RETURN OF APPLICATION
Dear Mr. Weber:
On April 12, 2006, the Division of Water Quality (DWQ) received your application dated April 10, 2007
to impact 280 linear feet of perennial stream to construct the proposed road through the site which is to be
developed as a residential subdivision. Your application was unacceptable due to the following items:
1. You have not shown all stream impacts including all fill slopes, dissipaters and bank stabilization
on the site plan.
2. You did not provide the proposed lot layout as overlays on the site plan.
3. You did not provide road details (i.e., two-lane, paved, gravel, etc.).
4. You did not provide detailed construction drawings for each site.
5. You did not provide construction details for the bridges at sites 1, 2 and 3. '
6. Additionally, DWQ has concerns with the restoration plans of these sites. Due to the steep slopes
of these streams it will be crucial to provide stability to prevent instability and head-cutting once
the grade controlling are removed. Please provide restoration plans for each individual site
including designed dimensions, patterns, and profiles along with the plan view and cross section
drawings. These drawings should include designed structures and planting locations. It is the
position of this Office that you have not adequately established a purpose and need for a third
aesthetic pond at this residential development.
For these reasons your permit application is hereby considered withdrawn. Should you choose to reapply,
we strongly encourage you to arrange apre-application with DWQ staff so we may assist you and help
you to submit a complete application. Additionally, once you have redesigned your project to address the

approval. This includes submitting a complete application package with the appropriate.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity
and any work done within waters of the state would be a violation of North Carolina General Statutes and
