On behalf of our client, CIP Construction, we request an appeal of the buffer determination performed by
Mr. Steve Mitchell of NCDWQ. Mr. Mitchell determined that feature B (see attached packet) on the
property that is depicted on the Wake County Soil Survey subject to the Neuse River Buffers
approximately at flag E14.7. S&EC believes the buffer for this feature should currently begin below this
point. Please accept this letter as an official appeal request. We are only appealing the determination of
feature B. We concur with the other determinations throughout the property. Your help in clarifying the
status of this feature is greatly appreciated.

This letter will serve as confirmation of the buffer determinations made by S & E C at the subject
property. This project is referenced by the Raleigh Regional Office as NBRRO 00-297.
The features represented on the Wake County Soils and the USGS Raleigh East Quad maps were
evaluated to determine their subjectivity to the Neuse Buffer Rule. Five features and a pond are
depicted on the soils map. Only the pond is shown on the USGS map. These features are labeled
as A, B, C, D, and E. Only a portion of Feature B, contained within the property evaluated, is a
stream subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management
Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code
T15A:02B.0233 (NCAC 0233).
The pond present on the site, although waters of the State of North Carolina, is not subject to
protection under the Buffer Rule. The features are delineated on the map received by this Office on
October 12, 2000. This letter only addresses the applicability of the Neuse Buffer Rules. Thank you
