The Division 10 Resident Engineer responsible for administering the contract has certified that the site was constructed according to construction plan sheets, with any exceptions noted in this As-Built Report. The following information has been included as part of the As-Built Report: 1) As-Built Plan Sheets (with adjustments highlighted in yellow), 2) Monitoring Gauge and Vegetation Monitoring Plot Map, and 3) Planting Plan and Restoration Detail Sheets. The site will be monitored as described in the approved mitigation plan and associated permit requirements. Per the letter from the Ecosystem Enhancement Program (EEP) to NCDOT dated August 25, 2004, the EEP has accepted the transfer of all off-site mitigation projects. The EEP will be responsible for fulfilling the monitoring requirements and future remediation for this project. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) those required by Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This Certification shall expire three (3) years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding US Army Corps of Engineers (USACE) Permit, whichever is sooner. Conditions of Certification: 1. The meander bend grading and bankfull bench construction shall be conducted as described in the modification request. Existing stream dimensions (including pattern and profile) are to be maintained above and below the location of the meander bend grading area and bankfull bench construction. 2. Tree removal shall be minimized to the greatest extent possible, with the exception of the removal of one (1) tree and one (1) stump at Station 35+00 and the removal of two (2) trees at Station 34+70 and 34+90 (the stumps at these stations are to remain to provide bank stability). 3. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications governing the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: a. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. b. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. c. The reclamation measures and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 4. Sediment and erosion control measures shall not be'placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has released the project. 5. The presence of equipment in the channel must be minimized. Under no circumstances must rock, sand or other materials be dredged from the wetted stream channel. 6. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. t Page 2 7. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic conditions can be provided. 8. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 9. All work shall be performed during low or normal flow conditions. 10. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 11. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it is a direct impact from road construction activities. 12. The proposal consists of grading on approximately 80 linear feet of channel bank. This grading will consist of installing a 6-foot minimum bankfull bench per the typical sections shown on the plan sheet. The bankfull bench will be installed on the outside meander bends. Mature trees located on the outside meander bend from Sta. 34+75 to Sta. 35+00 will not be disturbed. On the inside meander bend at approximately Sta. 35+00, the existing bank will be graded on a 4:1 or flatter slope from existing toe to natural ground. This would tie in with the existing point bar. The grading would require removal of one tree and stump located at Sta. 34+75 Left. Two other trees (Sta. 34+70 Right and 34+90 Left) will be cut, but the stumps will remain. Installing the bankfull bench and grading the inside meander bend from Sta. 34+75 to 35+25 will help reduce the stress that is currently on the outside bank. The section located between Sta. 35+90 to 36+20 would only consist of installing a bankfull bench on the outside bend. The inside bend is stable and requires no work. Installing the bankfull bench on the outside will help reduce the stress on this bank. The Department would also remove a debris jam that is located at Sta. 36+50 that is contributing to some of the instability noted upstream. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. This is a Prioritv 1 and 2 stream restoration proiect that provides mitigation credits for unavoidable off-site impacts. The site will impact 4,045 feet of channel while restoring 4,135.5 feet of channel, replanting 17.5 acres of buffer, enhancing 3.51 acres of wetland, restoring 0.44 acres of wetland, and creating 0.42 acres of wetland. all of which will be protected under a erpetual conservation easement. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. This stream restoration project provides a total of length of 4135.5 feet of restored stream channel. The project will be preserved within a conservation easement. The project requires a temporary pump-around system, excavating new meandering channels, stabilizing the banks, installing structures, and filling some portions of the existing channels.
