APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Holder:
Alan W. Klimek, P.E. Director
Division of Water Quality
March 23, 2005
DWQ# 05-0494
Cleveland County
You have our approval, in accordance with the attached conditions and those listed below, to permanently
impact 50 linear feet (If) of Beaverdam Creek (a perennial stream) with riprap to stabilize the stream bank and
provide protection to bridge bents during bridge replacement as described in your application received by the
Division of Water Quality (DWQ) on March 18, 2005. In addition, you have our approval to temporarily impact
50 linear feet of Beaverdam Creek for the purpose of installing temporary cofferdams during the bridge
replacement. The location of the project is State Road 1146 (Maple Springs Church Road) in Cleveland
County. After reviewing your application, we have determined that this project is covered by Water Quality
General Certification Number 3404. This certification corresponds to the Regional General Permit 198200031
issued by the U.S. Army Corps of Engineers (USACE). Please note that you should get any other federal,
state or local permits before proceeding with your project, including those required by (but not limited to)
Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval will
expire with the associated 404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design that you described in your application (unless modified
below). Should your project change, you must notify the DWQ in writing and you may be required to submit a
new application. If the property is sold, the new owner must be given a copy of this Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or if total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h)(6) and (7). For this approval
to remain valid, you must adhere to the conditions listed in the attached certification and those listed below:
1. Riprap must not interfere with thalweg performance and aquatic life passage during low flow conditions.
2. The presence of equipment in the channel must be minimized. Under no circumstances must rock, sand or
other materials be dredged from the wetted stream channel.
3. Erosion and sediment control practices must utilize Best Management Practices (BMP) and be in full
compliance with all specifications governing the proper design, installation, and operation and maintenance of
such BMP in order to protect surface water standards:
a. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of
the North Carolina Sediment and Erosion Control Manual.

The devices shall be maintained on all construction sites, borrow pit sites, and waste pile (spoil)
projects, including contractor-owned or leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina Surface
Mining Manual.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
4. Heavy equipment must be operated from the banks rather than in the stream channel, when possible, in
order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream.
5. Temporary dewatering sites must be restored to pre-existing conditions unless more natural geomorphic
conditions can be provided.
6. No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened.
7. The dimension, pattern and profile of the stream above and below the crossing should not be modified.
Disturbed floodplains and streams should be restored to natural geomorphic conditions.
8. All mechanized equipment operated near surface waters must be regularly inspected and maintained to
prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials.
9. All work shall be performed during low or normal flow conditions.
10. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to
surface waters is prohibited.
11. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within 30 days after the Division of Land Resources has
released the project.
12. The North Carolina Department of Transportation (NCDOT) and its contractors and/or agents shall not
excavate, fill or perform mechanized land clearing at any time in the construction or maintenance of this
project within waters and/or wetlands, except as authorized by this Certification, or any modification to this
Certification (e.g., no work shall occur outside of the footprint of the plans provided). In addition, there shall
be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this
Certification without appropriate modification. If this occurs, compensatory mitigation may be required since it
is a direct impact from road construction activities.
13. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to notify DWQ when all work included in the 401 Certification has been completed. Please
include photographs upstream and downstream of the structure to document correct installation.
14. Continuing Compliance. NCDOT shall conduct its activities in a manner so as not to contravene any state
water quality standards [including any requirements for compliance with section 303(d) of the Clean Water
Act] and any other appropriate requirements of state and federal law. If DWQ determines that such
standards or laws are not being met (including the failure to sustain a designated or achieved use) or that
state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ
may reevaluate and modify this certification to include conditions appropriate to assure compliance with such
standards and requirements in accordance with 15 A NCAC 2H.0507(d).
Page 3
Before codifying the certification, DWQ shall notify NCDOT and the USACE, provide public notice in
accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504. Any new or revised conditions shall be provided to NCDOT in writing, shall be provided to
the USACE for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also
become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If
you have any questions, please telephone Polly Lespinasse in the Mooresville Regional Office at 704-663-

Mr. Steve Lund - NCDOT Projects 050494

SUBJECT: Bridge # 113 Replacement, SR 1146 (Maple Springs Church Road), Cleveland County
Dear Mr. Lund:
The North Carolina Department of Transportation requests authorization to replace Bridge #113, which
was washed out during the storm of 12/10/04. The original 110' long x 20' wide timber and steel bridge
will be replaced with a three span 145' long x 33' wide concrete bridge. Fifty feet of Class II riprap will
be utilized on the embankment under the bridge for scour protection. The scope of the work will
permanently impact 50 linear feet of streambank of the jurisdictional waters associated with Beaverdam
Creek, which is classified as Class C Waters by the Division of Water Quality.
The normal flow stream width was determined to be -40 based upon upstream and downstream cross-
sections. The stream has overwidened to -55 feet at the bridge site, most likely due to the concrete footer
located in the middle of the stream from the old bridge. The instream concrete footer will be removed
during new bridge construction, which should allow the stream to narrow to "normal" dimensions. The
bents for the new bridge will be located at the each end of the 60-foot middle bridge span, which is to be
centered over the existing stream channel; therefore, the new bents will be located beyond the "normal"
40-foot stream width.
Temporary cofferdams will be used during bent construction to isolate the streamflow from the active
work area. Upon project completion, the areas impacted by the temporary cofferdams will be restored to
pre-project conditions. The streambank under the bridge will be graded to natural contours and the area
outside of the riprap will be revegetated with native woody vegetation.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The washed out bridge is being replaced with a three span bridge. Reference upstream/
downstream cross-sections indicate that the normal average stream width is 40 feet, The stream
channel at the bridge site has overwidened to a width of -55 feet, most likely due to the concrete
footer located in the middle of the stream. The concrete footer will be removed during new
bridge construction. The bents for the new bridge will be located at the each end of the 60-foot
middle bridge span which will be located at the edge of the existing stream channel. Once the
instream concrete footer is removed the stream channel should stabilize and narrow to its
"normal" width Class II riprap will be used around the on the embankment under the bridge
for scour protection.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetiands/strmgide.htmi.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Stream impacts will be mitigated for by regrading the stream bank under the bridge to natural
contours and revegetating the affected area outside of the fifty feet of ripap impacts with native
woody vegetation.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the

Minimal increase in impervious surface is proposed due to 13-foot increase in bridge width.
XH. Sewage Disposal (required by DWQ)
Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of
wastewater generated from the proposed project, or available capacity of the subject facility.
No wastewater will be generated from the project.

NOTES
This map is for use in administering the National Flood Insurance Program; it
does not necessarily identify all planimetric features outside Special Flood Hazard
Area or all areas sublecl to flooding, particularly from local drainage sources
of small size.
Areas of Special Flood Hazard (100-year flood) include zones, A, AE, Al-A30,
AH, AO, A99, V, VE and V1--V30.
Cenain areas not in Special Flood Hazard Areas may he protected by flood control
slruclures.
Boundaries of the floodways were computed at cross sections and interpolated
between cross sections. The floodways were based on hydraulic considerations
with regard to requirements of the Federal Fmergency Management Agency.
Floodway widths in some areas may be too narrow to show to scale. Refer to
Floodway Data Table where floodway width is shown at 1120 inch.
Coastal base flood elevations apply only landward of the shoreline.
This map mrorporales approximate boundaries of coastal narriers established
under the Coastal Barrier Resources Act (111. 97-148).
Corporate limits shown are torrent as of the date of this map. The user should
contact appropriate e onumunily officials to determine if corporate limits have
changed subsequent to the iuuame of this map.
For ad)mmng panels, see separately printed Map Index.
