9. PROJECT DESCRIPTION
The project site is located at 2001 Sommersett Landing, adjacent to the Atlantic Intracoastal Watei,~~ay,
on the mainland side of the AIWW, between the Town of Ocean Isle Beach and Sunset Beach. in
Brunswick County. To find the property from NC Highway 17 South, turn left onto NC 904 /Seaside
Road SW. Travel approximately 3.5 miles to NC 179 /Beach Drive SW, turn left and travel
approximately 0.6 miles to Sommersett Road SW. Turn right onto Sommersett Road SW, and travel
approximately 0.4 miles until the road dead ends at the subject property.
The property is an approximately 5-acre tract of land owned by TJM Ocean Isle Partners, LLC, c/o Tim
Moon. The existing marina is a full service facility consisting of 25 wet slips, 270 dry storage racks with
forklift haul out. The facility also includes a boat ramp, shower facilities, a full service boat yard and
fuel. The existing facility consists of the following two main structures: a floating dock located just to
the west of the boat ramp, which consists of 5 permanent slips on the west side and temporary tie-up
slips on the east side for launching via ramp and forklift_ Located east of the boat ramp is a fixed pier
which terminates in a "T-head" and has a floating dock located in the center of the main pier on the east
side and a floating docks on the landward side of the east end of the "T-head". There is an existing
boatlift on the west side of the main pier landward of the "T-head". The applicant states this entire
structure will accommodate 17 slips. There is another floating dock located just east of the main pier
adjacent to the bulkhead with an additional 3 slips creating a total of 25 existing slips for the entire
docking system.
The property is bordered by residential property to the west, north, and. east and the AIWW to the south.
The marina facility has been in existence since originally permitted on January 14, l 982, permit #4-82
issued to Charlie Furr. A second permit #169-88 was issued on September 2, 1988 for maintenance
dredging, a travel lift and extension of the pier. This permit was issued to M & J Marine Services. The
marina was later sold and in recent years operated under the name of Pelican Point Marina. The facility
has been issued several CAMA General Permits for a boatlift addition and bulkheads, (see, GP Nos.
17534, 18363, 38477 and 45823).
The waters of the AIWW in this location are classified as "SA, HQW" by the North Carolina Division
of Water Quality. The area is designated as a Primary Nursery Area by the North Carolina Division of
Marine Fisheries and is closed to the harvest of shellfish.
PROPOSED PROJECT
TJM Ocean Isle Partners, LLC is currently proposing renovation of the Ocean Isle Marina by the
replacement and reconfiguration of the existing fixed and floating docks, filling of the existing boat
ramp, construction of a new fork lift pad, replacement of the existing bulkhead, addition of boat lifts and
dry stack units, demolition of existing buildings, construction of additional parking areas. construction of
an elevated boardwalk and maintenance dredging of the basin.
The existing dock configuration, as counted by the applicant, includes approximately 25 docking spaces
or slips and approximately 5 temporary tie-up slips. The applicant is not proposing any increase in the
total number of penr~anent or temporary slips (see Sheets 6 & 7). As proposed, there w~~ulcl he ~~ n~~~~

long extending waterward from the bulkhead which would be accessed by a ramp measuring
approximately 4 feet wide by approximately 20 feet long, located just west of the forklift pad. The east
side of this structure ~~ould provideapproximately 4 temporary slips designated for the launching and
retrieval of boats. There would be an "L" shaped floating dock on the west side of this structure
measuring approximately 8 feet wide by approximately 190 feet long running parallel the AIW~~~. On the
waterward side of this structure would be six (6) finger piers, each measuring approximately four feet
wide by 35 feet long, extending perpendicular to the AIWW. These finger piers would accommodate
thirteen (13) slips, including twelve (12) boatlifts. Slips #2-5 would each have a boatlift measuring
approximately 12.5 feet wide by 12.5 feet long and the boatlifts for slips #6-13 would measure
approximately 14 feet wide by 12.5 feet long. No slips are shown on the landward side of the proposed
8' by 190' floating dock.
A second floating structure is proposed which would be located on the east side of the fork lift pad acid
would be accessed by an "L" shaped ramp measuring approximately 4 feet wide by 32 feet in total
length. The main floating dock would measure approximately 8 feet wide by approximately 112 feet
long, extending waterward perpendicular to the AIWW. On the west side of this structure and adjacent
to the bulkhead is proposed a finger dock measuring approximately 8 feet wide by approximately 88 feet
long rumiing parallel to the shoreline. The west end of this structure is designated as a temporary slip for
launching, retrieving and/or fueling. There would be another finger dock on the east side of~ the main
floating dock adjacent to the bulkhead running parallel the shoreline, measuring approximately 8 feet
wide by approximately 48 feet long, designated as one (1) slip. In the middle of the main floating dock
would be two more finger docks, one measuring approximately 4.5 feet wide by approximately 40 feet
long and one measuring approximately 4.5 feet wide by approximately 50 feet long. Both of these finger
docks would run parallel to the shoreline and would be located on the west side of the main floating
dock. The main floating structure would terminate in an "L-head" which would measure approximately
8 feet wide by approximately 64 feet long and would extend westward. This floating dock system is
designated to accommodate a total of twelve (12) permanent slips.
The applicant is also proposing to perform maintenance dredgin~~ of the original boat basin arra i ~~'~~
Sheet 8 & 10), which was originally permitted oil .lanuary 14, 1982 under State permit #~4-h_' anal ~-~-~~~
permitted at a final depth of -6 feet @ mean low water (MLW). The applicant is proposing to excavate
an area measuring approximately 200 feet by 150 feet long, to a depth of -6 feet @ (MLW). The area to
be excavated would be located from the east side of the temporary tie-up floating dock and would extend
past the east side of the second main floating dock. Approximately 3,111 cubic yards of material would
be removed by bucket and barge. The applicant is states that all spoil material be would be kept onsite
and placed on the northwest portion of the property (see Sheet 6). The spoil disposal area would measure
approximately 150' by 60' and would be contained by a silt fence (see Sheets 10.1 & 10.2).
The applicant is also proposing to fill in the existing boat ramp and utilize this area for the expansion of
the forklift launching pad (see Sheet 9). The area to be filled would measure approximately 35 feet by
approximately 24 feet and would require approximately 125 cubic yards of clean sand as fill material.
The applicant is also proposing to replace an existing bulkhead (see Sheet 1 l .l), which is located on the
east side of the boat ramp area and extends eastward approximately 337 feet. The proposed bulkhead
would also extend across the existing boat ramp, making the total length of the
new bulkhead approximately 394 feet including the wing wall. The applicant states that the proposed
bulkhead would be located an average of 2 feet and no more than 5 feet waterward of the existing
bulkhead and would require approximately 80 cubic yards of clean sand fill material below MHW. The

applicant is proposing to use both vinyl and steel sheet pile for the construction of the bulkhead. Coastal
wetlands, consisting primarily of Smooth Cordgarss (Spartina alternifloru) are located adjacent to the
existing bulkhead along the east side of the property. The applicant has proposed that .the hull:head in
this area be replaced in the same footprint, for a distance of approximately 1 12 linear meet. I h~ applicant
does not to propose to place any fill material within coastal wetlands.
The applicant is also proposing to construct an elevated wooden walkway to be located on the southwest
side of the property, waterward of and adjacent to the existing bulkhead (see Sheets 9 & 1 1.3). The
proposed walkway would measure approximately 6 feet wide by approximately 236 feet long and would
provide access from the amenities area on the south west corner of the property to the floating dock
containing Slips #1-13 and the temporary tie-up dock. This structure would extend over approximately
320 sq. ft. of coastal marsh consisting of Smooth Cordgarss (Spartinu ulternifloru).
The applicant is also proposing to replace four the existing single level dry stack storage racl:s ~-~ ith nc~~
four level units. Three of these units will also have removable racks on the bottom level for allcrnati~
parking (see Sheets 15 & 15.1). These units would measure approximately 15 feet wide by
approximately 40 feet tall and would very in length from approximately 34 feet to approximately 154
feet. These units would be located adjacent to the bulkhead (see Sheet 6) along the south and east side of
the property. It is also proposed the existing fuel tanks be relocated fi-om the east side of the existing
office building to the west side of the driveway adjacent to the existing metal dry stack building. New
gas pumps would be installed adjacent to the bulkhead on the east side of the forklift pad. All of these
structures would be located over existing impervious surface areas.
The applicant is also proposing to remove two (2) existing structures located on the cast arcl ~r~ril~~~~~~.ti~
side of the property. The first structure is refers-ed to as the "small boat building°' which measures
approximately 80 feet wide by approximately 126 feet long and the second structure is an existing single
story house measuring approximately 24 feet by 48 feet. These areas will be converted to a driveway and
additional parking. All of the existing graveled areas, (approximately 52,400 sq. ft.) will be converted to
concrete (see Sheets 12 & 13).
10. ANTICIPATED IMPACTS:
The filling of the existing boat ramp area would result in the filling of approximately 840 sq. ft. of open
water. The proposed bulkhead would result in the filling of approximately 332 sq. ft. of open water. The
new docking facility and associated slips would result in the incorporation of approximately 8,076 sc~. ti.
of estuarine waters and public trust area within the existing boat basin. (It is estimated that the current
marina design incorporates approximately 3,448 sq. ft.). The proposed docking system would extend
approximately 120 feet into a waterbody, which measures approximately 525 feet across. This distance
would conform with the 1/4 width rule and the established pier lengths. As proposed, approximately 6.5
feet of the floating docks would encroach into the U.S. Army Corps of Engineers 80-foot setback from
the AIWW, however all pilings are shown to be landward of the 80-foot setback (see Sheet 9). The
proposed structures would not encroach into the 15' riparian corridor setback. The floating docks would
potentially provide docking space for up to twenty-five

(25) permanent vessels and approximately five (5) temporary tie up spaces. The proposed dredging
would result in the excavation of approximately 30,000 sq. ft. of shallow bottom within a designated
primary nursery area previously authorized for excavation. The area is closed to the harvesting of
shellfish due to the presence of this marina. The proposed elevated walkway would result in the shading
of approximately 320 sq. ft. of coastal marsh, primarily Smooth Cordgarss (Spartinc~ alterniflo~~a).
As proposed, the total area of highground disturbance would be approximately 121,648 sd. ft., resulting
in the redevelopment of approximately 32,384 sq. ft. of existing impervious surface area within the 75-
Estuarine Shoreline AEC. This will result in a 65% impervious surface coverage within t he . A I
however no additional impervious surface coverage is proposed. Minor increases in turbidity should be
expected, but if construction is timed to avoid periods of peak biological activity impacts should be
minimal.
A state Stormwater Permit through the N.C. Division of Water Quality, (SW8 070106) was issued on
01/26/07. The application also states that a Sedimentation and Erosion Control Plan has been
concurrently submitted to the Division of Land Quality by Norris, Kuske and Tunstall Consulting
Engineers.

CAMA Major Permit

The subject tract is located at the end of SR 1161 where it intersects the AIWW.
This area is locally known as Sommersett Landing and is located between Sunset
Beach and Ocean Isle Beach, Brunswick County. The site has been an operating
marina since 1982 and is approximately 5 acres. Structurally there are two dry stack
storage buildings, a smaller building that serves as an office, three houses, two small
storage buildings, outdoor boat racks, fuel tank gas pumps, boat ramp, bulkhead,
boat docks and forklift pad. Currently most of the site is impervious surface.
The applicant proposes to fill in the existing boat ramp that measures approximately
26ft by 60ft to create a concrete launching dock (boat drop). On January 14~h, 1982 a
permit was issued (#4-82) for the above referenced property and included the
excavation of a boat basin in the open water measuring +/- 200ft by 150ft to the
depth of -oft at mean low water. The applicant proposes to reactivate this
maintenance dredging area with a modification to -6ft mean low water.
Approximately 3,100 cubic yards of spoil will be dredged using barge and bucket and
placed onsite within a silt fenced area. The applicant also proposes to remove all
existing fixed and floating docks and replace them with a new floating dock system
to accommodate 25 permanent slips and provide for temporary dockage for boats
being launched and retrieved from the dry stack storage facility. Existing dock layout
provides 25 permanent slips and approximately 130' of temporary tie-up dockage.
Verbal approval was originally given by the USACE Navigation Division (Howard
Varnum) for the floating docks to extend approximately 6.5' beyond the USACE
Channel Setback as long as all pilings associated with the floating docks were
installed landward of the setback. Written approval is forthcoming from James
Hargrove, with the USACE Navigation Division.
Upland development will consist of removing the small boat building on the eastern
side of the property to accommodate parking requirements. Existing impervious
areas consisting of gravel will be changed to concrete. The total area of impervious
cover within the 30' CAMA buffer will not increase. The existing dry stack storage
building and office building will have exterior renovations, and the existing concrete
floor of the dry stack storage building will be replaced to the same existing
dimensions. No modifications to the structure of the buildings are proposed. Existing
utility infrastructure will be utilized for the marina and buildings. A general permit was
granted on 7/12/06, #45823-D, for the installation of a new bulkhead along the
south-west edge of the property. The applicant proposes to add a wood walkway
along and attached to said bulkhead protruding 6' waterward. The walkway will
provide access to an amenities area on an adjacent property, proposed slips one
through thirteen, and the temporary tie-up dock. Existing one level dry stack boat
storage racks on the southern portion of property will be replaced with new four level
storage racks in the same location. Also the applicant proposes to re-bulkhead the
south and east sides of the property as shown in Figure #6.

5. INSPECT TEMPORARY SEDIMENT TRAPS /CHECK DAMS AFTER EACH
9 PERIOD OF SIGNIFICANT RAINFALL. REMOVE SEDIMENT AND RESTORE THE
TRAP TO ITS ORIGINAL DIMENSIONS WHEN THE SEDIMENT HAS
ACCUMULATED TO ONE-HALF THE DESIGN DEPTH OF THE TRAP, PLACE THE
SEDIMENT THAT IS REMOVED IN THE DESIGNATED DISPOSAL AREA AND
REPLACE THE CONTAMINATED PART OF THE GRAVEL FACING. CHECK THE
STRUCTURE FOR DAMAGE FROM EROSION OR PIPING. PERIODICALLY CHECK
