APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Holder:
You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact 104 linear feet (If) (64 for box culvert installation and 40 If for bankfull bench creation and riprap
stabilization) and to temporarily impact 40 If (for temporary cofferdam installation) of Long Branch (a perennial
stream). The impacts are proposed in order to replace the existing, deteriorating bridge with a 64-foot long
double barrel, concrete box culvert (one culvert for base flow and one culvert for flood flow) as described in
your application received by the Division of Water Quality (DWQ) on February 4, 2005. The location of the
project is State Road 2120 (Powell Bridge Road) in Iredell County. After reviewing your application, we have
determined that this project is covered by Water Quality General Certification Numbers 3404. This certification
corresponds to Nationwide Permits 14 and 33 issued by the U.S. Army Corps of Engineers (USACE). Please
note that you should get any other federal, state or local permits before proceeding with your project, including
those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply
Watershed regulations. This approval will expire with the associated 404 permit unless otherwise specified in
the Water Quality Certification.
This approval is valid solely for the purpose and design that you described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and you may be required to submit a
new application. If the property is sold, the new owner must be given a copy of this Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this approval
to remain valid, you must adhere to the conditions listed in the attached certification and those listed below:
Placement of culverts and other structures in waters, streams and wetlands must be below the elevation of
the streambed by one (1) foot for all culverts with a diameter greater than 48 inches, and 20 percent of the
culvert diameter for culverts having a diameter less than 48 inches, to allow for low flow passage of water and
aquatic life, as well as prevent headcutting of the streams. The design and placement of culverts and other
structures including temporary erosion control measures shall be installed in such a manner that the original
stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the
streambed). Existing stream dimensions (including pattern and profile) are to be maintained above and
below locations of each culvert. The applicant may be required to provide evidence that the equilibrium has
been maintained, if requested in writing by the DWQ.

2. Since two (2) culverts will be installed, the stream should only flow through one (1) culvert during normal low
flow conditions and through the other culvert above bankfull conditions. The floodplain benches should be
installed to restore the natural channel upon completion of the project. The benches should be constructed of
natural materials for bench stability.
3. Disposal of old bridge material into surface waters is not allowed. Strict adherence to the USACE guidelines
for bridge demolition will be required.
4. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions.
5. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation, and operation and maintenance of
such BMP in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual.
The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil)
projects, including contractor-owned or leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
6. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in
order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
7. Temporary dewatering sitbs must be restored to pre-existing conditions unless more natural geomorphic
conditions can be provided.
8. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
9. The dimension, pattern and profile of the stream above and below the crossing should not be modified.
Disturbed floodplains and streams should be restored to natural geomorphic conditions.
10. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
11. All work shall be performed during low or normal flow conditions.
12. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is prohibited.
13. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has
released the project.
r
Page 3
14. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this
project within waters and/or wetlands, except as authorized by this Certification, or any modification to this
Certification (e.g., no work shall occur outside of the footprint of the plans provided).
In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters
associated with this Certification without appropriate modification. If this occurs, compensatory mitigation
may be required since it is a direct impact from road construction activities.
15. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please
include photographs upstream and downstream of the structure to document correct installation.
16. Continuing Compliance. NCDOT shall conduct its activities in a manner consistent with state water quality
standards [including any requirements for compliance with section 303(d) of the Clean Water Act] and any
other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are
not being met (including the failure to sustain a designated or achieved use) or that state or federal law is
being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and
modify this certification to include conditions appropriate to assure compliance with such standards and
requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify
NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide
opportunity for public hearing in accordance with 15A NCAC 21-1.0504. Any new or revised conditions shall
be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant
to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If
you have any questions, please telephone Polly Lespinasse in the Mooresville Regional Office at 704-663-
1699.

SUBJECT: Bridge #350 replacement, SR 2120 (Powell Bridge Rd), Iredell County
Dear Mr. Lund:
The North Carolina Department of Transportation requests authorization to replace a deteriorating bridge on
SR 2120 in Iredell County. NCDOT proposes to replace the existing 65-foot long, 20-foot wide bridge
with a 64-foot long, double line 12' x 9' concrete box culvert with inlet and outlet headwalls on same
location. Twenty feet of Class II riprap will be utilized at the inlet and outlet of the box culvert for structure
stabilization. Riprap faced benches will be constructed at the inlet and outlet of the box culvert to maintain
channel dimensions and to divert base flow through only one barrel. The existing bridge will be removed in
accordance with NCDOT BMP's for bridge demolition. Stream surveys were conducted to establish a
thalweg profile on which to base the one-foot culvert burial. Upstream and downstream cross-sections were
also performed (see enclosed graphs). The upstream cross-section indicates a more "normal" stream width,
while the downstream cross-section shows the impacts of cattle access. Cattle paths to the stream have
overwidened the channel width in some areas, resulting in sandbars, failing banks, felling trees, and debris
jams. The scope of construction work will result in permanent impacts to the Long Branch, which is
classified as a WS-III watershed by the Division of Water Quality. Temporary cofferdams will be necessary
to manage stream water during the staged construction of the double box culvert. Upon project completion,
areas impacted by the temporary cofferdams will be restored to pre-project conditions.
This office has conducted a GIS and field survey for this project and is recommending a finding of "no
effect" for T&E species and historical structures.
The project is not located within %s mile of a critical watershed area; therefore, hazardous spill basins are not
required. Enclosed is the hazardous spill basin checklist.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to
provide information related to site constraints such as topography, building ordinances,
accessibility, and financial viability of the project. The applicant may attach drawings of
alternative, lower-impact site layouts, and explain why these design options were not
feasible. Also discuss how impacts were minimized once the desired site plan was
developed. If applicable, discuss construction techniques to be followed during
construction to reduce impacts.
The narrow bridge must be replaced for the safety of the travelling public. The roadwav
vertical curve must be improved to improve nigk visibility at the location. Inlet and
outlet headwalls are being utilized to minimize the length of culvert and still provide a
standard roadwav and shoulder width. Riprap is necessary too provide structure
stabilization.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of
impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts
to perennial streams.
USACE - In accordance with the Final Notice of Issuance and Modification of
Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will
be required when necessary to ensure that adverse effects to the aquatic environment are
minimal. Factors including size and type of proposed impact and function and relative
value of the impacted aquatic resource will be considered in determining acceptability of
appropriate and practicable mitigation as proposed. Examples of mitigation that may be
appropriate and practicable include, but are not limited to: reducing the size of the
project; establishing and maintaining wetland and/or upland vegetated buffers to protect
open waters such as streams; and replacing losses of aquatic resource functions and
values by creating, restoring, enhancing, or preserving similar functions and values,
preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in
order for USACE or DWQ to consider the application complete for processing. Any
application lacking a required mitigation plan or NCWRP concurrence shall be placed on
hold as incomplete. An applicant may also choose to review the current guidelines for
stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina,
available at http://h2o.enr.state.nc.us/newetlands/strmgide.htmi.
1. Provide a brief description of the proposed mitigation plan. The description should
provide as much information as possible, including, but not limited to: site location
(attach directions and/or map, if offsite), affected stream and -river basin, type and
amount (acreage/linear feet) of mitigation proposed (restoration, enhancement,
creation, or preservation), a plan view, preservation mechanism (e.g., deed
restrictions, conservation easement, etc.), and a description of the current site
conditions and proposed method of construction. Please attach a separate sheet if
more space is needed.
If mitigation is required by USACE mitigation for the project will be requested to be
handled by the Ecosystem Enhancement Program as outlined in the memorandum of
understanding between NCDOT and USACE.
2. Mitigation may also be made by payment into the North Carolina Wetlands
Restoration Program (NCWRP). Please note it is the applicant's responsibility to
contact the NCWRP at (919) 733-5208 to determine availability and to request
written approval of mitigation prior to submittal of a PCN. For additional
information regarding the application process for the NCWRP, check the NCWRP
