The stream restoration project is on White Oak Creek and tributaries in Wake County, NC, between NC Highway 55 and Davis Road. The non-federal sponsor for this project is the "Town on Cary. The restoration project will include channel relocation, bench cuts, in stream features (cross veins/ J-hooks/ rock veins/ pool & riffle construction) and back filling of the abandoned stream channel. Additional features include removing sediments that have eroded into a pond and construction of two upland stormwater detention ponds. Since this project is proposed by the Corps, no Corps permit is required, but the action will adhere to the terms and conditions of the Corps Regulatory Nationwide Permit No. 27. Also it is the Corps' opinion that the project complies with Water Quality General Certification No. 3689. Five copies of the Preconstruction Notification Form (PCN) and required attachments are included with this submittal (two full sets of plans and three 11 "x 17"). The State Clearinghouse provided comments on the environmental assessment for this project in February 2009, and these comments are also included with the attachments. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The main channel of White Oak Creek and its unnamed tributaries within the project area have been degraded as evidenced by sections of the channel becoming incised and several active headcuts. There has also been a separation of the channel from its associated floodplain further reducing the water quality of the streams. The area surrounding the streams is mainly residential subdivisions with insufficient storm water retention features. Sandy sediment from a degraded tributary is accumulating at the head of a pond. 3b. List the total estimated acreage of all existing wetlands on the property: No evidence of wetlands with in the project area. 3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property: 1,425 LF 3d. Explain the purpose of the proposed project: The purpose of the project is stream restoration which includes channel relocation, bench cuts, instream features (cross veins/ J-hooks/ rock veins/ pool & riffle construction) and back filling of the abandoned stream channel. Also sediment that has accumulated at the head of a pond will be removed, and two upland stormwater detention ponds will be constructed. 3e. Describe the overall project in detail, including the type of equipment to be used: This project wiill be a stream restoration project. The project construction work will be completed by a contracted construction firm and will include creation of three bench cuts and stream restoration along with the creation of the instream features. The bench cuts (1, 3 and 11) will be on the main stem of White Oak Creek and cover a distance of 309 feet, and the stream restoration on an unamed tributary of White Oak Creek covers a distance of 1,116 feet. This work will be acomplished with the use of track hoes with the excavated material being used to back fill the old stream channel. Also, about 600 cubic yards of sandy sediment from a degraded tributary that has accumulated at the head of a pond will be removed and used to backfill the old stream channel. Any excess material will be hauled off site. In additon, adjacent to the upland portion of the unamed tribuarty of White Oak Creek that is to be restored, two upland detention ponds are to be constructed. DENR Project No. 09-0179 Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject document and we are familiar with the habitat values of the area. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and North Carolina General Statutes (G.S. 113-131 et seq.). The U.S. Army Corps of Engineers (Corps) and Town of Cary ("Town) propose to implement an ecosystem restoration project on White Oak Creek and its tributaries between Davis Drive and N.C. Highway 55. Eleven sites were evaluated and restoration activities will take place at eight sites. Activities include construction of two dry detention ponds (Sites 6 and 7) and stream restoration including bank protection, head cut repairs, bench cuts and/or channel modifications (Sites 1, 2, 3, 4, 5, and 11). The purpose of the project is to restore channel stability and habitat quality to White Oak Creek and its tributaries. White Oak Creek is a tributary to B.E. Jordan Reservoir in the Cape Fear River basin, While there are no records for federal or state listed aquatic species in White Oak Creek, B.E. Jordan Reservoir supports a diverse fishery including sunfish (Lepomis spp.), crappie (Pornoxis sp.), catfish (Ictalurus sp.), largemouth bass (Micropterus salmoides), and striped bass (Morone saxatilis). In addition, there are records for the state threatened bald eagle (Haliaeetus leucocephalus) in the B.E. Jordan Reservoir watershed.
