T am told that there are several dozen homes beyond this bridge on this dead end road. As a result, an extended road closure is not feasible. Further negotiations with the property owner @ the bridge site have proved fruitless. He continues to refuse right-of-way to install the single lane temporary bridge that would be necessary to maintain traffic while constructing u new spanning structure. The Wildlife Contntission and the property owner have both objected to the installation of the pipes that we proposed as a means of minimizing the length of any road closure. Since upgrading this structure to modern standards with new pipe or a new bridge doesn't appear possible, shoring up the abutment that created the prompt action notice appears to be our only viable option at this time. This work will not require additional fill in a jurisdictional area and therefore should not require permits. If further information is required, please let me know. Army Corps of Engineers Raleigh Regulatory Field Office 6508 Falls of Neuse Road, Suite 120 Raleigh, NC 27615 051'939 Subject: Nationwide Permit 414 & 03 Bridge #177 on SR 1137 Watauga County, North Carolina Project Number: 11B.209521 (DWQ Permit Fee: $200) Dear Mr. Thomas: We recently received a prompt action notice for Bridge #177 on SR 1137 indicating that there are serious structural deficiencies with this bridge. As a result, immediate action is required. This is a dead end road, so an offsite detour is not possible. We also were not granted right of way to install a temporary bridge adjacent to the existing structure that would be used to maintain traffic while the bridge is being rebuilt. Therefore, we will have to close this dead end road while we upgrade this structure. In order to minimize the hardship that an extended road closure would create to the property owners at the end of the road, we are proposing to install a CSPA (1 at 112"09"x50') at the same location. Direct impacts of the pipe installation will total 50 feet. Miscellaneous rip-rap impacts will total 20 linear feet. Total impacts at this location will be 70 feet. Please note: the existing bridge is located in an extremely rocky section of stream with many small waterfalls in the vicinity (see photos). We will try to bury the pipe the recommended one foot, but it is unlikely we will be able to due to the amount of rock present at this location. The replacement of the existing bridge with the proposed pipe will require temporary dewatering as well. An impervious sandbag dike will be constructed approximately 20 feet upstream of the existing structure to create a small pool. Clean water will temporarily be pumped around the construction area and will be discharged into a buffer area downstream. Any dirty water located inside the construction area will be pumped into a silt bag. The dewatered area will total approximately 0.010 acres. Bridge # 177 crosses Clark Creek (Class: C). The Division 11 Environmental Officer reviewed this project for the presence of threatened and endangered species on September 22, 2005. The subject project will have no effect on any federally listed endangered plant or animal species. Historic compliance work will be scheduled and concurrence with the State Historic Preservation Office will be obtained if required. Attached is a Preconstruction Notification Form, plan sheets, a marked county map, a marked topography map and photographs. Please note: the attached SR map is misleading. The bridge is actually located approximately 0.4 mile from the intersection of SR 1137 and SR 1136 and is the third bridge coming from the intersection of SR 1136 and SR 1137. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The existing bridge must be replaced due to its condition. By utilizing, all appropriate BMPs during construction adverse impacts to Clark Creek will be minimized. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as Page 7 of 12 incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at hitp1/h2o.enr..state._nc,_.us/ncwetlands/strm ide.litn 1. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction.
