Box 308 Concord, North Carolina 28026 Dear Ms. Churchwell: Subject: Endangered and Threatened Species Assessment, Proposed Glen Laurel Sewer Line Replacement Project, South of Concord, Cabarrus County, North Carolina On June 1, 2011 we received a letter from you (via e-mail) in which you requested our comments on the subject project. We have reviewed the information you presented and are providing the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). According to the information that you presented, the City of Concord is proposing to replace an undersized and failing sewer line. The new sewer line will be constructed along an unnamed tributary to Irish Buffalo Creek. Multiple crossing of the unnamed stream will be necessary to complete the project. You indicated that several crossings will be directionally bored, however two crossings will be installed using an open-cut/trench method. Your letter did not indicate the specific number of crossings or the total amount of impacts that will occur to the unnamed stream. Endangered Species. According to our records and a review of the information you presented, no listed species or their habitats occur on the site. Therefore, we believe the project will have "no effect" on federally listed species or designated critical habitats and the requirements under section 7 of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. Migratory Birds - Your letter did not state the exact construction alignment of the new sewer line. We assume that the new sewer line will be installed in the existing right-of-way of the existing sewer line. However, if any new right-of-way will need to be cleared for the new sewer line, then protective measures for migratory birds should be implemented into the project plans. The Migratory Bird Treaty Act (16 U.S.C. 703-712) prohibits the taking, killing, possession, transportation, and importation of migratory birds, their eggs, parts, and nests, except when specifically authorized by the Department of the Interior. Implementing regulations define "take" under the Migratory Bird Treaty Act as to "pursue, hunt, shoot, wound, kill, trap, capture, possess, or collect." Unlike the Endangered Species Act, neither the Migratory Bird Treaty Act nor its implementing regulations at 50 CFR Part 21, provides for the permitting of "incidental take" of migratory birds. To avoid impacts to migratory birds, we recommend conducting a visual inspection of migratory bird nesting habitat within the project area during the nesting season of March through September. If migratory birds are discovered nesting in the project impact area, avoid impacting the nests during the migratory bird nesting season (March through September). Bald and golden eagles are afforded additional legal protection under the Bald and Golden Eagle Protection Act (16 U.S.C. 668-668d). Erosion Control and Wetland/Stream Protection. Given the proximity of the project to aquatic environments, measures to control sediment and erosion should be installed before any ground disturbing activities occur. Grading and backfilling should be minimized, and existing vegetation should be retained (if possible) to maintain shoreline cover for fish and wildlife. Disturbed areas should be re-vegetated with native grass and tree species as soon as the project is completed. Invasive/Exotic Species. We are concerned about the introduction and spread of invasive exotic species in association with the proposed project. Without active management, including the revegetation of disturbed areas with native species, project corridors will likely be sources of (and corridors for) the movement of invasive exotic plant species. Exotic species are a major contributor to species depletion and extinction, second only to habitat loss. Exotics are a factor contributing to the endangered or threatened status of more than 40 percent of the animals and plants on the Federal List of Endangered and Threatened Wildlife and Plants.' It is estimated that at least 4,000 exotic plant species and 2,300 exotic animal species are now established in the United States, costing more than $130 billion a year to control.2 Additionally, the U.S. Government has many programs and laws in place to combat invasive species (see www.invasivespecies.gov). Specifically, Section 2(a)(3) of Executive Order 13112 - Invasive Species (February 3, 1999) directs federal agencies to "not authorize, fund, or carry out actions that it believes are likely to cause or promote the introduction or spread of invasive species in the United States or elsewhere." Despite their short-term erosion-control benefits, many exotic species used in soil stabilization seed mixes are persistent once they are established, thereby preventing the reestablishment of native vegetation. Many of these exotic plants3 are also aggressive invaders of nearby natural areas, where they are capable of displacing already-established native species.
