Dear Mr. Pope:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
material in 0.01 acre of wetland for the purpose of grading and stabilizing road shoulders as part of the
improvements to Beachway Trail, SR 1929, in Brunswick County. This project shall be constructed in
accordance with your application dated April 27, 2005. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3404 which may be
viewed on our website at http://h2o.enr.state.ne.us/ncwetlands. This certification corresponds to the
Nationwide Permit 14 issued by the U.S. Army Corps of Engineers. In addition, you should acquire any
other federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval
will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality
Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). For this
approval to remain valid, you must adhere to the conditions listed in the attached certification.

1.) Upon. completion of the project, the NCDOT shall complete and return the enclosed "Certification of
Completion Form" to notify DWQ when all work included in the 401 Certification has been
completed. At that time, the responsible party shall complete the attached form and return it to the
401 /Wetlands Unit of the Division of Water Quality.
2.) NCDOT shall conduct its activities in a manner consistent with State water quality
standards (including any requirements resulting from compliance with section 303(d) of the
Clean Water Act) and any other appropriate requirements of State law and federal law. If
DWQ determines that such standards or laws are not being met (including the failure to
sustain a designated or achieved use) or that State or federal law is being violated, or that
further conditions are necessary to assure compliance, DWQ may re-evaluate and modify
this certification to include conditions appropriate to assure compliance with such standards
and requirements in accordance with 15A NCAC 2H.0507(d). Before modifying the
certification, DWQ shall notify NCDOT and the US Army Corps of Engineers, provide
public notice in accordance with 15A NCAC 211.0503, and provide opportunity for public
hearing in accordance with 15A NCAC 211.0504. Any new or revised conditions shall be
provided to NCDOT in writing, shall be provided to the US Army Corps of Engineers for
reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall
also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.

SUBJECT: Nationwide 14 Permit Application for Grade, drain, base and pave at SR 1929
(Beachway Trail), Brunswick County Project Number: 3c010042 (DWQ Permit Fee:
$200)
Please find enclosed a PCN application from the North Carolina Department of Transportation for
a Nationwide 14 permit from the Army Corp of Engineers for the secondary road improvement project on
SR 1929 (Beachway Trail.) in Brunswick County. The scope of the project will be to grade, drain, base
and pave the 0.1 mile of existing unpaved road to current NCDOT secondary road standards of 20 ft of
pavement and 6 ft of earthen shoulders to improve roadway safety and stability.
IMPACTS TO WATERS OF THE UNITED STATES
This project is located in the Lumber River Basin within USGS hydrologic unit 03040207 (subbasin
030759). The proposed project will fill 0.01 acres of non-riverine wetlands for the construction of
shoulders at Site A (Sta. 0+68 to Sta. 1+38 RT). Dave Timpy (U.S. Army Corps of Engineers) verified the
wetlands for this project on October 14, 2004. Ken Averitte (DWQ) conducted a site visit on January 19,
2005. No stream impacts are associated with this project. Furthermore there are no permanent or
temporary utility impacts proposed with this project.
COMPENSATORY MITIGATION
Based upon the letter from the U.S. Army Corp of Engineers, Wilmington District dated September 1,
2004, it is understood that the North Carolina Department of Environment and Natural Systems Ecosystem
Enhancement Program (EEP), will assume responsibility for satisfying the Federal Clean Water Act
compensatory mitigation requirements for all NCDOT projects at a 2:1 ratio. It is also NCDOT's
understanding that if the USACE District Engineer determines that compensatory mitigation is required for
any project, it will be submitted to EEP for acceptance on a quarterly basis by the Department with a copy
provided to the Wilmington District office for verification and accounting purposes.

The Department has avoided and minimized impacts to jurisdictional resources to the greatest extent
possible as described above. The remaining, unavoidable impacts to 0.01 acres of jurisdictional non-
riverine wetlands will be offset by compensatory mitigation provided by the EEP proms. 'Plus ystem is
a non-riverine successional hardwood forest in the Lumber River Basin within USUS'hydrofcigkiiidf
03040207 (subbasin 030759).
NATURAL AND HISTORIC RESOURCES
FEDERALLY PROTECTED SPECIES
Species with the federal classification of Endangered, Threatened, Proposed Endangered and Proposed
Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of
1973 as amended (16 U.S.C. 1531 et seq.). The United States Fish and Wildlife Service lists fifteen
federally protected species for Brunswick County which include American alligator (Alligator
mississippiensis), Red-cockaded woodpecker (Picoides borealis), Cooley's meadowrue (Thalictrum
coolep) and Rough-leaved loosestrife (Lysimachia asperulaefolia). A GIS and field review has been
conducted for these species and their habitat for this project and a determination of "No Effect" for the
listed species is recommended.
HISTORICAL RESOURCES
Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic
Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part 800, this project has
been reviewed and cleared for effects on historical and archeological resources (see attachments).
REGULATORY APPROVAL
Section 404 Permit The Department of Transportation is requesting to proceed under Nationwide 14 as
authorized by a Nationwide Permit (67 FR 2020; January 15, 2002).
Section 401 Permit: We are also requesting by copy of this letter issuance of the 401 Water Quality
Certification 3404 from the DWQ. We have provided a method of debiting $200 to be submitted to the
DWQ for processing the WQC permit request, as noted in the subject line of this application, as payment
for processing the Section 401 permit request.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

constructed adjacent to the wetland. All wetlands or surface waters not affected by this project

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for ' processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
hLtp://h2o.enr.state.nc.us/ncwetlands/stnngide.html.

Subject: Brunswick County Secondary Road Projects
In response to your request, based on the recommendations of the North
Carolina State Historic Preservation Office (HPO), I surveyed the following
secondary road projects in Brunswick County for historic architectural resources
on March 3, 2004:
SR 1318A - Mintz Cemetery Road,
SR 1929 - Beachway Trail, and
SR 1934 - Schyler Road.
Neither the federal permit areas, nor the entire project areas contain any
properties listed on or eligible for the National Register of Historic Places and,
specifically, no properties built prior to 1955. The three projects thus are in
compliance with North Carolina General' Statute 121-12(a) and Section 106 of
the National Historic Preservation Act for historic architecture.
The attached table summarizes architectural review for the above projects and
eleven other secondary road projects you have submitted to the HPO during the.
second half of 2004.
