Director O O f Division of Water Quality ?,ynrgo rgT .9 AP August 29, 2005 01Alexander DWQ# 606 County APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Holder: You have our approval, in accordance with the attached conditions and those listed below, to permanently impact 120 linear feet (If) (60 If for culvert installation, 50 If for floodplain bench creation, and 10 If for inlet/outlet stabilization using riprap) and temporarily impact 40 If (temporary cofferdam installation) of Robinette Creek, a perennial stream. The impacts are proposed in order to replace a deteriorating bridge with a double barrel concrete culvert as described in your application received by the Division of Water Quality (DWQ) on August 22, 2005. The location of the project is State Road 1310 (Robinette Road) in Alexander County. After reviewing your application, we have determined that this project is covered by Water Quality General Certification Number 3404. This certification corresponds to Regional General Permit 198200031 issued by the U.S. Army Corps of Engineers (USACE). Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval is valid solely for the purpose and design that you described in your application (unless modified below) and will expire with the associated USACE 404 permit unless otherwise specified in the Water Quality Certification. Should your project change, you must notify the DWQ in writing and you may be required to submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification and those listed below: Due to the streambed elevation at the inlet end of the proposed culvert, DWQ will not require the burial of the culvert in the streambed at the inlet end of the pipe. The outlet end of the pipe must be placed below the elevation of the streambed by one foot to allow for low flow passage of water and aquatic life. All structures shall -be installed in such a manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the streambed). Design and placement of culverts and other structures including temporary erosion control measures shall be installed in such a manner that the original stream profiles are not altered (i.e., the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including pattern and profile) are to be maintained above and below locations of each culvert. The applicant may be required to provide evidence that the equilibrium has been maintained, if requested in writing by the DWQ. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions. 3. Disposal of old bridge material into surface waters is not allowed. Strict adherence to the USACE guidelines for bridge demolition will be required. 4. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full compliance with all specifications governing the proper design, installation, and operation and maintenance of such BMP in order to protect surface water standards: a. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. b. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. c. The reclamation measures and implementation of these measures must be in accordance with the requirements of the Sedimentation Pollution Control Act. 5. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 6. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic conditions can be provided. 7. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened. 8. The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 9. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 10. All work shall be performed during low or normal flow conditions. 11. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 12. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has released the project. 13. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this project within waters and/or wetlands, except as authorized by this Certification, or any modification to this Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it is a direct impact from road construction activities. Page.3 14. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please include photographs upstream and downstream of the structure to document correct installation. 15. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state water quality standard [including any requirements for compliance with section 303(d) of the Clean Water Act] and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. C. 28801-5006 SUBJECT: Bridge #85 replacement, SR 1310 (Robinette Rd), Alexander County Dear W. Lund: The North Carolina Department of Transportation requests authorization to replace a deteriorating bridge on SR 1310 (Robinette Rd) in Alexander County. NCDOT proposes to replace the existing 20' x 20' bridge with a 60-foot long, double CMPA. The main flow pipe dimensions are 142" x 91" and the flood flow pipe dimensions are 117" x 79". Although, the stream in the immediate vicinity of the bridge is not a steep gradient section, the project site is located in the Brushy Mountain area of northern Alexander County and there is a steeper gradient section upstream of the bridge that appears to have a definite riffle/pool sequence (see attached upstream photo). The scope of work will result in permanent fill impacts to Robinette Creek, which is classified as Class B waters by the Division of Water Quality. A thalweg profile was conducted to determine the streambed elevations on which to base the one-foot pipe burial. It was discovered that the proposed pipe inlet invert, if placed one foot below the existing streambed elevation would be lower than the proposed pipe outlet invert elevation. (See enclosed sketch sheet 4 with thalweg and proposed pipe elevations). Therefore, based upon the existing streambed elevations, it is proposed that the main flow pipe inlet be placed on streambed grade and the pipe outlet be buried one foot below the existing streambed elevation. The flood flow pipe will be placed - one foot higher than the main flow pipe. Riprap faced bankfull benches will be constructed upstream and downstream of the flood flow pipe to maintain normal channel dimensions and direct flow through the main flow pipe. Stream destabilization does not appear to be an issue based upon the calculated slopes of the existing stream and the proposed pipe. Temporary cofferdams will be necessary for the staged construction of the double pipe. Upon construction completion, areas impacted by the cofferdams will be restored to pre project conditions. SR 1310, Bridge #85 Page 2 August 16, 2005 This office has conducted a GIS and field survey for this project and is recommending a finding of "no effect" for T&E species and historical structures. The project is not located within % mile of a critical watershed area; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. Size of watershed draining to pond: Expected pond surface area: VII. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Due to the financial considerations, the lower cost alternative of the double pipe is proposed for this bridge replacement A bottomless arched culvert was also considered for this location; however, borings of the site indicated that the bedrock in the area was too deep. A stream survey was conducted (thalwegprofile and upstream/downstream cross-sections) to determine adequate pine sizes to carry normal stream flow and bankfull flow. The "normal" stream width was determined to be -12 feet' therefore a 142" wide pipe will be installed for the main flow channel Bankfull width was determined to be -20 feet; therefore, the second flood flow Ripe will 11 T' wide which will provide a 21 foot bankfull width. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Page 5 of 9 If mitigation is required for this project, a copy of the. mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmaide.htmi. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed.
