Dear Ms. Dailey:
Burns & McDonnell was retained by Piedmont Natural Gas (client) to provide wetland
delineation services for the Bellamy Lake Road Distribution Replacement Project (Project). The
following sections provide information on the proposed Project and summarize the completed
wetland delineation.
INTRODUCTION
The client proposes to construct approximately 3,400 linear feet of 8" medium -dense
polyethylene (MDPE) natural gas pipeline in Halifax and Nash Counties, North Carolina. The
Project is located east of Interstate 95 (I-95), west of US 301 (Route 301), south of NC 481
(Route 481), and is accessible via Bellamy's Mill Road (Route 1518). A General Location Map
illustrating the Project location has been included in Attachment A (Figure A-1). Potential
construction activities associated with the Project may include clearing, grubbing, and
construction of pipeline infrastructure.
The proposed Project has the potential to impact wetlands or other waterbodies that may be
under the jurisdiction of the U.S. Army Corps of Engineers (USACE) as designated by Section
404 of the Clean Water Act. In an effort to avoid and minimize potential impacts to regulated
waterbodies, Burns & McDonnell conducted a wetland delineation within a 23.42 acre area
consisting of a 300-foot-wide corridor along the proposed 3,400-foot-long pipeline route (Study
Area). This report documents the findings of the delineation which determined the boundaries
and extent of wetlands and other water bodies within the Study Area.
METHODS
The following discussions summarize the methods used to review existing data and conduct the
wetland delineation.
Existing Data Review
Burns & McDonnell reviewed publicly available background information for the Study Area
prior to conducting a site visit. This background information included U.S. Geological Survey

(USGS) 7.5-minute topographic maps, U.S. Fish & Wildlife Service (USFWS) National Wetland
Inventory (NWI) map, and U.S. Department of Agriculture (USDA) Natural Resources
Conservation Service (MRCS) 2014 Soil Survey Geographic (SSURGO) digital data for Halifax
and Nash Counties. Maps generated from this publicly available data are included as Figures A-2
and A-3 in Attachment A.
Wetland presence based only on background information, including NWI maps, cannot be
assumed to be an accurate assessment of potentially occurring jurisdictional wetlands. Wetland
identification criteria differ between the USACE and other agencies. As an example, wetlands
shown on an NWI map may not be under the jurisdiction of the USACE, and USACE-
jurisdictional wetlands are not always included on the NWI maps. A field visit is necessary to
identify any wetlands, streams, or other waterbodies that may be present.
Wetland Delineation Field Survey
An onsite wetland delineation of the Study Area was completed in accordance with the 1987
Corps of Engineers Wetlands Delineation Manual and the 2010 Regional Supplement to the
Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain (Regional
Supplement). Sample plots were established at multiple locations and Wetland Determination
Data Forms from the Regional Supplement were completed to characterize the Study Area
(Attachment B). Vegetation, soil conditions, and hydrologic indicators were recorded at each of
these sample plots. Locations of sample plots and other identified features were surveyed in the
field by Burns & McDonnell using a submeter Global Positioning System (GPS) antenna.
Natural color photographs were taken onsite and are included in Attachment C.
RESULTS
The following sections describe the results of the existing data review and the completed wetland
delineation.
Existing Data Review
The existing USGS topographic maps for Ringwood, NC (2019 Revision) and Enfield, NC (2019
Revision) were reviewed to familiarize Burns & McDonnell wetland personnel with the
topography of the Study Area and potential locations of wetlands and other waterbodies (Figure
A-2). The USGS topographic maps indicate the Study Area consists of mostly forested area with
varying terrain and multiple wetlands and drainage features draining into Fishing Creek (Figure
A-2).
The USFWS NWI map indicates multiple freshwater forested/shrub wetlands, one freshwater
emergent wetland, and one riverine feature located within the Study Area (Figure A-2).
The NRCS SSURGO digital data indicates the Study Area is underlain primarily by Marlboro
fine sandy loam, 0 to 2 percent slopes; Winton fine sandy loam, 25 to 45 percent slopes; and

Tomotley fine sandy loam, 0 to 2 percent slopes, rarely flooded. Tomotley fine sandy loam is
considered hydric in Halifax and Nash Counties, North Carolina (Figure A-3).
Wetland Delineation Field Survey
On April 15 and 16, 2020, Patrick Meier, wetland specialist with Burns & McDonnell, conducted
a wetland delineation of the Study Area to identify the presence of wetlands, streams, and other
waterbodies. The Study Area was largely composed of forested areas with open understory and
upland cutover with varying terrain and multiple drainage features.
Vegetation: Typical woody species within the Study Area consisted of loblolly pine (Pinus
taeda), red maple (Acer rubrum), American beech (Fagus grandifolia), American hornbeam
(Carpinus caroliniana), and swamp chestnut oak (Quercus michauxii). Typical herbaceous
species within the Study Area consisted of dog -fennel (Eupatorium capillifolium), Japanese
honeysuckle (Lonicera japonica), broom -sedge (Andropogon virginicus), Virginia creeper
(Parthenocissus quinquefolia), saw -tooth blackberry (Rubus argutus), and southern lady fern
(Athyrium asplenioides).
Soils: Typical soil colors ranged from light brown (10YR 6/4) to light gray (2.5Y 6/1) with a
typical texture of sandy loam.
Hydrology: The primary sources of hydrology within the Study Area were ground water table
and surface runoff. Typical indictors of hydrology included soil saturation and high-water table.
Delineated Areas: Wetlands
During the delineation, a total of 2.40 acres of potentially jurisdictional wetlands were located
within the Study Area. Typical site conditions for each wetland classification are described
below and locations of the wetland areas are shown in Figure A-4. Table 1 provides the quantity
for each wetland classification delineated within the Study Area.

Wetland 01 (W-01) Palustrine Forested (PFO) 2.21-acre: W-01 is a PFO wetland that
occurred as a floodplain along the banks of Fishing Creek in the eastern half of the Study Area.
Dominant vegetation within W-01 consisted of water tupelo (Nyssa aquatica), red maple,
American hornbeam, shallow sedge (Carex lurida), common fox sedge (Carex vulpinoidea), and
swamp milkweed (Asclepius incarnate). Wetland hydrology was indicated by soil saturation and
high-water table. Observed soils were light gray (2.5Y 5/1) with a clay loam texture. Hydric soil
was indicated by a depleted matrix with redox concentrations.
Wetland 02 (W-02) PFO and Palustrine Scrub -Shrub (PSS) 0.49 acres: W-02 consisted of
both PFO and PSS wetlands. These wetlands occurred as a floodplain along Fishing Creek
within the western portion of the Study Area. Dominant vegetation within these areas consisted
of swamp chestnut oak (Quercus michauxii), American hornbeam, red maple, American holly,
(Ilex opaca), black willow (Salix nigra), lamp rush (Juncus ejusus) common fox sedge, and
southern lady fern within the PFO area and sweet -bay, giant plume grass, and cottongrass
bulrush (Scirpus cyperinus). Wetland hydrology was indicated by soil saturation and high water
table. Observed soils ranged from olive gray (10YR 4/2) to light gray (2.5Y 6/1) in color with a
sandy loam texture. Hydric soil was indicated by a depleted matrix with redox concentrations.
Wetland 03 (W-03) PFO 0.70-acre: W-03 is a PFO floodplain wetland along the western
bank of Fishing Creek near the western terminus of the Study Area. Vegetation within this area
consisted of water tupelo, red maple, American hornbeam, common fox sedge, and Japanese
stilt -grass (Microstegium vimineum). Wetland hydrology was indicated by surface inundation,
soil saturation, and high water table. Observed soils ranged from olive gray (IOYR 4/2) to light
gray (IOYR 5/1) with a sandy loam texture. Hydric soil was indicated by a depleted matrix with
redox concentrations.
Delineated Areas: Streams
Two stream channels were located within the Study Area during the wetland delineation. Table 2
provides the classification and length of the streams. The streams are also described below and
displayed on Figure A-4.

Stream-1 (S-1): S-1 is a segment of Fishing Creek and is located near the western end of the
Study Area. The channel enters the Study Area from the south and flows to the north where it

leaves the Study Area (Figure A-4). The channel averaged approximately 123 feet wide and the
banks averaged 4-6 feet deep. Substrate within the channel consisted of an unconsolidated sandy
loam. Riparian vegetation along the banks consisted of sweetgum (Liquidambar @raciva), red
maple, river birch (Betula nigra), American hornbeam, Japanese honeysuckle, and Japanese stilt
grass.
Stream-2 (S-2): S-2 is a segment of Fishing Creek located near the eastern end of the Study
Area. The channel enters the Study Area from the north and flows to the south where it leaves
the Study Area (Figure A-4). The channel averaged approximately 130 feet wide and the banks
averaged 4-6 feet deep. Substrate within the channel consisted of an unconsolidated sandy loam.
Riparian vegetation along the banks consisted of sweetgum, red maple, river birch (Betula
nigra), green ash (Fraxinus pennsylvanica), American hornbeam, Chinese privet (Ligustrum
sinense), Japanese honeysuckle, and Japanese stilt grass.
SUMMARY
Burns & McDonnell conducted a wetland delineation of the Study Area on April 15 and 16,
2020 to determine the presence of wetlands, stream channels, and other waterbodies.
Approximately 2.21 acres of PFO, 0.19 acres of PSS wetlands, and 601.50 LF of stream channel
were identified. On behalf of Piedmont Natural Gas, Burns & McDonnell respectfully requests a
preliminary jurisdictional determination of the water resources identified in the Study Area. We

A Preliminary Jurisdictional Determination (PJD) provides an indication that there may
be "waters of the United States" or "navigable waters of the United States"on a property.
PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all
waters and wetlands on the property will be treated as if they are jurisdictional "waters of
the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is
"preliminary" in the sense that an approved JD can be requested at any time. PJDs do

An Approved Jurisdictional Determination (AJD) is a determination that

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
