SECRETARY Ms. Lori Beckwith, NCDOT Regulatory Project Manager U.S. Army Corps of Engineers 110676 151 Patton Avenue, Room 208 Asheville, NC 28801-2714 Subject: Nationwide 14 Permit Application Land of Lakes Subdivision-Road Additions (SR 1198, SR 1199, SR 2000) Polk County State Project No. 14C.075083 (DWQ Minor Permit fee $240) Dear Ms. Beckwith: The North Carolina Department of Transportation (NCDOT) is proposing to widen, grade, drain and pave three substandard gravel roads within Land of Lakes. Subdivision to NCDOT secondary road standards. The roads are SR 1198 (Bishop Lane), SR 1199 (Twin Drive) and SR 2000 (Hitching Post Road) in Polk County. SR 1198 begins at the intersection of SR 1138 (Silver Creek Road) and proceeds in a northeasterly direction for approximately 1550 feet to the intersection of SR 1199. SR 1 199 continues in a northerly direction for approximately 875 feet to the intersection of SR 2000. SR 2000 continues in a northerly direction for approximately 3435 feet to the end of the project. The total project length is 5,860 feet. I am enclosing a straight line diagram, a drawing of the pipe culvert extension, a marked county map, USGS quad map, and photographs. The North Carolina Natural Heritage Database was checked for records of threatened and endangered species. There are no records of threatened or endangered species for the unnamed tributary of Ostin Creek. Additionally, there are no records for Ostin Creek downstream of the confluence of the unnamed tributary. There are numerous records for the white irisette (Sisyrinciriuln c/icholomunt), a federally endangered plant, near the top of the watershed. All the records within the watershed are above 2400 feet elevation and are found in relatively high gradient areas. The areas to be affected by this project are less than 1200 feet and exhibit significantly lower gradient than the occupied areas near the top of the watershed. The habitat within the subdivision has been severely altered by development and the characteristic habitat of the white irisette is lacking. No white irisette were found along the road during a reconnaissance of the road on June 29, 2011. Effects on cultural resources are not anticipated. The project is being submitted to the North Carolina Department of Transportation's Human Environment Unit for review of potential impacts to cultural resources. NCDOT will conduct the appropriate site investigations and.obtain compliance from SHPO prior to project construction. The best management practices will be used to minimize and control sedimentation and erosion on this project. Water will be pumped around the culvert work area to minimize erosion and sedimentation from the pipe trench. The construction foreman will review all sedimentation control measures.during installation to ensure sedimentation is controlled effectively. If the planned device`s are not functioning as intended, they will be replaced immediately with better devices. The sedimentation control devices will be in place prior to pipe culvert removal and remain in place until the new pipe is in place. Impacts to Waters of the United States The unnamed tributary to Ostin Creek (DWQ Class: C Tr) is not shown on the USGS topographic map. The stream is approximately three feet in width with a well-defined channel composed primarily of cobble, gravel and sand. The channel lacks vegetation. There is a pond immediately above the culvert inlet. The unnamed tributary flows approximately 0.4 miles to Ostin Creek. Ostin Creek then flows approximately 1.4 miles to Lake Adger. Lake Adger meets the definition of a Traditional Navigable Water. For these reasons, we believe that the unnamed tributary of Ostin Creek is Relative Permanent Water and is under the jurisdiction of the U.S. Anny Corps of Engineers. In order to replace the culvert, it will be necessary to impact waters of the United States in the Broad River Basin. Specifically, NCDOT is requesting to replace and extend one metal culvert in an unnamed tributary to Ostin Creek. Listed below is a summary of the proposed impact. Site StNo. ation No. Station .
