Dear Mr. McMillan:
We are submitting the additional information requested from written correspondence
on June 22, 2011. We are requesting for NC Division of Water Quality (DWQ) written 401
approval under Section 404, Clean Water Act, 33 USC 1344. We have addressed your
included written comments in the following paragraphs.
Please re-submit your site plans on full plan sheets at a scale of no smaller
than 1"=50' with topographic contours shown.
Please refer to the attached C400 plan sheet.
2. Please indicate all wetland impacts including fill slopes on the site plan.
Please refer to the attached C400 plan sheet. Existing wetlands and the
proposed wetland disturbance areas have been identified.
3. Please locate all isolated or non-isolated wetlands, streams, and other
waters of the State as overlays on the site plan.
Please refer to the attached C400 plan sheet. The existing non-isolated wetland
has been identified. There are no isolated wetlands on the property.

4. Per the requirements of the Neuse River Riparian Buffer Rule, you must
show that this site meets diffuse flow requirements with a level spreader or
other BMP per Chapter 8 of the BMP Manual.
Diffuse flow from this site is anticipated without level spreaders or BMP device. I
spoke with Ms. Lyn Hardison of the Washington regional office prior to submitting
the original package. There are no streams on the property and it is surrounded by
large wetland areas. No erosive velocities are anticipated from the rail expansion
project.

On May 9, 2011, the Division of Water Quality (DWQ) received your application dated April 28, 2011, and
Public Notice issued by the USACE on May 6, 2011, and received by the DWQ on May 6, 2011, to place
fill within or otherwise impact 1.74 acres of 404/wetland and and 0.00 square feet of Zone 1 Neuse River
protected riparian buffer, and 0.00 square feet of Zone 2 Neuse River protected riparian buffer, to construct
a rail expansion at the site. The DWQ has determined that your application was incomplete and/or provided
inaccurate information as discussed below. The DWQ will require additional information in order to
process your application to impact protected wetlands and/or streams on the subject property. Therefore,
unless we receive five copies of the additional information requested below, we will place this project on
hold as incomplete until we receive this additional information. If we do not receive the requested
information, your project will be formally returned as incomplete. Please provide the following information
so that we may continue to review your project.
Additional Information Requested:
