On July 18, 2011, the North Carolina Division of Water Quality (Division) received a copy of an application for
a 404 Nationwide Permit and coverage under a 401 General Water Quality Certification to impact 40 linear feet
of stream for the purpose of adding parking area on property owned by Phil Stevens at 119 Old Brickyard Rd,
North Wilkesboro, NC in Wilkes County. Upon review of the documentation, the Division notes that additional
information is necessary to ensure this project's compliance with the Conditions of 401 General Water Quality
Certification Number 3821 (GC #3821):
1. Page 8 of the Pre-Construction Notification (PCN) notes that this facility will have 0% impervious
surface upon completion, however the description of the project is for parking. Please note that the
Division requires the impervious surface determination to be made based on the final project/final
use. Please revise the PCN form and adequately indicate existing and new impervious surfaces as a
result of this project. Please note that gravel surfaces and some compacted fill surfaces may be
considered impervious by the Division.
2. Condition Number 12 of Water Quality General Certification #3821 details Stormwater
Management Plan Requirements for this project. A copy of General Certification #3821 is included
for your reference. Please review this project carefully to ensure that it meets the requirements of
Condition 12.

3. The second paragraph on Page 2 of General Certification #3821 states "Activities that are below
thresholds.... do not require written approval from the Division of Water Quality as long as they
comply with the Conditions of Certification listed below, including the Stormwater Management
Plan condition." Although written application is not required for this project, the Division
recommends that you apply for written concurrence to document review and approval of the
stormwater management plan.
Please note that you are not required to have written approval for this project per the requirements of General
Certification #3821, and therefore you are not required to respond to this letter. However please note that the
project is required to meet all Conditions of that Certification, including Condition #12 and Stormwater
Measures must be installed and operational prior to occupation of any building or use of any impervious
surfaces.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
