On February 16, 2011 the Division of Water Quality received your letter dated February 15, 2011
concerning your request for DWQ's opinion on Duke Energy's application to FERC for a Non-Capacity
License Amendment. The planned and ongoing work to the Bridgewater Powerhouse is needed in order
to meet the requirements of the Relicensing Settlement Agreement for this project as well as the 401
Certification issued on November 14, 2008. Our understanding is that it now appears that the
powerhouse construction will be completed before the new FERC license is issued. Therefore the
Division supports your application for the Non-Capacity License Amendment to FERC.
