SUMMARY The following report summarizes the monitoring activities that occurred in 2010 at the Mitigation Sites on Lots 39 and 41 in the Royall Oaks Subdivision and Lots I 1 and 12 in the Dolphin Ridge Subdivision that were created pursuant to Permit 200401077. The Dolphin Ridge Subdivision is located on the south side of Coast Guard Road in Emerald Isle, North Carolina, and the Royall Oaks Subdivision is located on the north side of Coast Guard Road (directly across from the Dolphin Ridge Subdivision) in the Town of Emerald Isle. The Town of Emerald Isle is located in Carteret County, North Carolina. The goal of the monitoring activities is to determine if the Mitigation Sites have been constructed and planted to establish sustainable wetlands areas ("Created Wetlands") that are similar to the natural wetlands that adjoin the Mitigation Sites. The data obtained from the monitoring wells installed in the Mitigation Sites and the survival and growth of the various wetlands plants planted in the Mitigation Sites indicates that the Mitigation Sites are functioning just like the natural wetlands they adjoin and that the creation of the Created Wetlands has been successful. Although one additional year of monitoring is required, based on the results from the first two years of monitoring, the mitigation has been successful and the Mitigation Sites are functioning wetlands. INTRODUCTION Project Description: The Project consists of 5,268.35 square feet of mitigation areas that are located on the following lots: 1. 1,442.45 square feet on Lot 39 in Royall Oaks; 2. 2,160.10 square feet on Lot 41 in Royall Oaks; 3. 1,318.4 square feet on Lot 11 in Dolphin Ridge; and 4. 347.4 square feet on Lot 12 in Dolphin Ridge. The 5,268.35 square feet of mitigation areas are to provide compensatory mitigation for a total of 3,530 square feet of wetlands that were filled on Lots 9, 12, and 93 in Dolphin Ridge and Lot 2 in.Royall Oaks. The compensatory mitigation exceeds the minimum 1:1 onsite mitigation ratio, and is close to a ratio of 1.5:1. The Mitigation Sites on Lots 11 and 12 in Dolphin Ridge adjoin each other and are considered one Mitigation Site in this Report. Copies of portions of the subdivision plats for Dolphin Ridge and Royall Oaks and copies of the surveys on Lots 39 and 41 in Royall Oaks and Lots 11 and 12 in Dolphin Ridge are included in Exhibit 1 to this Report. The plats have the general locations of the Mitigation Sites marked on them. The Mitigation Sites initially were excavated and planted in 2007. However, the Corps of Engineers expressed concerns that the depth of the 2007 excavation might not be sufficient to establish long term sustainable wetlands. To address these concerns, in 2008 additional excavation occurred at all of the Mitigation Sites to bring the elevations in the Mitigation Sites to elevations similar to those of the natural wetlands that adjoin the Mitigation Sites. The Corps of Engineers also recommended that when the Mitigation Sites were replanted after the additional excavation that plants from the neighboring natural wetlands be transplanted to the Mitigation Sites to insure compatibility and to increase the success of the wetlands. Accordingly, in 2008, the Mitigation Sites were planted with a mix of Lizard's Tail (Saururus cernuus), Rush (Juncaceae), Red Maple (Acer rubrum), Button Bush (Cephalanthus occidentalis), Wax Myrtle (Myrica cerifera), Bald Cypress (Taxodium distichum), and Sweetbay Magnolia (Magnolia virginiana) plants. Although not reported previously, Fetterbush (Lyonia lucida) also was transplanted into the Mitigation Sites and a Black Willow (Salix nigra) was planted in the Mitigation Site on Lots 11 and 12 Dolphin Ridge. We specifically did not plant any Common Cattail (Typha latifolia) in the Mitigation Sites. After the plantings were completed, two monitoring wells were installed in each Mitigation Site. The monitoring wells were installed pursuant to the instructions and procedures detailed in the "Technical Standard for Water-Exhibit Monitoring of Potential Wetland Sites" prepared by the U.S. Army Corps of Engineers dated June 2005. In order to demonstrate that the mitigation is successful, hydrology and vegetation monitoring must be conducted for three years to confirm that the Mitigation Sites meet the Hydrology Success Criteria and the Vegetation Success Criteria as established by the project specifications and in compliance with federal guidelines for wetland mitigation. 2010 is the second year of monitoring following the re-grading and replanting of the sites in 2008. This Report details the 2010 results of the hydrology and vegetation monitoring at the Mitigation Sites. 4 HYDROLOGY Hydrology Success Criteria: Project specifications require saturation (within 12 inches of the surface) or inundation of the Mitigation Sites for a consecutive period of at least 12.5% of the growing season for one year under average climatic conditions for the Mitigation Sites to be deemed to meet the Hydrology Success Criteria. According to the data for WETS Station Morehead City 2WNW, NC5830 having a latitude of 34° 44'N and a longitude of -76° 44'W, published by the National Water and Climate Center of the Natural Resources Conservation Service of the United States Department of Agriculture, the growing season in Carteret County, based on a 50% probability that air temperatures will reach 28° Fahrenheit or higher, runs from March 14 to November 30. That means that the growing season contains 261 days, and 12.5% of 261 days equates to 33 days. Accordingly, for the various Mitigation Sites to meet the Hydrology Success Criteria, they need to show saturation (within 12 inches of the surface) or inundation for at least 33 consecutive days between March 14 and November 30 under average climatic conditions. Lot 39 in Royall Oaks is located at latitude 34° 39'30"N and longitude -77° 04'29"W; Lot 41 in Royall Oaks is located at latitude 34° 39'30"N and longitude -77° 04'26"W; and Lots 11 and 12 in Dolphin Ridge are located at latitude 34° 39'21 "N and longitude -77° 04'21 "W. The Mitigation Sites are located approximately 20 miles from WETS Station Morehead City 2WNW, NC5830 and approximately 4 miles from State Climate Office of North Carolina Station KNJM - Bogue Field MCALF, in Bogue, North Carolina, having a latitude of 34.69°N and a longitude of -77.02°W. Each Mitigation Site has two (2) monitoring wells installed in it. The monitoring wells were installed pursuant to the instructions and procedures detailed in the "Technical Standard for Water-Exhibit Monitoring of Potential Wetland Sites" prepared by the U.S. Army Corps of Engineers dated June 2005. The Monitoring Well Installation Data Sheets for each of the monitoring wells and surveys showing the location of the monitoring wells at the Mitigation Sites were included in the Annual Mitigation Report for 2009. The monitoring wells at each Mitigation Site were labeled "A" and "B" for ease of reference. Each monitoring well was manually monitored on a daily basis from March 14, 2010, to November 31, 2010. Monitoring well reports in graph form showing the daily measurements at each of the monitoring wells for each month of the Growing Season are contained in Exhibits 2 - 7 of this Report. All measurements are in inches. Each monitoring well has a separate graph for each month of the Growing Season. Each graph shows the "Date," "Depth of Water From Surface in Monitoring Well," and "Depth of Standing Water Above Surface." Negative numbers indicate that the water level is located below the ground level surface that distance, and positive numbers indicate that the water level is located above the ground level surface that distance. If there is no standing water on the surface, the graph shows the depth of standing water as "0". If the depth of the surface water surrounding a monitoring well exceeded the height of the monitoring well riser, then the number shown in the "Depth of Water From Surface in Monitoring Well" column is the depth of the surrounding surface water. Monitoring Well Results for Entire Growing Season: A review of the Monitoring Well reports based on the entire Growing Season (without consideration of the amount of rainfall during the Growing Season) indicates that each of the Mitigation Sites experienced saturation (within 12 inches of the surface) or inundation for at least 33 consecutive days of the 2010 Growing Season. An analysis of the Monitoring Well reports for each of the Mitigation Sites for the entire Growing Season shows the following: A. At the Mitigation Site at Lot 39 in Royall Oaks: 1. Monitoring Well A had 113 days (vs. 86 days in 2009) where the soil was saturated at a depth of 12 inches or less from the surface and 140 days (vs. 171 days in 2009) where the soil was inundated with water. 2. Monitoring Well B had 112 days (vs. 79 days in 2009) where the soil was saturated at a depth of less than 12 inches from the surface and 146 days (vs. 178 days in 2009) where the soil was inundated with water. B. At the Mitigation Site at Lot 41 in Royall Oaks: Monitoring Well A had 115 days (vs. 115 days in 2009) where the soil was saturated at a depth of less than 12 inches from the surface and 144 days (vs. 142 days in 2009) where the soil was inundated with water. 2. Monitoring Well B had 116 days (vs. 106 days in 2009) where the soil was saturated at a depth of less than 12 inches from the surface and 141 days (vs. 151 days in 2009) where the soil was inundated with water. C. At the Mitigation Site at Lots 11 and 12 in Dolphin Ridge: Monitoring Well A had 85 days (vs. 62 days in 2009) where the soil was saturated at a depth of less than 12 inches from the surface and 147 days (vs. 189 days in 2009) where the soil was inundated with water. 2. Monitoring Well B had 89 days (vs. 57 days in 2009) where the soil was saturated at a depth of less than 12 inches from the surface and 152 days (vs. 200 days in 2009) where the soil was inundated with water. 6 Monitoring Well Results for Periods During Growing Season with Average Climatic Conditions: Since one of the parameters of the Hydrology Success Criteria is that the conditions be met "under average climatic conditions," the average climatic conditions during a normal Growing Season must be determined. Once the average climatic conditions are determined, it must be determined if (and when) such average climatic conditions occurred during the 2010 Growing Season. The Monitoring Well data then must be examined to determine if the Mitigation Sites experienced saturation (within 12 inches of the surface) or inundation for at least 33 consecutive days during the 2010 Growing Season when the average climatic conditions occurred. To assist in answering these issues, we prepared the charts contained in Exhibit 8 of this Report. The charts in Exhibit 8 of this Report show the following data: 1. The column labeled "Date" shows the date of the measurements. 2. The column labeled "Rain Measured at Site" shows the rainfall data as manually measured on a daily basis at one of the Mitigation Sites at the same time that the monitoring wells were being checked. The column labeled "Rain Per NC CRONOS" shows the Daily Precipitation by Day data published by the State Climate Office of North Carolina for Station KNJM - Bogue Field MCALF, in Bogue, North Carolina. 4. The column labeled "Normal Rainfall" is the Normal Precipitation by Day based on 1971 to 2000 climate records as published by the State Climate Office of North Carolina for the period of March 14 to November 30 for Station 315830 - Morehead City 2WNW, in Morehead City, North Carolina. 7 We then compiled the daily data contained in the charts in Exhibit 8 into the chart below where: 1. The column labeled "Month" shows the month during the Growing Season. 2. The column labeled "Actual Rainfall Measured at a Mitigation Site" shows the total rainfall measured for the month at one of the Mitigation Sites. 3. The column labeled "Historic Normal Rainfall" shows the monthly total of the rainfall during the month based on the "Normal Rainfall" reported by the State Climate Office of North Carolina. 4. The column labeled "Actual Rainfall Measured by the Weather Service" shows the monthly total of the Daily Precipitation by Day data published by the State Climate Office of North Carolina for Station KNJM - Bogue Field MCALF, in Bogue, North Carolina. The column labeled "Difference" shows the "Actual Rainfall Measured at a Mitigation Site" less the corresponding "Historic Normal Rainfall." However, the overall difference for the entire growing season only was a negative 2.58 inches of rainfall, and that represents only approximately a six (6) percent difference for the entire growing season. Consequently, we considered the growing season as a whole to meet the "average climatic conditions" requirement. Although excess rain in a growing season could indicate that an area is a wetlands when in fact it is not a wetlands during a normal rain season, having an area meet the hydrologic requirements for a wetlands when the rainfall is less than the normal amount (as in this case) does indicate that the area would meet the hydrologic requirements during a normal rain season. An analysis of the monitoring well data for the 2010 growing season for the Mitigation Sites shows that the Mitigation Sites experienced saturation (within 12 inches of the surface) or inundation for at least 33 consecutive days. Consequently, the Mitigation Sites met all of the parameters of the Hydrology Success Criteria. The monitoring wells reports for the 2010 growing season show the following: A. At the Mitigation Site at Lot 39 in Royall Oaks: Monitoring Well A met the criteria 253 days of the growing season. This included one period beginning in March of 112 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water and second period beginning in July of 136 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water. 2. Monitoring Well B met the criteria 258 days of the growing season. This included one period beginning in March of 115 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water and second period beginning in July of 143 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water. B. At the Mitigation Site at Lot 41 in Royall Oaks: Monitoring Well A met the criteria 259 days of the growing season. This included one period beginning in March of 116 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water and second period beginning in July of 143 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water. 2. Monitoring Well B met the criteria 257 days of the growing season. This included one period beginning in March of 114 consecutive days where the soil was saturated 9 at a depth of less than 12 inches from the surface or the soil was inundated with water and second period beginning in July of 143 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water. C. At the Mitigation Site at Lots 11 & 12 in Dolphin Ridge: Monitoring Well A met the criteria 232 days of the growing season. This included one period beginning in March of 101 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water and second period beginning in August of 98 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water. 2. Monitoring Well B met the criteria 241 days of the growing season. This included one period beginning in March of 105 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water and second period beginning in August of 109 consecutive days where the soil was saturated at a depth of less than 12 inches from the surface or the soil was inundated with water. Based on the monitoring well data, all of the Mitigation Sites met the Hydrology Success Criteria for the 2010 Growing Season and would be considered wetlands under the Hydrology Success Criteria. 10 VEGETATION Vegetation Success Criteria: Project specifications require that we establish wetlands vegetation in the Mitigation Sites similar to the vegetation in adjacent natural wetlands areas for the Mitigation Sites to be deemed to meet the Vegetation Success Criteria. The Mitigation Sites were planted with Lizard's Tail (Saururus cernuus), Rush (Juncaceae), Red Maple (Acer rubrum), Button Bush (Cephalanthus occidentalis), Wax Myrtle (Myrica cerifera), Fetterbush (Lyonia lucida), Bald Cypress (Taxodium distichum), and Sweetbay Magnolia (Magnolia virginiana) in 2008. A Black Willow (Salix nigra) also was planted in the Mitigation Site on Lots 11 and 12 Dolphin Ridge. We specifically did not plant any Common Cattail (Typha latifolia) in the Mitigation Sites. With the Mitigation Sites being small in size (ranging from approximately 1,450 square feet to 2,160 square feet), the vegetation may be monitored with a simple visual inspection of the Mitigation Sites. All of the Mitigation Sites were visually inspected in July of 2010 and January of 2011. In July of 2010, the Mitigation Site on Lot 39 in Royall Oaks was thriving as shown in Photographs 1 - 3 in Exhibit 9 taken on July 24, 2010. The photographs show a healthy wetlands area with Common Rush, Common Cattail, Bald Cypress, Southern Lady Fern, Fetterbush, and other wetlands plants that naturally have propagated into the Mitigation Site. Photographs 4 and 5 in Exhibit 9 show the Mitigation Site on Lot 39 in Royall Oaks on January 16, 2011. In July of 2010, the Mitigation Site on Lot 41 in Royall Oaks was flourishing as shown in Photographs 6 - 8 in Exhibit 9 taken on July 24, 2010. The photographs show a healthy wetlands area with Common Rush, Common Cattail, Wax Myrtle, Lizard's Tail, Fetterbush, and other wetlands plants that naturally have propagated into the Mitigation Site. Photographs 9 and 10 in Exhibit 9 show the Mitigation Site on Lot 41 in Royall Oaks on January 16, 2011. In July of 2010, the Mitigation Site on Lots 11 and 12 in Dolphin Ridge was prospering as shown in Photographs 11 and 12 in Exhibit 9 taken on July 24, 2010. The photographs show a healthy wetlands area with Common Rush, Common Cattail, Sweetbay Magnolia, Lizard's Tail, Fetterbush, the Black Willow, and other wetlands plants that naturally have propagated into the Mitigation Site. Photographs 13 and 14 in Exhibit 9 show the Mitigation Site on Lots 11 and 12 in Dolphin Ridge on January 16, 2011. All of the Mitigation Sites are doing well and look like the natural wetlands that they adjoin. As the wetlands plants continue to grow and natural propagation occurs from the adjoining wetlands, each of the Mitigation Sites will become integrated into the adjoining natural wetlands. Although the Red Maple died in all of the Mitigation Sites and the Sweetbay Magnolia died in two of the Mitigation Sites, the extensive growth of the other wetlands plants shows how well the Mitigation Sites have been transformed into wetlands. The Mitigation Sites look like the natural wetlands that they adjoin. All indications are that the good survival and growth rates of the wetlands plants will continue. CONCLUSION The Mitigation Sites are doing well. All of the Mitigation Sites met the Hydrology Success Criteria and the Vegetation Success Criteria in 2010. The Mitigation Sites are functioning just like the natural wetlands that they border. 12 REFERENCE MATERIALS: 1.
