On July 13, 2011, the Division of Water Quality (DWQ) received your application dated July 7, 2011 to
impact 100 square feet (ft) of Zone 1 protected riparian buffers and 200 square feet (ft) of Zone 2
protected riparian buffers to replace and extend the proposed sewer line. The DWQ has determined that
your application was incomplete and/or provided inaccurate information as discussed below. The DWQ
will require additional information in order to process your application to impact protected wetlands
and/or streams on the subject property. Therefore, unless we receive five copies of the additional
information requested below, we will place this project on hold as incomplete until we receive this
additional information. If we do not receive the requested information, your project will be formally
returned as incomplete. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please enumerate all riparian buffer impacts on the site plan and clearly label impacts (Buffer
Impact 1, etc.).
2. Please provide a location/most recent bound and published county soil survey/USGS 1:24,000
topographic map for the project.
3. Please provide a revised acceptance letter from the Forrest Creek Riparian Buffer Mitigation
Bank. The documentation you supplied from them indicates they have 100 square feet of
available buffer mitigation and not the required 300 square feet of buffer mitigation.
4. One (1) data CD of full size plans in TIFF Group 4 format (black and white, not grayscale or
color). If the plans are too large to store in TIFF format, they can be stored in PDF format.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me. If you will not be able to provide the requested information within that timeframe,

please provide written confirmation that you intend to provide the requested information, and include a

Re Project: Hogan Lane Water and Sewer Extension
This document confirms that City of Raleigh JApplicant) for the Hogan Lane Water and Sewer
Extension has expressed an interest to reserve 300 Square feet of Riparian Buffer Mitigation
Credits/Units from the Forrest Creek Riparian Buffer Mitigation Bank. The Forrest Creek
Riparian Buffer Mitigation Bank (Banker) attests to the fact that 300 Square Feet of Mitigation
is currently available for immediate transfer from its Official Bank Credit Ledger to Applicant as
of this date.
Banker will notify applicant if the 300 credits/units become considered "At Risk" of not being
available upon permit issuance. Credits are not considered secured until payment in full is
received from the Applicant resulting in the issuance of a Bill of Sale and Affidavit of Sale by the
bank acknowledging that the applicant has fully secured credits from the bank and the Banker
has accepted full responsibility for the mitigation obligation requiring the credits/units.
The Banker will issue the Affidavit of Sale within ten (10) days of receipt of the balance of the
Purchase Price. Banker shall provide to Applicant with a copy of the Affidavit of Sale and a
documented copy of the debit of credits from the Bank Official Credit Ledger showing the
permit number and the resource type secured by the applicant. A copy of the Affidavit of Sale,
with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
