Dear Ms. Beckwith:
The North Carolina Department of Transportation (NCDOT) is proposing to widen, grade„drain
and pave SR 1145; Shoal Creek Road, in Cherokee County. This proposal entails widening and
paving the existing gravel road to a standard 18-foot roadway. The original permit application
dated December 1, 2010, included the extension and/or replacement of six corrugated metal
culverts. Once the project was under construction, it was discovered that we needed to extend
two additional pipes, site 7 and site 8. This will increase the total stream impacts from 183 linear
feet to 262 linear feet.
1 have enclosed a revised impact table to the PCN application and plan sheets for the two
additional culverts, photographs, and a USGS quad map. We propose to install the new culverts
slightly below the existing streambed elevation where bedrock is not encountered to minimize
impacts to aquatic habitats and allow the existing stream gradient to remain as unchanged as
physically possible.
The best management practices will be used to minimize and control sedimentation and erosion
on this project. The construction foreman will review all erosion control measures daily to
ensure sedimentation and erosion is being controlled effectively. If the planned devices are not
functioning as intended, they will be replaced immediately with better devices.

Impacts to Waters of the Ueitetl States
The unnamed tributary of South Shoal Creek (DWQ Class C; Tr) at site 2 is shown on the USGS
topographic map as a perennial stream. The streams at permit sites I, 3, 4 and 7 are not shown
on the topographic map. The unnamed tributaries of Rocky Ford Creek (DWQ Class C) at sites
5, 6 and 8 are not shown on the topographic map. The seven unnamed tributaries that are not
shown on the USGS map are small, but they have well-defined channels. The channel substrate
of the streams to be effected is primarily composed of gravel, sand and silt. All five unnamed
tributaries of South Shoal Creek flow into South Shoal Creek within 0.5 mule of the road
crossings. South Shoal Creek flows into Appalachia Lake approximately 11.5 to 13.0 miles
downstream from sites I and 4 respectively. The three unnamed tributaries of Rocky Ford Creek
flow into a larger unnamed tributary within approximately 650 feet of the road crossings. The
unnamed tributary then flows approximately 0.5 mile downstream to Rocky Ford Creek. Rocky
Ford Creek flows approximately 4.8 miles to Turtletown Creek. In turn, Turtletown Creek flows
approximately 10.6 miles to the Hiwassee River. Appalachia Lake and Hiwassee River meet the
definition of Traditional Navigable Water. For these reasons, we believe that the unnamed
tributaries of South Shoal Creek and Rocky Ford Creek are Relatively Permanent Waters and are
under the jurisdiction of the U.S. Army Corps of Engineers. In order to make the needed safety
improvements to SR 1145, it will be necessary to impact waters of the United States in the
Hiwassee River Basin. Specifically, NCDOT is requesting to replace and/or extend two
additional culverts; the proposed modifications are listed below.

(NCWRC) to conunent directly to you concerning the 404 Nationwide Permit modification
request.
Also, by copy of this letter, I am requesting authorization under Section 401 of the Clean Water
Act from the North Carolina Deportment of Environment and Natural Resources (DENR),
