In the final days of construction, repeat heavy rains revealed that the original design for the ditch outlet at 37+75Rt within the SE quadrant was causing a 'Hydraulic Trespassing' issue for the adjacent property owner. Due to pre-existing topography with a low spot in this property owner's yard, water exiting this ditch contributed to significant flooding next to this house. In order to correct this situation, the ditch was adjusted horizontally to take the runoff under the bridge to outlet by the stream. Therefore, it was necessary to revise the original design by deleting the energy dissipator pad at this location and replacing it with a longer grass-lined ditch (with a rip rap pad at the tail end) that extends to adjacent stream bank. This is a change in the "buffer design" as discussed in the field with Rob Ridings on 07/08/11: however this ditch was constructed through previously permitted buffer footprint or beneath the bridge deck, so no new buffer impacts result. Note that the plan depicts getting outside of the ROW into the unpermitted buffer to construct the ditch. However, this was not necessary in order to install the ditch and all work was done within previously permitted construction limits. The rip rap placed on the bank was installed above the ordinary high water mark, so there was no additional impacts to surface water resulting from this revision. The Division is providing this email as documentation of corrected information for your records.
