Sullins Dee Freeman Governor Director Secretary July 1, 2011 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Keith Page 340 Joe's Drive Chapel Hill, NC 27517 DWQ Project # 11-0546 Chatham County Subject Property: Page Property - AFTER-THE-FACT Ut to Cub Creek [030605, 16-41-2-10-(0.5), WSIV, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Page: On June 6, 2011, the Division of Water Quality (DWQ) received your After-the-Fact application dated June 2, 2011, with to impact or fill 287 linear feet of stream and 17,220 square feet of Zone 1 Jordan Lake protected riparian buffers and 11,480 square feet of Zone 2 Jordan Lake basin protected riparian buffers to reportedly provide buildable area for construction of an addition to the existing home on the property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please locate all isolated or non-isolated wetlands, streams, and other waters of the State as overlays on the site plan. 2. Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2. 3. Please enumerate all riparian buffer impacts on the site plan and clearly label impacts (Buffer Impact 1, etc.). 4. Please re-submit your site plans on full plan sheets at a scale of no smaller than I"=50' with topographic contours shown. 5. Please provide documentation identifying the month and year the stream was piped. Please provide documentation on how the stream impact length was quantified. 287 linear feet of compensatory stream mitigation is required for this project. Please provide a compensatory mitigation plan. The plan must conform to the requirements of 15A NCAC 2H .0500 and must be appropriate to the type of impacts proposed. If you choose not to mitigate for the impacts associated with piping the stream, you must restore to stream to its original location, including pattern, bed, and profile. Should this be the case, please submit your complete and comprehensive restoration plan. 8. If the pipe remains in place, this project may require a Major Variance from the Jordan Lake Buffer Rules to be granted by the Environmental Management Commission. 9. Please note, if this project is subject to the Jordan Lake Riparian Buffer Rule, all stormwater drainage from this site must be discharged through a correctly designed level spreader or treated by a stormwater BMP that removes a minimum of 30 percent of total nitrogen and total phosphorus prior to discharge through the riparian buffer. Level spreader design requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: http://portal.ncdenr.org/web/wq/ws/su/bmp-manual. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be returned and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
