APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Holder: Alan W. Klimel- P.E. Director Division of Water Quality June 9, 2005 DWQ# 05-0999 Lincoln County You have our approval, in -accordance with the attached conditions and those listed below, to permanently impact 70 linear feet (If) of an unnamed tributary* to Indian Creek to construct a floodplain bench and two (2) cross vanes with pools and to install a gabion rock wall to stabilize a road shoulder.as described in your application received by the Division of Water Quality (DWQ) on May 31, 2005. The location of the project is Highway 27 near Lincolnton in Lincoln County. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3495. This certification corresponds to Nationwide Permits13 and 27 issued by the U.S. Army Corps of Engineers (USACE). Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval will expire with the associated 404 permit unless otherwise specified in the Water Quality Certification. This approval -is valid solely for the purpose and design that you described in your application (unless modified below). Should your project change, you must notify the DWQ in writing and you may be required to submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) -and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification and those listed below: 1. Streambed material (cobble) shall be salvaged during construction and used to reconstruct riffles as part of the stream relocation. 2. The floodplain bench should be installed to restore natural channel dimensions. The benches should be constructed of natural materials for bench stability. 3. A representative from the North Carolina Department of Transportation (NCDOT) environmental staff shall be present on site during the construction of the floodplain bench and cross vanes to provide guidance to the NCDOT Maintenance Personnel and/or selected contractor. 4. Indian Creek is classified as WS-11, High Quality Waters by the DWQ. The NCDOT shall strictly adhere to sediment and erosion control Best Management Practices as described for High Quality Waters entitled "Design Standards in Sensitive Watersheds" (15A NCAC 04B.0024) throughout design and construction of the project. 6. The presence of equipment in the channel must be minimized. Under no circumstances must rock, sand or other materials be dredged from the wetted stream channel. 7. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 8. Temporary dewatering sites must be restored-to pre-existing conditions unless more natural geomorphic conditions can _be provided. 9. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened. 10.The dimension, pattern and, profile of the stream above and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 11. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 12. All work shall be performed during low or normal flow conditions. 13. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 14. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within 30 days after the :Division of Land Resources has released the project. 15. The NCDOT and its contractors and/or agents shall not excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it is a direct impact from road construction activities. 16. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please include photographs upstream and downstream of the structure to document correct installation. 17. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act] and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Page 3 Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. C. 28801-5006 SUBJECT: Bank Stabilization/Mmor Stream Relocation, Hwy 27, Lincoln County Dear Mr. Lund: The North Carolina Department of Transportation requests authorization to install a bankfull rock bench and gabion wall bank protection along a section of an unnamed tributary to Indian Creek located adjacent to the N.C. Highway 27 embankment in Lincoln County. The scope of the work will permanently impact 70 linear feet of the jurisdictional waters associated with the unnamed tributary to Indian Creek, which is classified as WS-II Waters (HQW) by the Division of Water Quality. The road embankment/streambank is unstable and is sloughing off into the stream. The embankment has eroded to within 5 feet of the highway. There is a concern that with future heavy rainfall events, the roadway will be eventually be undermined and collapse. The bottom of the road embankment fill must be extended out to allow stabilization of the embankment and reconstruction of the road shoulder; therefore, an existing 70-foot bench (located along the opposite bank within the banlfull channel width) must be removed to relocate the normal flow stream channel to this area. A 70-foot long, 4-foot wide rock bankfull bench will be constructed along the base of the roadway embankment; approximately 1.5 cubic yards/foot of rock is below average high water. A gabion basket wall will be constructed (extending from the top of the rock bench to the roadway elevation), which will allow the construction of an adequate road shoulder. Streambed material will be salvaged from the stream before the stream relocation and placed in the new constructed channel. A reference cross-section (Chart 1) was surveyed at a point -80 feet downstream of the failing bank to determine the "normal" channel dimensions. The stream width was determined to be 6-7 feet and the bankfull width, 9-10 feet; with a bankfull height of -1.2 feet. These reference dimensions will be utilized to reconstruct the streambank and channel. An existing and proposed stream channeUstreambank cross- section in the area of the bank failure is shown for comparison in the Chart 2. Chart 3 shows the existing and proposed thalweg profiles for the 70-foot longitudinal section of stream channel ? i Hwy 27 Bank Stabilization Page 2 May 23, 2005 The embankment stabilization necessitates the straightening of the stream for this project; therefore, it is anticipated that velocity energy will increase during high flows. Two cross vanes/pools will be constructed at each end of the rock bench/gabion wall in an effort to dissipate energy within the stream channel and to control the grade of the stream. The right sills of the vane will connect to the rock bench. This office has conducted a GIS and field survey for this project and is recommending a finding of "no effect" for T &E species and historical structures. The project is not located within %i mile of the critical watershed area, therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. Enclosed is a pre-construction notification for NWP # 13 (Bank Stabilization) and NWP#27 (Stream Restoration), sketches of planned activities, photographs of the site, and location maps relative to the project. Describe the overall project in detail, including the type of equipment to be used: The project consists of the stabilization of streambanklroadway embankment. To provide ade i to area to stabilize the embankment, an inner bend floodplain bench (located onposite the severely eroding embankment) must be removed to relocate the stream to this area. A 70-foot rock bench will then be constructed along the stream at the base of the roadway embankment. A gabion basket retaining wall will be constructed from the top of the rock bench to the roadway elevation and an adequate road shoulder will be reconstructed. The embankment will be seeded and stabilized upon construction completion. A trackhoe will be used during pLoject. 11. Explain the purpose of the proposed work: The purpose of the project is to stabilize bank the bank and to prevent further scour of the roadway embankment. IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. N applicable, discuss construction techniques to be followed during construction to reduce impacts. The stabilization project must be done to prevent the continuing erosion ofthe streambank/ roadway embankment. There is a valid concern that future storms will undermine the road and will cause the roadwav to collapse. The stream will be diverted during the vroiect to minimize disturbance. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, Page 5 of 8 M • but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any. application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at html. hn://h2o.enr.state.nc.us/ncwetlands/strmgide. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreagellinear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. ONSITE MITIGATION PLAN: Reference cross sections were taken in more stable areas of the stream to establish a "normal" stream width, bankfull width and bankfull depth The stream will be reconstructed to -5 foot width with a five foot wide rock bench to be constructed at the base of the embankment adjacent to the stream channel. The rock bench is to be constructed to the bankfull height to allow bankfull flow access. Due to the strai tening?of the stream within the terrace banks, it was necessary to provide some energy dissipation during high water events.. Two cross vanes with pools will be constructed at each end of the rock bench/gabion wall in an effort to dissipate energy within the stream and to control the grade of the stream 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN.
