The Corps will evaluate this prospectus and the establishment of the Global TransPark
Mitigation Bank in accordance with the procedures outlined in 33CFR Part 332
Compensatory Mitigation for Losses of Aquatic Resources. Additionally, this proposal
will be reviewed pursuant to the permitting authority under Section 404 of the Clean
Waters Act if construction involves the discharge of fill material in waters and/or wetlands
of the United States.
Location
The Bank is comprised of three sites totaling 4,600 acres located within the Lower Neuse
River Basin in Craven and Lenoir Counties North Carolina. The Dover Bay site is located
near Dover in Craven County (35.222562N -77.330320W). The Frog Hollow site is
located in the Neuse River floodplain in Craven County (35.275339N -77.253646W) and
the Stonyton Creek site is located near Kinston in Lenoir County, North Carolina
(35.337742N -77.583135W).

Applicant's Stated Purpose
The bank sponsor proposes to establish and operate a wetland and stream compensatory
mitigation bank to compensate for losses authorized by applicable federal and state
regulatory programs.
Project Description
The sponsor proposes to establish a mitigation bank using mitigation credits developed in
association with approved mitigation plan dated January 1997 (Plan) required by the
Department of the Army permit issued to the North Carolina Global TransPark Authority
(Action ID SAW-1992-02851). Anticipated impacts did not occur and the NCGTP has
excess mitigation credits. The sponsor proposes to use existing wetland and stream
restoration, enhancement and preservation at three sites within the Lower Neuse River
Basin. The restoration and enhancement components of the proposed bank have been
implemented and monitored for a period of five years. Conservation easements for each
of the sites have been recorded. The Stonyton Creek Conservation Area is protected
through a Conservation Declaration recorded in the Lenoir County Courthouse. The
conservation area will remain under ownership of the North Carolina Global TransPark
Authority (NCGTP). The Frog Hollow Preservation Site is protected by a Conservation
Easement conveyed to the Coastal Land Trust, recorded by the Craven County Register of
Deeds on February 27, 2009. The Dover Bay Mitigation Site was purchased by the
NCGTP in 1998. A conservation easement was granted to the North Carolina Wildlife
Resources Commission in 2006.
The proposed Geographic Service Area for this bank includes the Neuse River 8-digit
hydrologic unit code (HUC) 03020202 as well as an adjacent 12-digit HUC
030202030704. The proposed bank may provide wetland and stream mitigation credits
for Section 404 authorized impacts.
Evaluation and Commenting Information
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials, including any consolidate State Viewpoint or written position of the
Governor; Indian Tribes and other interested parties in order to consider and evaluate the
establishment of the Pancho Stream and Wetland Mitigation Bank. Any comments
received will be considered by the Corps of Engineers in evaluating the approval of this
bank. All factors which may be relevant to the proposal will be considered including the
cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historic properties, fish and wildlife values, flood
hazards, flood plain values (in accordance with Executive Order 11988), land use,
navigation, shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and, in general, the needs and welfare of the people.

The Corps has reviewed the proposal and has examined all information provided by the
sponsors. Preliminary review of this proposal indicates the following: 1. An environmental
impact statement (EIS) will not be required. 2. No listed species of fish, wildlife, or plant
(or their critical habitat) listed as endangered or threatened under the Endangered Species
Act of 1973 are expected to be effected by the construction of this bank; and 3. No
cultural or historic resources considered eligible or potentially eligible for listing on the
National Register of Historic Places are located within the proposed project site.
Accordingly, the Corps is making a "no effect" determination for threatened and
endangered species and for cultural and/or historic resources at this time.
Written comments pertinent to the proposed work, as outlined above, will be received
in this office, Attention: Ms. Tracey Wheeler, Washington Regulatory Field Office, Post
Office Box 1000, Washington, North Carolina 27889, until 5:00 p.m., July 28, 2011.
