. These will have the added purpose of creating stable riffle- pool sequencing and enhancing aquatic habitat. Finally, the streambanks in areas of severe degradation will be re- sloped to have more gentle slopes (less than 2:1) and therefore will be more stable for the riparian plants to grow upon. In addition, banks will be graded to include a "bankfull bench" in appropriate sections. Riparian planting will include native shrubs and trees along the riparian edge of the stream to provide additional stabilization and habitat (see Re-vegetation Detail). Plantings will include temporary seeding to provide quick cover after construction, followed by permanent planting which will include a floodplain seed mixture, live stakes of native shrubs and trees and bare root plantings of native shrubs and trees, (see Re-vegetation Detail). The entire 1,180-linear-foot project reach will be planted. The landowner intends to enter into an agreement to preserve the buffer in its natural state for a period of 10 years after the planting. Equipment to be used includes a track excavator and tandem tri-axle dump trucks for sloping banks and placing boulders on site. Other equipment includes hand-held tools for installing fence and planting the riparian buffer. All heavy equipment will be kept out of the stream channel during project construction except where absolutely necessary to install the aforementioned structures. 4. Jurisdictional Determinations 4a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The proposed work and associated impacts are intended to enhance UT-Peak Creek and stabilize erosive streambanks while minimizing impacts to aquatic resources. Design measures intended to decrease sedimentation include the installation of rock vanes, j-hooks, and the installation of a dense native riparian buffer. All disturbed areas will be immediately seeded (temporary - annual rye), matted (coconut/coir matting), and stabilized at the close of each construction day. Following construction the banks of the restored chanel will be seeded with a native floodplain mix (permanent seed). Livestakes and matting staples will be used to secure the coconut matting in these high stress areas. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. All heavy equipment will be kept out of the stream channel during project construction except where absolutely necessary to install vegetated rock slope. Disturbance of channel bottom, banks, and equipment access areas shall be held to the minimum necessary to allow for installation of in-stream structures. Furthermore, the "pump-around" method will be employed, when applicable, to divert flow around the work area during "in-stream" work (see detail). 2. We have reviewed the information you presented and are providing the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). According to the information you presented, you are applying for permits to conduct stream bank stabilization activities on a portion of a tributary to Peak Creek. Your letter did not include any plans or designs as to how the project will be constructed. It is difficult for us to give a detailed assessment without a complete set of plans that includes the exact location of the project and specific details regarding project plans and construction techniques. The purpose of this letter is only to inform you of federally listed species that occur within the geographical area indicated on the map that you provided. Endangered Species. According to our records, no listed species or their habitats occur on the site. We do not believe any endangered or threatened species or their habitats will be affected by the proposed project; therefore, the requirements under section 7 of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. Fish and Wildlife Resources - We have no objection to the proposed actions and support any efforts to restore and protect the water quality in the project area. However, we believe that a lack of vegetated buffers along the stream is, and will continue to be, a contributing factor in the instability of the stream bank. Because stream conditions are least affected where stream banks are stabilized by deep-rooted woody vegetation, stream restoration efforts should incorporate the use of native vegetation adapted to site conditions. The presence of large woody debris is an important aspect of natural stream conditions in headwater streams. Biodegradable erosion-control materials should be incorporated into bank restoration design in order to stabilize soils as vegetation becomes established. Live, dormant stakes (such as black willow) may be used to reestablish root structure in riparian areas. In areas where banks are severely undercut, high, and steep, whole tree revetments or rock may be used as a stabilization treatment (small rock, gravel, sand, and dirt are not recommended due to their erosive nature). However, it should not extend above the bank-full elevation (the elevation of the channel where the natural floodplain begins), and deep-rooting woody vegetation should be established along banks where any channel work is accomplished. Tree and shrub plantings should be spaced at intervals no greater than 10 feet along banks. We also want to emphasize that stringent measures to control sediment and erosion should be implemented prior to any ground disturbance and should be maintained throughout project construction. Temporary (e.g., rye, grain, wheat, millet) or permanent herbaceous material should be planted to help control erosion immediately following any ground-disturbing activity. Native annual small grains and herbs appropriate for the season are recommended. Fescue-based mixtures should be avoided. Also, fertilizers and pesticides should not be used near streams.
