Sullins Director Natural Resources Dee Freeman Secretary May 31, 2011 CERTIFIED MAIL: 7010 0290 0003 0834 1086 RETURN RECEIPT REQUESTED Prestige Homes Attn: John Koenig 6432 Yadkin Road Fayetteville, NC 28303 Dear Mr. Koenig SUBJECT: Williamsburg Plantation, Jacksonville Project # 05 2253 V3 Onslow County This Office has reviewed your Pre-Construction Notification (PCN) application dated April 12, 2011 for the fill of 0.020 acres of jurisdictional wetlands for a Nationwide 3 permit from the US Army Corps of Engineers (USACE). The Division of Water Quality (DWQ) has determined that your application was incomplete as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide all of the following information so that we may continue to review your project. On May 18, 2011, David Bailey of the USACE wrote a letter stating that the project as proposed: 1) Does not qualify as `Maintenance' under the Nationwide 3. 2) The purpose and need for the project cannot be currently justified. 3) Requested information to change the project so it would qualify for the Nationwide 3 permit 4) Made suggestions that the proposed project be include in an Individual Permit application for the remaining section of Williamsburg Plantation. Please include the DWQ in your response to the USACE's letter. Please respond within three weeks of the date of this letter by sending this information to me in writing and two copies to Ian McMillan c/o 401 Wetlands and Stormwater Branch, 1650 Mail Service Center, Raleigh, NC 27699-1650. Please reference the DWQ Project # of 2005 2253 V3 in all future correspondence. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
