PROJECT SUMMARY: The project sites were previously permitted through the general permit process (57807C & 57833C) as temporary structures. These permits are set to expire on 9/30/11 and 10/18/11. The applicant has stated that at least 36 months would be needed in order for the scientific study to be completed and are asking for the structures to remain in place for this time period. 9. Narrative Description The NC State University Department of Biology project is located on two sites, 112 Mansfield Parkway and 2050 Mason Lane and is located within a branch of Peletier creek and Porters Creek. Porters Creek connects to Newport River while Peletier Creek connects to Bogue Sound. Mansfield Parkway is found by travelling east along Hwy 70 and is located approximately 300 feet east of the existing Kniart retail store and adjacent to the Parker Pontiac car dealership. Turn right at the car dealership onto Mansfield Parkway and continue until the first road on the right. The site is located immediately north of this road. The Mason Lane site is found by following Hwy 70 east in Morehead City town limits to North 20th Street. Turn left on N. 20th and follow until it intersects Country Club Road. Turn right onto Country Club Road and continue for less than I/4 of a mile. Mason Lane is located on the left. Follow Mason Lane until it terminates at 2050 Mason Lane. The total length of the shoreline for the Mansfield Parkway site is 300' while the Mason Lane site has 1000' of shoreline. The project areas for both sites are 500 square feet in their entirety. There are coastal wetlands located onsite; however, the current locations of the fish antennae are not affecting the coastal wetlands. The coastal wetlands consist predominately of Spartina patens (salt meadow cordgrass), Juncus roemerianus (black needlerush) and Spartina alterniflora (smooth cordgrass). The high ground in both areas is comprised of pines and scrub bushes. The Mansfield Parkway site is undeveloped within the project area with the exception of the fish antenna kiosk while the Mason Lane site has an existing single-family home, driveway, shed and fish antenna kiosk. The 9/28/2007 Morehead City Land Use Plan classifies this property as commercial/low density residential with all parts of the AEC classified Conservation. This section of the Newport River/Porters Creek is not designated as Primary Nursery Area and is open to the taking of shellfish. Peletier Creek is not designated as a primary nursery area and is closed to the taking of shellfish. Porters Creek is approximately 25' wide within the Mason lane site and carries a water classification of SA/HQW. The tributary connecting to Peletier Creek is 9' to 20' wide depending on location and carries a water classification of SB. This tributary is connected to Peletier creek via a road culvert. It is tidally influenced however terminates approximately 300 from the fish antenna's current location. Substrate in the Newport River/Porters Creek and Peletier Creek is comprised of sand and silt. No SAV's or shellfish beds were observed within the proposal project area. Water depths within both project areas are < 6 inches nlw. 10. Proiect Description: f The existing general permits (57807C & 57833C) authorized temporary fish antennae at Field Investigation Report: NC State University Department of Biology Page 03 both sites. The Mansfield Parkway site currently has three in place with one in place at the Mason Lane site. The current proposal is for the previously permitted antennae to remain for an additional 36 months. The applicants stated this additional time is necessary to complete their scientific research. Both fish antennae are 3' wide by 7' long and constructed of 8" OD schedule 40 PVC. The Peletier Creek site currently has three antennae in place. One is located at the discharge of the existing road culvert; one is located within the North West ditch branch with the final antenna located within the southwest ditch branch. Due to the narrowness (< 20' wide) and shallow water depths (<6" nlw) within this project area as well as the termination of these ditch branches a few hundred feet away, this area has not been traditionally used for any type of boat or canoe use. The Mason Lane site is located within a locally named tributary called Porters Creek which connects to the Newport River. The water depth within the project area is <6" nlw as well. The width of the creek within this area is 25'. The applicants were permitted to place three fish antennae within this location; however, after reviewing the site, they determined only the placement of one was necessary. Due to the shallow water depths (<6" nlw) and the narrowness (<25' wide) of this creek it can normally only be accessed by canoes, kayaks or john boats. The fish antenna was placed flat on the creek bed and secured to help ensure it would not float and not obstruct navigation. 11. Anticipated Impacts: The fish antennae would incorporate a total of 84 ft' of shallow bottom habitat (63 ft2 in Peletier Creek and 21 ft2 in Porters Creek). Due to the low profile characteristics of the antennae and infrequent use of these areas by the public, the Division does not anticipate interference to navigation or public use. The proposal is to allow previously permitted and temporarily placed fish antennae. to remain for a period of 36 months to help with the completion of a scientific research project. The existing general permits are set to expire on 10/18/11 for the Mason Lane site and 9/30/11 for the Mansfield Parkway site. The project has three existing fish antennae located within an unnamed tributary which connects to Peletier Creek and one existing fish antennae located within Porters Creek. The low profile characteristics of the antennae and infrequent use of these areas by the public do not unreasonably interfere with navigation or public use. Therefore the District recommends the project be authorized as proposed on plats dated received May 13, 2011, contingent upon the following specific conditions and all applicable standard conditions: The authorized structure and associated activity shall not cause unreasonable interference with navigation. 2. No wetlands shall be excavated or filled. 3. The fish antennae shall not exceed the distance as shown on the plats. 4. No Slips or excavation is authorized. Give complete description: We are commencing a study of movement, growth, and production of small estuarine fish with the use of passive integrated transponder (PIT) tags. A PIT tag is a small electromagnetic chip that gets inserted into fish. To detect a tagged fish, the fish needs to pass through a coil of wire encased in a loop of 6 inch PVC. We need to temporarily place three loops-of PVC in the creek. The use of three PVC loops (as opposed to one or two) allows us to better determine directionality of movement in and out of the creek.
