We are also requesting 4o1-Certification and Buffer Compliance from the NC-DWQ for the impacts to jurisdictional waters and wetlands. The subject property is approximately 11o acres in size and is located immediately west of Hebron Church Road (SR 2547), approximately looo feet west of the intersection of Ackerman Road (SR 2709) and Hebron Church Road. Latitude: 35.6653988°N and Longitude: 78.5831386°W in Garner, Wake County, North Carolina. The site contains unnamed tributaries to Mahlers Creek and is located in the Neuse River Basin. The Water Quality Classification for these features is: C;NSW, the Cataloging Unit for this site is: o3ozo2oi, and the Stream Index number is: 27- 43-9• Project History Wetlands were delineated by Soil and Environmental Consultants. Site meetings were conducted with the NC-DWQ on November 12, 2004 (DWQ EXP# 04-1793) and February 14, 2005 (DWQ EXP# 05-0241) to verify stream origin points and subjectivity to the Neuse Buffer Rules. On January 10, 2007, apre-application meeting was conducted with the NC-DWQ to review the proposed impacts to the riparian buffers necessary to provide stormwater management for the site (i.e. constructed wetlands). DWQ agreed that due to topographic constraints, impacts to Zone 2 of the Riparian Buffer could not be avoided. Proposed Impacts The proposed permanent impacts consist of 241 linear feet of jurisdictional stream channel (131 l.f. unimportant/intermittent channel + 110 l.f. of important/perennial channel) and o.017 acres of wetland for road construction. Temporary impacts include 30 linear feet of important/perennial channel for the installation of a utility line. In addition, approximately o.92 acres of riparian buffer will be impacted for the installation of roadways, utility lines, and stormwater BMP's. Avoidance and Minimization Prior to site plan development, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and `waters' could be minimized. Impacts were minimized by crossing the channel at a nearly perpendicular angle and through the use of steeper fill slopes at the stream crossings. The initial plans proposed impacts to Zone 1 of the Riparian Buffer for BMP devices, however, based on comments from DWQ and additional review, we were able to eliminate these impacts completely. Stormwater Management Plan The proposed impervious for this project is expected to be approximately 30%, therefore constructed wetlands will be used to treat the Stormwater before it leaves the site. A copy of the Stormwater plans is included with the attachments. During construction the applicant will utilize BMP devices to prevent sediment from entering jurisdictional stream channels or wetlands. Mitigation Because impacts to perennial channels are less than i5o linear feet and wetland impacts are less than o.l acres, we do not believe that mitigation will be required. However, because crossing D is greater than i5 degrees from perpendicular, the he applicant proposes payment to the NC-EEP to satisfy mitigation requirements for buffer impacts. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No additional impacts are proposed at this time. We have reviewed the additional stream crossings needed to develop this parcel and it appears that these crossings could be accomplished through the use of arch culverts and therefore would not require any additional impacts. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It maybe useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site .layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Prior to site plan development, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and `waters' could be minimized. Impacts were minimized by crossing the channel at a nearly perpendicular angle and through the use of steeper fill slopes at the stream crossing. The initial plans proposed impacts to Zone 1 of the Riparian Buffer for BMP devices however based on comments from DWO and additional review we were able to eliminate these impacts completely. In addition, the crossings are located at a point where the stream channel contained very few meander bends, thereby minimizin tg he impacts. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 1 S, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors Page 5 of 8 including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.uslncwetlands/stnn~ide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. XV. Other Circumstances (Optional): It is the applicant's responsibility to submit the application sufficiently in advance of desired construction dates to allow processing time for these permits. However, an applicant may choose to list constraints associated with construction or sequencing that may impose limits on work schedules (e.g., draw-down schedules for lakes, dates associated with Endangered and Threatened Species, accessibility problems, or other issues outside of the applicant's control). SECTION 1 -MAINTENANCE OF BEST MANAGEMENT PRACTICES Monthly or after every runoff producing rainfall, whichever comes first: a. Remove debris from trash racks b. Check and clear orifice and riser of any obstructions. The detention device should be kept clear of debris such as loose bottles, cans, food containers and other forms of rubbish. Any rodents that have fallen into the device should be removed so that they do not present a source of blockage for the discharge pipe. c. Check pond side slopes; remove trash, repair eroded areas before next rainfall. Rills and gullies should be filled with suitable soil compacted and then seeded. Where eroded areas are detected, the cause of the erosion should be addressed to prevent a continued maintenance problem. II. Quarterly a. Inspect the collection systems (i.e., catch basin, piping, grassed swales) for proper functioning. Clear accumulated trash from basin grates, and basin bottoms, and check piping for obstructions. b. Check pond inlet pipes for obstructions. c. Repair any broken pipes. d. Replace riprap that is choked with sediment. III. Semi-Annually a. Remove accumulated sediment from bottom of outlet structure. b. Check pond depth at various locations. If the elevations of the marsh areas exceed the permanent pool elevation, the sediment should be removed to design levels. This shall be performed by excavating the marsh areas six inches below design elevations. Afterwards clean topsoil shall be placed to bring marsh areas back to design elevations and the required plant material reestablished. (see elevation tables below) c. The riser structure should be visually inspected semi-annually for any seepage through mortar joints or cracks in the walls of the structures. The orifice outlets should be cleared of any debris that may build up and the extension should be checked for damage. The drain valve assembly should be operated to ensure that all internal parts remain lubricated and in good working order. d. Conduits should be visually inspected at the joints. Pipes should be inspected for proper alignment (sagging), elongation and displacement at joints, cracks, leaks, surface wear, loss of protective coating, corrosion and blocking. A depression in the soil surface over the pipe may be signs that soil is being removed from around the pipe. IV. General a. Mow side slopes according to the season. Maximum grass height to be six (6) inches. b. Wetland planting densities in the marsh areas should be maintained by replanting bare areas as needed. Wetland plants should be encouraged to grow in the marsh areas. c. All components of impoundment system to be kept in good working order. d. In case the ownership of the impoundments transfers, the current owner shall, within thirty (30) days of transfer of ownership, notify NCDENR-DWQ of such ownership transfer. Inspection should be conducted semi-annually. Observations -All observations should be recorded. Where _periodic inspections are performed following significant rainfall, these inspections should be logged into the Periodic Inspection, Operations and Maintenance Form in Section 3 of this manual. Other Operational Procedures -The owner should maintain a complete and up-to-date set of plans (as-built drawings) and all changes made to the detention device over time should be recorded on the as-builts. Sedimentation and Dredging -Sedimentation from on-site and off-site soils will eventually result in a decrease of the storage capacity for these ponds and will have to be removed. The frequency of this sediment removal can be reduced by ensuring that the site areas be stabilized with a vegetative ground cover such that it restrains erosion. This would include a periodic application of fertilizer and/or other treatment necessary to promote a stable ground cover and minimize sedimentation to the device. The removed material should be hauled offsite to a suitable landfill site or mounded somewhere on site and stabilized with a ground cover sufficient to restrain erosion.
