The following responses are provided to address the comments contained in your June 3,
2011 Request for More Information pertaining to the Individual Permit (IP) Application
for the Carolina North Project. Each North Carolina Department of Environment and
Natural Resources, Division of Water Quality (DWQ) comment is provided in italics and

This project is subject to Stormwater Management Plan (SMP Requirements for
Applicants Other Than the North Carolina Department o Transportation (see
hitp://portal.ncdenr.org/web/w•q/.viIV/x,s/401/certscnulpermits/svtnurncrgement). Foreaeh
proposed BMP, please provide a completed BMP Supplement Form with all required
items (see http://portal.ncdem°.or='weh/iwghvs/su/bnap-manual).
The 50-year Carolina North development shown in the EP Application for Carolina North
will occur in phases that correspond to projects funded for design and construction. For
each project, SMP approval will be sought from DWQ or the Town of Chapel Hill, which
is a certified local government.
Prior to construction of the first funded project at Carolina North, the University will
provide completed BMP Supplement Forms for each BMP with all required items for
SMP review by DWQ.
The University formally requests a 90-day extension from DWQ in order to provide the
SMP for the first funded project at Carolina North.

2. Is this project being reviewed by the North Carolina State Clearinghouse under SEPA?
If so, has a FONSI or FOSI been generated? Please provide this documentation or a
timeline as to when it may be submitted if applicable.
The project is being reviewed by the North Carolina State Environmental Review
Clearinghouse (Clearinghouse) under the State Environmental Policy Act (SEPA). An
Environmental Assessment (EA) was submitted to the Clearinghouse for review on May
11, 2011. The Clearinghouse review period will be completed on July 2, 2011. Once a
Finding of No Significant Impact (FONSI) or Finding of Significant Impact (FOSI) is
generated, the documentation will be provided to DWQ.
The University formally requests a 90-day extension from DWQ in order to provide the
FONSI or FOSI for Carolina North.
3. Per the requirements of the Jordan Lake Riparian Buffer Rule, all stormwater drainage
from this site must be discharged through a correctly designed level spreader or treated
by a stormwater BMP that removes a minimum of 30 percent of total nitrogen and total
phosphorus prior to discharge through the riparian buffer. Level spreader design
requirements are set forth in Chapter 8 of the North Carolina Stormwater BMP Manual,
available at. httn://L?ortul.ncdew.o?/xeb/u?q/tivs/.5u/bmp-r?ianual.
As shown in the Stormwater Concept Plan for Carolina North (see Appendix F of the I P
Application for Carolina North), all drainage from Carolina North will be treated by
stormwater BMPs that remove a minimum of 30 percent of total nitrogen and total
phosphorus prior to discharge through the riparian buffer.
LTNC-CH understands that no impacts to wetlands, waters or protected buffers are
