APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Holder:
You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact 24 linear feet (If) (4 If for pipe replacement, 15 If for a rock ladder and 5 If for bank stabilization) and
temporarily impact 5 If (upstream dam) of an unnamed tributary* to Rocky Creek. The impacts are propo?.• <
for the purpose of replacing an existing pipe in anticipation of secondary road paving as described in your
application received by the Division of Water Quality (DWQ) on June 20, 2005. The location of the project
State Road 1298 (Bow Lane) in Iredell County. After reviewing your application, we have determined that t`
project is covered by Water Quality General Certification Numbers 3404 and 3366. These certifications
correspond to Nationwide Permits 14 and 33 issued by the U.S. Army Corps of Engineers (USACE). Plea
note that you should get any other federal, state or local permits before proceeding with your project, inclw <
those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply
Watershed regulations. This approval will expire with the associated 404 permit unless otherwise specifies:; '.
the Water Quality Certification.
This approval is valid solely for the purpose and design that you described in your application (unless mo6i -:
below). Should your project change, you must notify the DWQ in writing and you may be required to subE 4
new application. If the property is sold, the new owner must be given a copy of this Certification and appro-
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now c _
the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this app; ..

compliance with all specifications governing the proper design, installation, and operation and mainten''-v-,-.?

a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual.
The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil)
projects, including contractor-owned or leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
4. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in
order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
5. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic
conditions can be provided.
6. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
7. The dimension, pattern and profile of the stream above and below the crossing should not be modified.
Disturbed floodplains and streams should be restored to natural geomorphic conditions.
8. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
9. All work shall be performed during low or normal flow conditions.
10. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is prohibited.
11. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has
released the project.
12. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate,,fill or perform mechanized land clearing at any time in the construction or maintenance of this
project within waters and/or wetlands, except as authorized by this Certification, or any modification to this
Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall
be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this
Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it
is a direct impact from road construction activities.
13. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please
include photographs upstream and downstream of the structure to document correct installation.
14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state
water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act]
and any other appropriate requirements of state and federal law.

If DWQ determines that such standards or laws are not being met (including the failure to sustain a
designated or achieved use) or that state or federal law is being violated, or that further conditions are
necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions
appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC
2H.0507(d). Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public
notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with
15A NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided
to the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall
also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

SUBJECT: Pipe replacements/Secondary Road Paving, SR 1298 (Bow Lane), Iredell County
Dear Mr. Lund:
The North Carolina Department of Transportation requests authorization to replace existing pipes on SR
1298 (Bow Lane) in Iredell County associated with a secondary road paving project. At Station 12+00,
an existing 36", 40-foot pipe will be replaced with a 36", 44-foot pipe with 10 feet of associated riprap
at inlet and outlet for structure stabilization. The pipe inlet will be buried 5 inches below the existing
streambed elevation based upon the thalweg profile. The existing pipe is perched and is on an -6.5 %
slope. Reconnecting the upstream elevation directly to the downstream elevation would result in an
extreme pipe slope (>100/o), which could promote stream destabilization. Due to the existing site
conditions, NCDOT request a waiver from the Regional Condition 2(b)(e) permit depth specification, for
the construction of this project. It is proposed to leave the proposed pipe perched and construct a 10-15
foot rock ladder to connect the pipe outlet elevation to the downstream bed elevation. This will allow for
energy dissipation and some aquatic passage. The new pipe outlet invert will be placed approximately
one foot higher than the existing pipe outlet invert to decrease the proposed pipe slope from - 6.5% to
-2.5%. The stream is a low flow intermittent stream; therefore, it is anticipated that the flow can be
temporarily dammed and the pipe installed within an eight-hour period. Upon project completion, this
area will be restored to pre project conditions.
There are wetland areas adjacent to NCDOT right of way between Station 10+00 and 15+00. These areas
have been delineated and measures will be taken to avoid any permanent or temporary impacts during the
road paving/pipe replacement project. A seep originates in the drainage ditch at Station 14+90, at this site
an 18", 40-foot pipe will be replaced with a 24", 40-foot pipe. There is no defined channel on the
downstream side of this seep drainage area; therefore, the pipe will be placed on grade.
The scope of the work will result in a 4 feet of pipe fill impacts, 25 feet of riprap impacts from rock
ladder construction and streambank/structure stabilization, and 5 feet of temporary impacts to the
unnamed tributary to Rocky River, which is classified as Class C waters by the Division of Water
Quality.

This office has conducted a GIS and field survey for this project and is recommending a finding of "no
effect" for T &E species and historical structures. The proposed project is not located within any
designated critical resources waters or NC-designated waters or wetlands. Hazardous spill basins are not
required. Enclosed is the NCDOT hazardous spill basin checklist.
Enclosed is a PCN application for a Nationwide #14 and #33, sketches of planned activities, photographs
documenting existing conditions, and location maps relative to the project.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
A minor increase in pipe length is necessary at site #1 for construction of the road to paved road
standards Measures will be taken to avoid impacts to the sprinWintermittent stream in ditchline
adjacent to road at site #1 and the wetland areas adjacent to right of way in the vicinity of the
permitted area (See designation on erosion/sedimentation control plan). The existing pipe
outlet is perched and at an -6.5% slope To reconnect the upstream and downstream bed
elevations would result in an extreme pipe sloe (>10%l; therefore the outlet of the proposed
pipe will remain perched To decrease the slope of the pipe the proposed pipe outlet invert will
be approximately 1 foot higher than the existing pipe invert (which will provide for a pipe slope
of -2.5%). A rock ladder will be constructed connecting the pipe outlet to the downstream bed
elevation The rock ladder will dissipate energy and provide some aquatic passage.
V11L Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when

aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwettands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Since the existing nine is perched and is not currently allowing_Muatic passage. The
proposed mitigation for the minor impacts of this project is the construction of the rock
ladder, which will allow some aquatic organism passage.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the
