On January 18, 2007, the 401 Oversight/Express Permitting Unit of the Division of Water Quality received a
request from Mr. John Schrum of Horvath Associates, PA, regarding a project known as "Rustica Oaks
Subdivision" for acceptance into the Express Review Program. This letter advises you that your project will be
accepted into the Express Review Program once the following items are received:
1) The application fee of $4,000.00 [for 401 Water Quality Certification with major impacts + Riparian Buffer
Authorization], made payable to the North Carolina Division of Water Quality];
2) Five (5) complete and collated copies of the PCN Application;
3) One (1) completed copy of the Addendum to the PCN Application;
4) Five (5) copies of all site plan information pertaining to this project (please refer to the Addendum
http:/Ih2o.enr.state.nc.us/ncwetlandslappadd5.pdf);
5) Three (3) copies of the stormwater management plan and all required information (refer to
http://h2o.enr.state.ne.usincwetlands/documents/Exp Rev SWMA.pdt]. Please be aware that under
Condition No. 4 of GC 3402, DWQ can require stormwater management plans for developments that have,
or are anticipated to have, 30% or greater of impervious surface area. Furthermore, it is DWQ's policy that
areas of concentrated development within a project must treat stormwater runoff. Stormwater management
shall be designed to remove 85% TSS according to the latest version of DWQ's Stormwater Best
Management Practices Manual at a minimum. Additionally, in watersheds that are classified as Nutrient
Sensitive Waters (NSW), the Division shall require that extended detention wetlands, bio-retention areas, or
detention ponds followed by forested filter strips be constructed as part of the stormwater management plan.
Thank you for your attention to this matter. The clock for this project will not start until receipt of the completed
application package and required fee are received. If the impacts are greater than indicated on the Initial Interest
Form and/or the services are different, you may be required to remit an additional fee. If you have any questions.
or wish to discuss these matters further please do not hesitate to call Cynthia Van Der Wiele at 919-715-3473 or
Lia Miott at 919-733-9502.
Sincerely,
~"
