8. PROJECT SUMMARY: The applicant proposes to refurbish and expand an existing pier, re-configure
an existing dock into aten-slip dock with one boatlift, and to construct an open deck landward of the
existing bulkhead.

9. PROJECT DESCRIPTION:
The project site is located at 1343 Cedar Landing Road, adjacent to the Atlantic Intracoastal Waterway
(AIWW), on the mainland side of Holden Beach, in Brunswick County. To get to the site from
Wilmington take US Hwy 17 S to Mt. Pisgah Rd. Turn left onto Mt. Pisgah Rd., Mt. Pisgah Rd. merges
with NC Hwy 130, and continue on NC Hwy 130. Turn right onto Cedar Landing Road, which is the last
street to the right before crossing the Holden Beach Bridge. The subject property is located on Cedar
Landing Road approximately 0.1 miles on the left.
The project site consist of 2 adjoining parcels (Tract A and Tract B) totaling approximately 1.08 acres of
land, bordered by Cedar Landing Road to the north, the AIWW to the south. Existing highground
structures include a 2-story building with a restaurant; both uncovered and covered decks, elevated
boardwalks, boat ramp and gravel parking area. The southern portion of Tract A is bulkheaded. The
property has an average elevation of approximately 7 feet above mean sea level with approximately 197
linear feet of shoreline. Upland vegetation consists of lawn grasses, landscape shrubs and trees.
Waterward of the bulkhead and adjacent to Tract B, is a band of low marsh measuring approximately 15'
to 25' in width, which consists primarily of Smooth Cordgrass (Spartina alterniflora).
The Brunswick County Land Use Plan classifies upland portion of the project area as Conservation. The
waters of the Atlantic Intracoastal Waterway are classified as SA, HQW by the NC Division of Water
Quality. These waters are NOT designated as Primary Nursery Area (PNA) by the NC Division of
Marine Fisheries and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to refurbish and expand an existing pier, re-Conti<,ure an existing duel, into .~ !~n-
slip dock with one boatlift, and to construct an open deck landward of the existing bull:h~ad. l h~~
applicant is proposing to refurbish the existing 58' x 4' pier, remove the existing platform, ramp and
floating dock.
The existing dock encroaches approximately 28' into the USACOE's 80' Federal Channel Setback. As
proposed the new pier would measure approximately 44' in length by approximately 6' in width. There
would be a ramp on the terminal end of the pier, which would continue waterward and would measure
approximately 16' in width by approximately 16' in length. The applicant is proposing aramp-landing
platform measuring approximately 6' in width by 6' in length on the landward side of the east end of the
proposed floating dock. The proposed floating dock would measure approximately 125'in length by
approximately 6' in width aril would extend westward perpendicular to the AIWW. As proposed the
floating dock would encroach approximately 6' into the 80' Federal Channel Setback, however. all
pilings as proposed would be located landward of the 80' setback and all structures would also meet the
15' Riparian Corridor Setback. The applicant states that the floating dock would be used for temporary
transient dockage for the restaurant patrons. The floating dock is designated for 9 slips with five (5) slips
on the waterward side and four (4) slips on the landward side. The applicant is also proposing a finger
pier on the eastern end of the floating dock, which would measure approximately 10' in length by
approximately 4' in width and would extend landward. Adjacent to the finger pier on the eastern side,
the applicant is proposing a boatlift, which would measure approximately 14' in length by approximately
12.5' in width. The applicant states that the boatlift would be the only permanent slip. As proposed,

the new docking system would result in a ten-slip facility. The application states that the water depths
adjacent to the floating dock range from approximately -1.0' to approximately -2.7' at Mean Low Water
(MLW) and approximately 0.0' @ MLW at the boatlift.
The applicant is also proposing to expand the existing deck, which is located adjacent to the bulkhead on
the landward side. The existing deck measures approximately 20' x 36' and is covered. The existing
deck is located entirely within the 30' Coastal Shoreline Buffer. The owners were granted a variance
from the CRC on January 29, 2004 to construct a roof over the open deck. As proposed the deck addition
would measure approximately 10' x 20' and would be elevated and uncovered. The deck addition would
be located on the west side of the existing deck and would also be located entirely within the 30' Coastal
Shoreline Buffer.
10. ANTICIPATED IMPACTS:
The proposed fixed pier, floating dock, finger pier and boatlift would incorporate 1,138 sq. ft. of
Estuarine Waters and Pubic Trust Area. The proposed floating dock would not encroach into the
adjacent 15' Riparian Corridor Setback Area, but would encroach 6' into the 80' USACE Federal
Channel Setback. The applicant states that a verbal approval was received from Howard Varnam for the
floating dock encroachment. Minor increases in turbidity should be expected during construction. The
proposed docking facility would extend an average of approximately 68~ into the waterbocl~ . ~-~ hich
measures approximately 305' feet across. This distance conforms to the li4 width rule.
The proposed deck addition would result in 200 sq. ft. of open decking within the 30' Coastal Shoreline
Buffer. There is approximately 1,035 sq. ft. of existing covered deck located within the 30' Coastal
Shoreline Buffer adjacent to the existing bulkhead. Of this, approximately 720 sq. ft. was allowed by a
Variance from the CRC, which was granted on January 29, 2004.

The applicant proposes to refurbish an existing pier, remove existing structures within the
Corps 80' setback, construct a new 125'x 6' floating dock for transient dockage,
construct one boat lift and a 200 square foot (s.f.) slated elevated wooden deck on their
property located at 1343 Cedar Landing Road, Brunswick County, North Carolina. The
property is located on the Atlantic Intracoastal Waterway.
Currently there is an existing pier, platform, ramp and an 8'x 25' floating dock. The
existing platform, ramp and floating dock will be removed. The existing 58'x 4' pier will
be refurbished to 44'x 6' pier. Anew 3'x 16' ramp and 125'x 6' floating dock will be
added to provide temporary transient dockage to restaurant patrons. One boatlift will be
constructed. Based on an updated normal high water line flagged by Land Management
Group Inc. in August of 2006, total linear length of the shoreline is 197 feet, allowing for
a total of 788 s.f. of dock structure. Based on 25' side-to slips there will be five on the
waterward side and four on the land side of the floating dock plus on lift-slip equaling 10
total slips.
Land Management Group, Inc. has discussed the proposed project with the Corps of
Engineers. Specifically, the Navigation Branch (Howard Varnam) has agreed that so
long as all mooring pilings are located outside of the 80' setback then the Corps will not
object to the project on a navigation basis.
There is no dredging or wetland fill proposed. Platforms will not extend more than '/4 of
the width of the water body, into the channel, or more than 6' over coastal wetlands.
None of the proposed structures associated with the boating facility are located within 15
feet of adjacent lot riparian corridor lines.
There is no additional upland development proposed. Existing man-made features on the
tract include elevated boardwalks, decks, a pier, a two story building functioning as a
restaurant, septic drain field, parking area, bulkhead, and associated utilities. Vegetation
on the tract consists of native trees, shrubs, and grasses along with landscaped areas.
Soils on the tract are classified as Wando. The 404 wetland line has been delineated,
surveyed and is being submitted for approval by the Corps of Engineers.
