Sullins Dee Freeman Governor Director Secretary CERTIFIED MAIL: 7010 2780 0001 4221 6023 RETURN RECEIPT REQUESTED Dean Green, President Greensboro Auto Auction, Inc. 3907 West Wendover Ave Greensboro, NC 27409 Re: Section 401 Water Quality Certification application Dear Mr. Green: June 7, 2011 DWQ# 10-0988 Guilford County On May 12, 2011, the North Carolina Division of Water Quality (Division) received additional information related to your application for a 401 General Water Quality Certification to impact 295 linear feet of an unnamed tributary to South Buffalo Creek for the 4009 West Wendover Ave Retail and Auto Auction Parking Project in Greensboro, NC in Guilford County. Additional information is again required in order that we may determine your project's compliance with 15A NCAC 2H.0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506. Please provide the following information so that we may continue to review your project. 1. The Division has been notified by the US Army Corps of Engineers (USACE) that they have received comments during the public notice period and will request your response to the comments. When you respond to the USACE, please copy the Division of Water quality also. Per our discussion in a meeting on February 8, 2011, we still require more detailed documentation regarding avoidance and minimization of stream impacts for this project. This should include stream relocation, retaining walls, alternative designs and layouts of the buildings and parking areas, etc, including modifying the type of use of the property. The documentation submitted on May 12, 2011 and the plan sheets submitted to the USACE for the public notice do not adequately address avoidance and minimization. The application documentation indicates a "future restaurant". Please specify what type of restaurant is being proposed and show the building location on the plans. Please also indicate the required parking per Greensboro City Ordinance. Please clearly show which parking spaces are dedicated to the future restaurant on the plans (highlight, hatching, label, etc). Please also clearly designate the parking spaces dedicated for Kaplan University and for the Greensboro Auto Auction on the plans. In addition, please show alternative layouts of the property that have been considered which may reduce the stream impacts. These should include an analysis of an alternative use of the restaurant space or an alternative type of restaurant that may require less space, or an alternative layout of the property that would locate parking away from the stream. Please also consider retaining walls on both sides of the stream to minimize the impact length to the stream. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to Sue Homewood at the address on this letterhead, and a copy to Ian McMillan N. C. Division of Water Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the Division.
