Lia, Bob Kessler who heads up our marketing for the Flat Swamp Mitigation Bank alerted me to his recent conversation
with you about accounting and approvals related to our nutrient and Neuse River buffer mitigation credits. At your
request I am attaching the following:
1. Two recent letters directed to Eric Kulz requesting approval from DWQ as required in our MBL
2. A copy of our ledger reflecting these debits.
For your information these are the first two debits since release of credits was authorized. We hope to add a lot more!
We do need a communication back indicating that both are approved.
Let either Bob or I know if you have questions. We do look forward to working with you as we move this project
forward.

Dear Eric,
This serves as our request under Paragraph V.D of the banking instrument executed June 15,
2009 for authorization to sell 874.8 pounds of nutrient credits to Ample Storage, LLC to satisfy
impacts they have within HUC 03 020202. These credits are being used to offset a stormwater
management permit issued to Ample Storage LLC also known as Lampe Storage Facility by the
City of Goldsboro, issued on or about March 4, 2010.
Upon notification from you that this sale is approved we will debit the existing nutrient credit
ledger by 874.8 pounds and send a copy of the ledger for your files.
