On behalf of the Town of Belhaven, Kimley-Horn and Associates, Inc. is submitting the enclosed joint
404/401 Preconstruction Notification Application and Preliminary Jurisdictional Determination Request
for authorization to construct the above referenced project under a Nationwide Permit #23 and General
Water Quality Certification #3701. This project is included in the 2009-2015 NCDOT Transportation
Improvement Program as Project B-4500. A Programmatic Categorical Exclusion has been approved for
this project and signed by NCDOT (9/2/10) and FHWA (9/16/10). Field review of the project area was
conducted by the USACE (Tom Steffens), NCDWQ (Garcy Ward), and NCDCM (Stephen Lane) on July
22, 2010. The following information is included as part of this application submittal:

NCDOT Bridge Management Unit records indicate Bridge No. 324, constructed in 1940, has a
sufficiency rating of 22.6 out of a possible 100 for a new structure. The posted weight limit on the bridge
is down to 8 tons for single vehicles and 14 tons for truck-tractor semi-trailers. The bridge is considered
structurally deficient.
The purpose of this project is to replace the Water Street Bridge (Bridge #324) over Wynn's Gut, a
tributary of Pantego Creek in Belhaven, Beaufort County, North Carolina. The current bulkheads under
the bridge are part of the existing structure and will also be replaced. Bridge No. 324 is constructed of
timber and steel and should be possible to - remove with no resulting debris in the water based on standard
demolition practices. The bridge will be replaced on the existing alignment with traffic being detoured
offsite during the construction period.
The project site begins in front of the Pungo District Hospital and proceeds in a southeast direction across
the tributary to the intersection with Wynn's Gut Lane before ending in front of the building for the
Community Developers of Beaufort. In addition to the bridge replacement, this project will also consist
of new grading and paving for the locations immediately surrounding the bridge to tie the new bridge to
the existing roadway.
The site consists of areas along Water Street and the bridge carrying Water Street across Wynn's Gut.
The main drainageway for the area is Wynn's Gut. Wynn's Gut flows to Pantego Creek which flows to
the Pungo River which ultimately discharges into the Pamlico Sound. Land use in the vicinity of the site
is urban including the Pungo District Hospital to the west, the marina to the east, residential and
commercial development to the north, and open water to the south.
All the soils in this area are classified as urban land (Ur) with more than 85 percent of the surface area
covered with streets, buildings, parking lots, and airports. This area has been greatly altered by cutting,
filling, grading, and shaping. Slopes range from 0-6 percent.
The project is approximately 0.06 miles in length. Approximately 0.21 acres will be disturbed during the
construction of this project. Bridge no. 324 is 52 feet long. The replacement structure will be it bridge of
51.5 feet in length. The current bulkheads under the bridge will be replaced. The proposed bridge will
include two I 1-foot lanes, curb and gutter, and 5-foot sidewalks on both sides. The roadway grade of the
new structure will be approximately the same as the existing stricture, varying one fool or less for the
existing ground. In addition, approximately 0.09 acres will be stabilized with grass and permanent
plantings.
Authorization is being requested for 0.042 acre of temporary impact to jurisdictional waters (Wynn's Gut)
associated with the removal of the existing 3 span bridge which is being replaced with a single span
structure and 0.016 acre of permanent impact associated with fill required for the bulkhead replacement.
In addition, the bridge replacement will impact 1,581 sq ft. of Zone I Tar-Pamlico riparian buffers and
609 sq ft. of Zone 2 buffer. There are no jurisdictional wetlands located within the project area.

north, and open water to the south.

The purpose of the proposed project is to replace bridge no. 324 carrying Water Street over Wynn's Gut. Structural
components of bridge no. 324 are experiencing an increasing degree of deterioration that can no longer be addressed by
reasonable maintenance activities and the bridge is approaching the end of its useful life.

Bridge no. 324 is 52 feet long. The replacement structure will be a bridge of 51.5 feet in length. The existing bulkheads
under the bridge will be replaced. The proposed bridge will include two 11-foot lanes, curb and gutter, and 5-foot
sidewalks on both sides. The roadway grade of the new structure will be approximately the same as the existing
structure, varying one foot or less for the existing ground.

All practical measures have been taken to avoid and minimize impacts to the riparian buffers and open waters. The original
design for the proposed project called for swales to be cut through the riparian buffers in order to control runoff from the
adjacent roadway. The swales were removed from the design in order to eliminate ground disturbance within the riparian
buffers.

Turbidity curtains were placed outside of the existing bulkheads to catch sediment that may be disturbed during construction
of the new bulkheads.

The pupose of the project is to replace bridge no. 324 which has been determined to be structually deficient. The project

According to the USFWS, Wynn's Gut would be considered suitable habitat for the West Indian Manatee.
Correspondence with the USFWS indicates that as long as the Guidelines for Avoiding Impacts to the West Indian
Manatee (June, 2003) are implemented, the project should not have an adverse impact to the manatee (email
communication; Gary Jordan, USFWS - 06/03/2010).

Based upon a review of mapping at the State Historic Preservation Office (SHPO) in Raleigh, NC on April 5, 2010, there
are no known National Registar listed properties, properties eligible for listing, or historic districts within the project study
area. The project study area is adjacent to the Belhaven Historic District and the Belhaven Commercial District. Based
upon a review of mapping at the State Office of Archaeology on April 5, 2010, there are no known archaeological
resources within the project study area.

that was not studied as a part of the effective FEMA Flood Insurance Study (FIS). The flood hazards designated at the
bridge location on the effective Flood Insurance Rate Map (FIRM) are associated with storm surge flooding. Because the
tributary has not been studied by FEMA, and because of the bridge's location within a coastal flooding area, FEMA
coordination was not required. This was confirmed by the North Carolina Department of Transportation, which reviewed
and approved the bridge replacement design and associated hydraulic study.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions, (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F. R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or

A. Proieet Description:
The purpose of this project is to replace Bridge No. 324, carrying Water Street over Wynn's Gut,
a tributary of Pantego Creek and the Pungo River, in Belhaven, Beaufort County. Bridge No. 324
is 52 feet long. The replacement structure will be a bridge 51.5 feet long. The current
bulkheads under the bridge are a part of the existing structure and will also be replaced. The
bridge will include two 11-foot lanes, curb and gutter, and 5-foot sidewalks on both sides. The
roadway grade of the new structure will be.approximately the same as the existing structure,
varying.one foot or less from the existing ground.
The approach roadway will extend approximately 100 feet from the west end of the new bridge
and 125 feet from the east end of the new bridge. The approaches will include a 24-foot
pavement width providing two travel lanes no wider than 12 feet. Curb and gutter.and five-
foot wide sidewalks will be provided on each side. The roadway is a local collector and will be
designed with a 25 mile per hour design speed.
Figures 1, 2, and 3 include study area mapping and project photos. Traffic will be detoured off-
site during construction.
B. Purpose and Need:
NCDCIT Bridge Management Unit records indicate Bridge No. 324 has a sufficiency rating of 22.6
out of a possible 100 for a new structure. The posted weight limit on the bridge is down to 8
tons for single vehicles and 14 tons for truck-tractor semi-trailers. The bridge is considered
structurally deficient. It has a structure condition appraisal of 2 out of 9 (Item 67 on the Bridge
Inspection Report). According to Federal Highway Administration (FHWA) standards, the bridge
is eligible for FHWA's Highway Bridge Program.
The,superstructure of Bridge No. 324 is made of a reinforced concrete floor on timber joists and
steel l-beams. The substructure consists of timber caps on timber piles. Timber components
have a typical life expectancy between 40 to 50 years due to the natural deterioration rate of
wood. Rehabilitation of a timber structure is generally practical only when a few elements are
damaged or prematurely deteriorated. However, past a certain degree of deterioration, most
timber elements become impractical to maintain and upon eligibility are programmed for
replacement. Structural components of bridge. No. 324 are experiencing an increasing degree
of deterioration that can no longer be addressed by reasonable maintenance activities, and the
bridge is approaching the end of its useful life.
C. Proposed Improvements:

10. Construction of bus transfer facilities (an open area consisting of passenger shelters,
boarding areas, kiosks and related street improvements) when located in a commercial
area or other high activity center in which there is adequate street capacity for
projected bus traffic.
11. Construction of rail storage and maintenance facilities in areas used predominantly for
industrial or transportation purposes where such construction is not inconsistent with
existing zoning and where there is no significant noise impact on the surrounding
community.
12. Acquisition of land for hardship or protective purposes, advance land acquisition loans
under section 3(b) of the UMT Act. Hardship and protective buying will be permitted
only for a particular parcel or a limited number of parcels. These types of land
.acquisition qualify for a CE only where the acquisition will not limit the evaluation of
alternatives, including shifts in alignment for planned construction projects, which may
be required in the NEPA process. No project development on such land may proceed
until the NEPA process has been completed.
13. Acquisition and construction of wetland, stream and endangered species mitigation
sites.
14. Remedial activities involving the removal, treatment or monitoring of soil or
groundwater contamination pursuant to state or federal remediation guidelines.

J.
Bicycle Designation: This portion of Water Street is not a part of a designated bicycle route nor
is it listed in the Transportation Improvement Program (TIP) as a bicycle project.
Bridge Demolition: Bridge No. 324 is constructed of timber and steel and should be possible to
remove with no resulting debris in the water based on standard demolition practices.
Alternatives Discussion:
No Build - The no build alternative would result in eventually closing the road which is
unacceptable given the Town of Belhaven's commitment to maintain the bridge and preserve
the connectivity along Water Street.
Rehabilitation - The bridge was constructed in 1940, and the timber materials within the
bridge are reaching the end of their useful life. Rehabilitation would require replacing the
timber components which would constitute effectively replacing the bridge.
Offsite Detour - Bridge No. 324 will be replaced on the existing alignment. Traffic will be
detoured offsite (see Figure 2) during the construction period. NCDOT Guidelines for Evaluation
of Offsite Detours for Bridge Replacement Projects considers multiple project variables
beginning with the additional time traveled by the average road user resulting from the offsite
detour. The offsite detour for this project would include Pamlico Street, Main Street, and Allen
Road. The majority of traffic on the road is through traffic. The detour for the average road
user would result in two minutes or less of additional travel time (0.3 miles additional travel). A
9 to 12-month duration of construction is expected on this project.
Based on the Guidelines, the criteria above indicate that on the basis of delay alone the detour
is acceptable. A representative of Pungo District Hospital (located adjacent to the bridge on the
west side) attended the Citizens Informational Workshop (described below/next page) and
indicated that the detour is acceptable. The hospital's emergency room entrance is located on
the west side of the hospital near Allen Street, and emergency responders arriving from areas
east of Belhaven primarily use Main Street and Allen Street.
Onsite Detour - An onsite detour was not evaluated due to the presence of an acceptable
offsite detour.
Staged Construction - Staged construction would require a temporary bridge beside the
existing roadway alignment, an additional cost for the temporary bridge, and extra right of way.
The existing bridge is not wide enough to phase construction. This option was not considered
further since an acceptable offsite detour is available.
New Alignment -Given that the alignment for Water Street is acceptable, a new alignment was
not considered as an alternative.
Natural Resources:
An Environmental Screening Report was prepared in April 2010. Field investigations by Kimley-
Horn and Associates, Inc. (KHA) staff were conducted on December 4, 2009.
Wetlands _ Field investigations by KHA staff determined that no wetland areas are located
within the project study area.
Public Involvement:
A Citizens Informational Workshop was field on Tuesday, February 23, 2010 at the Belhaven -
Town Hall. Eleven citizens attended, and two comment sheets were received. Adjoining
property owners requested that the navigable waterway remain high/wide enough for existing
boat traffic to continue use after the bridge is replaced. The second written comment received
expressed concern over frequent flooding in Belhaven, suggesting flood gates under this bridge.
Permits:
The US Coast Guard is responsible for administering Section 9 of the Rivers and Harbors Act. A
Section 9 permit is required for construction or modification of all bridges spanning navigable
waters. In lieu of the Coast Guard Bridge Permit, an Advance Approval (AA) process has been
established to reduce the permit burden for bridges over waterways in which only small craft
navigate and that typically have no adverse effects on the environment. Based upon
correspondence with the Coast Guard and NCDOT Natural Environment Unit staff, it is
anticipated that this project will follow the AA process.
Other Agency Comments:
The North Carolina Wildlife Resource Commission (NCWRC) provided a project-specific
comment that the area around B-4500 is characterized by higher salinity water 'primarily
supporting species under the jurisdiction of the NC Division of Marine Fisheries (NCDMF).
Coordination should be initiated with NCDMF to address impacts to aquatic species. NCWRC
recommends replacing this bridge with a bridge. Standard recommendations apply. According
to subsequent correspondence with NCDMF and NCWRC (documented in the Environmental
Screening Report, April 2010), the project study area is not designated as anadromous fish
spawning habitat or a primary nursery area.
The NCDENR Division of Water Quality (NCDENR-DWQ) provided the following project-specific
comments:
- Wynn's Gut is classified as an SC, NSW stream and is.listed on the current 303(d) list for
Chlorophyll a.
- Pantego Creek and associated tributaries, including Wynn's Gut, are class SC, NSW
waters of the State. NCDWQ is very concerned with sediment and erosion impacts that
could'reSult from this project. The NCDWQ recommends that highly protective
sediment and erosion control BMPs be implemented to reduce the risk of nutrient
runoff to Wynn's Gut. The NCDWQ requests that road design plans provide treatment
of the storm water runoff through best management practices as detailed in the most
recent version of NCDWQ's Stormwater Best Management Practices.
- This project, is within the Tar-Pamlico River Basin. Riparian buffer impacts shall be
avoided and minimized to the greatest extent possible pursuant to 15A NCAC 28.0259.
Copies of all letters received in response to the Scoping Letter (November 2009) are attached.

Response to Question 2: Manatees are considered seasonal inhabitants of North Carolina
typically occurring in June through October. This species inhabits a
variety of habitats including shallow coastal bays, lagoons, estuaries,
and inland rivers of varying salinity. Manatees typically inhabit
waters with depths ranging from 1.5 to 6 meters (about 5 to 20 feet).
Although water depths within the project study area are marginally
sufficient for manatee (the average water depth at the bridge is
approximately 3.3 feet and transitions to 5.3 feet about 100 feet
downstream of the bridge), according to the US Fish and Wildlife
Service (USFWS), Wynn's Gut would be considered suitable habitat
for manatee. The USFWS has prepared precautionary measures for
construction activities in waters used by manatee (Guidelines for
Avoiding Impacts to the West Indian Manatee, June 2003). According
to USFWS, if these guidelines are implemented by the:contractor
during construction, the project should not have an adverse impact to
manatee. Correspondence with USFWS indicating concurrence with a
Biological Conclusion of No Effect and the above referenced
doannent are attached.
" Clarification for Question 10: The North Carolina Department of Environment and Natural
Resources - Division of Coastal Management (NCDENR-DCM)
commented that it "appears that Public Trust Area and Public Trust
Shoreline Areas of Environmental Concern (AECs) will be impacted
and a Coastal Area Management Act (CAMA) permit will be required.
It is anticipated that the proposed bridge replacement will qualify for
authorization under a CAMA General Permit with no significant
effects to any AEC.
Response to Questions 28 / 30: Bridge No. 324 is located on the edge of the Belhaven Historic
District, a property eligible for listing in the National Register of
Historic Places. Through coordination with the State Historic
Preservation Office (HPO) and Federal Highway Administration
(FHWA), FHWA intends to make a de minimis ruling based on the HPO
concurrence that this project will have "no adverse effect" on the
Belhaven Historic District. HPO has concurred with this finding and
issued a "no adverse effect" call based on the use of the Texas Classic
rail and 8-inch non_mountable curb along the bridge.

Project Description:
The purpose of this project is to replace Bridge No. 324, carrying Water Street over Wynn's Gut,
a tributary of Pantego Creek and the Pungo River, in Belhaven, Beaufort County. Bridge No. 324
is 52 feet long. The replacernent structure will be a bridge 51.5 feet long. The current
bulkheads under the bridge are a part of the existing structure and will also be replaced. The
bridge will include two 11-foot lanes, curb and gutter, and 5-foot sidewalks on both sides. The
roadway grade of the new structure will be approximately the same as the existing structure,
varying one foot or less from the existing ground.
The approach roadway will extend approximately 100. feet from the west end of the new bridge
and 125 feet from the east end of the new bridge. The approaches will include a 24-foot
pavement width providing two travel lanes no wider than 12 feet. Curb and gutter and five-
foot wide sidewalks will be provided on each side. The roadway is a local collector and will be
designed with a 25 mile per hour design speed.
