Reference is made to the July 8, 2011 meeting in which we met with Mr. Bret Mangum of
Anderson Creek Partners, your consultants, Mr. Chris Huysman of Wetland and Natural
Resources Consultants Inc, and Mr. Steve Tedder of Tedder Farm Consulting and NC DWQ
representatives to discuss the Anderson Creek South Project. During the meeting we advised you
that we felt we could recommend a permit decision on the information provided to date, but based
on review of that information, the decision would likely not be favorable. Subsequently, you
requested the opportunity to provide additional information to us, including an expanded
alternatives analysis, to include a smaller-sized lake. We have agreed to postpone any permit
decision until the additional information is received. Per our conversation, you agreed to provide
the additional information no later than 9 August 2011.
