8. PROJECT SUMMARY: The applicant is proposing to construct a 10-slip docking facility
with storage shed, located on Tusk Creek in Smyrna. The site would also consist of a boat
ramp with no upland development proposed.
9. NARRATIVE DESCRIPTION:
The Phillip Golden project is located at 191, 203, and 209 Old Carteret Road in Smyrna,
Carteret County. The project site is found by traveling on Hwy. 70E into Smyrna. Turn
south(right) onto Marshallberg Road and travel 1.2 miles and turn east(left) onto Old Carteret
Road. The project site is located at the terminus of Old Carteret Road.
The subject properties total 1.03 acres and average +3' in elevation above NHW. The
parcels are cleared and maintained; vegetation consists of native grasses and pines. There is
a single family home onsite is scheduled to be demolished as of the date the application.
Presently, the shoreline is stabilized by rip-rap above the NHW edge of the shoreline. The
shoreline, waterward of the rip-rap, consists of approximately 50' of Spartina alterniflora.
Tusk Creek is approximately 600' across at this location and the subject property has a
shoreline of approximately 220'. There are two shellfish leases located to the north of the
proposed project site at a distance of approximately 650'. Water depths at location of the
proposed slips are -2.7' NLW and connect to a channel with maintained depths at -2.7'
NLW. The location was formerly a commercial fishing facility used to offload seafood. The
water depths immediately adjacent the proposed pier and the connecting channel have been
maintained by maintenance excavation general permits. The substrate at the location of the
docking facility is silt. There are presently residential piers on both sides of the proposed
facility, at distances of approximately 200' to the north and 375' to the south.
The Division of Water Quality classifies this area of Tusk Creek as SA-ORW. This area is
also classified as a Primary Nursery Area by the Division of Marine Fisheries. The Carteret
County LUP Classification for this project is Conservation. This portion of Tusk Creek is
open to harvesting of shellfish.
10. PROJECT DESCRIPTION:
The applicant is proposing to construct a 155' X 6' docking facility to accommodate 10-slips.
A "L" shaped platform is proposed on the waterward end of the walkway dimensioned at 20'
x 6'. Total length for the facility would be 160' as measured from the NHW line. Four 25' x
2.5' finger piers would be utilized to gain access to the boat slips. The proposed facility
would be in the footprint of a previously existing commercial fishing dock and fish offloading
house. The bottom had been disturbed for many years and the area was maintained via
CAMA General Permit in 2011 to a depth of -2.7' NLW. All proposed slips would be located
at a depth of -2.7' NLW. At the closest location, Slip #1 would be located approximately 10'
from the closest extent of coastal wetlands and 25' waterward of the NHW contour.
Immediately waterward the NHW line would be a 30' x 15' deck. This deck would connect
to a 24' x 16' storage building to be used by slip holders. All portions of the storage building
would be located above NHW. The access walkway would extend approximately 30' above
NHW. A concrete boat ramp is also proposed on the south side of the property. Total
dimensions for the ramp would be 58' x 10'. As proposed, the ramp would extend 30' below
the NHW contour. Construction of the ramp would require approximately 22 yd3 of silty
shallow bottom to be removed from below NHW. Above NHW 292 ft2 of highground
disturbance would occur. Highground disturbance would consist of the spoil location. The
spoil location is proposed at 105' x 85' and located a distance of approximately 220' landward
of the NHW line. The most inshore slip would be located approximately 25' offshore of the
waterward edge of the marsh. The offshore slip would be located 150' waterward of the
NHW line. The project is within the property owner's riparian corridor and is a distance of
approximately 1' from the I.J. Won 15' Riparian Setback. The facility would be for vessels of
various sizes, from 14' to 20' in length. The dock would utilize 11 mooring pilings
throughout the facility.
11. ANTICIPATED IMPACTS:
The proposed docking facility would result in 4,950 ft2 of open water being incorporated
and 1,730 ft2 of shallow bottom shading impacts. The 4,950 ft2 would be a loss of Public
Trust Area and Estuarine Waters, but the area has historically served as a commercial
fishing operation, therefore any impacts would not be considered new impacts. The facility
would utilize 570 ft2 of slatted platform below NHW with a 384 ft2 storage building
connected to the facility and immediately above NHW. The project site consists of
approximately 220' of shoreline. The docking facility would provide mooring for 10
vessels. All ten slips would be located in waters averaging approximately -2.7' NLW. The
area maintained at -2.7'NLW connects to a historical channel which runs from Tusk Creek
outward to Core Sound. This channel averages 20' in width and approximately -2.7' NLW.
An increase in turbidity will occur while setting pilings. The waters surrounding the
structure are open to shellfish harvesting. No coastal marsh would be filled or excavated
during this project. No SAVs were observed at the times of site visits.
