TO: NORTH CAROLINA-DEPARTMENT OF WATER QUALITY (DWQ)
The undersigned, EarthMark North Carolina, LLC, the Sponsor of the Cape Fear Riparian Buffer
and Nutrient Umbrella Bank (the "Bank"), hereby certifies the following:
Carino's Redevelopment has deposited monies with the Sponsor sufficient to
acquire 86.20 lbs of Nitrogen bank credits and 7.5 lbs of Phosphorus (the
"Credits") from the Carl Lloyd Nutrient Bank Site for use on its project Carino's
Redevelopment within the City of Durham Project No D1100001.
2. The Carino's Redevelopment project requires a total of 86.20 Nitrogen and 7.5
Phosphorus mitigation lbs/Credits Cape Fear River Basin Hue 03030002060070 as
part of its mitigation. Of this amount 86.20 Nitrogen and 7.5 Phosphorus
Credits are being provided by the Carl Lloyd Nutrient Bank Sites.
The Sponsor has deducted 86.20 Nitrogen and 7.5 Phosphorus Mitigation
Lbs/Credits from the Bank's credit ledger (s) from the Carl Lloyd Nutrient Bank
Site
A copy of the Carl Lloyd Nutrient Mitigation Site credit ledger reflecting the above transaction is
attached to this Affidavit.
