Dear Ms Beckwith:
The North Carolina Department of Transportation (NCDOT) is proposing to widen, grade,
drain and pave SR 1145, Shoal Creek Road, in Cherokee County. This proposal entails
widening and paving the existing gravel road to a standard 18-foot roadway. The proposed
improvements of SR 1145 have been identified as necessary maintenance and safety
improvements. Funds have been allocated for this project, and NCDOT would like to
perform these activities in 2010/2011.
1 am enclosing a pipe installation detail, photographs, a marked county map and USGS
topographic map. We propose to replace and/or extend six culverts. The culverts will be
installed slightly below the existing streambed elevations where bedrock is not encountered to
minimize impacts to aquatic habitats and to allow the existing stream gradients to remain as
unchanged as physically possible.
The North Carolina Natural Heritage Program database lists 22 species with federal status for
Cherokee County that are known from current records or were known to occur in the county
historically. Two species, white fringeless orchid (Platanthera integrilabia) and sicklefm
redhorse (Moxostoma sp.2) are candidate species. Five species, littlewing pearlymussel
(Pegias fibula), Cumberland bean (Villosa trabalis), bog turtle (Glyptemys muhlenbergii),
small whorled pogonia (lsotria medeoloides) and Indiana bat (Myotis sodalis) are listed as
federally threatened or endangered. There are no records in the database that are within the
project area for these species.
SR-1145 Shoal Creek Road 2
The white fringeless orchid is a federal candidate species that is presumed to be extirpated
from North Carolina. This species was known to have occurred in Cherokee County
historically. This plant is an obligate wetland species and there are no wetlands affected by
the project.
The bog turtle, which is listed as threatened due to similarity of appearance with the listed
northern bog turtle, also requires wetlands. The bog turtle is typically associated with open
bogs. There are no wetlands at the site; therefore, habitat for the bog turtle is lacking.
The sicklefin redhorse is a federal candidate species known to occur in the Hiwassee River,
Valley River and their larger tributaries. The streams within the project area are too small to
support the sicklefin redhorse.
The littlewing pearlymussel and Cumberland bean are fresh water mussels. The littlewing
pearlymussel is an endangered freshwater mussel that is known from Cherokee County
historically. There are no current records listed for this species. The Cumberland bean is
known from one area downstream of the Apalachia Dam. The streams to be effected by the
road are small unnamed tributaries and are not of sufficient size to provide habitat for
freshwater mussels.
The small whorled pogonia is a federally threatened species that is associated typically with
open dry deciduous woods. It also is known to occur in rich mesic woods in association with
white pine and rhododendron. The nearest record for the small whorled pogonia is
approximately 30 miles to the northeast. Much of the project is along pasture and fence line
with shrubby growth on the fill side of the road and the cut side of the road is dominated by
oak-pine forest. Much of the oak-pine forest is closed canopy and is not characteristic of the
small whorled pogonia. There will be very minimal disturbance along most cuts. Some cuts
will have moderate disturbance within the edge of the oak-pine forest. The overall habitat
appears marginal for small whorled pogonia.
The Indiana bat is federally endangered and is known to occur in Cherokee County. Most of
the trees along the road that will need to be removed lack loose bark or sloughing bark in the
case of dead trees. Because there may be some limited potential forIndiana bat roosts along
the corridor. trees should be cleared during the winter months while the Indiana bats are in
their winter hibemacula.
Habitat for listed threatened and endangered species appears to be lacking at the site or the
species occurs too far from the proposed project to be affected. Best management practices
will reduce the potential for effects to any distal aquatic species or habitat.
Impacts to historic or cultural resources are not anticipated. The project is being submitted to
NCDOT's Human Environment Unit for archaeological and historical review.
The best management practices will be used to minimize and control sedimentation and
erosion on this project. The construction foreman will review all erosion control measures

daily to ensure sedimentation and erosion is being controlled effectively. If the planned ,
devices are not functioning as intended, they will be replaced immediately with better devices.
The rock silt screens and other erosion control devices will be in place prior to pipe culvert
construction and will remain in place until the project is stabilized.
Impacts to Waters of the United States
The unnamed tributary of South Shoal Creek (DWQ Class C. Tr.) at site 2 is shown on the
USGS topographic map as a perennial stream. The streams at permit sites 1, 3, and 4 are not
shown on the topographic map. The unnamed tributaries of Rocky Ford Creek (DWQ Class
C) at sites 5 and 6 are not shown on the topographic map. The five unnamed tributaries that
are not shown on the USGS map are small, but they have well-defined channels. The channe
substrate of the streams to be effected is primarily composed of gravel, sand and silt. All four
unnamed tributaries of South Shoal Creek flow into South Shoal Creek within 0.5 mile of the
road crossings. South Shoal Creek flows into Appalachia Lake approximately 11.5 to 13.0
miles downstream from sites 1 and 4 respectively. The two unnamed tributaries of Rocky
Ford Creek flow into a larger unnamed tributary within approximately 650 feet of the road
crossings. The unnamed tributary then flows approximately 0.5 mile downstream to Rocky
Ford Creek. Rocky Ford Creek flows approximately 4.8 miles to'T'urtletown Creek. In'turn,
Turtletown Creek flows approximately 10.6 miles to the Hiwassee River. Appalachia Lake
and Hiwassee River meet the definition of Traditional Navigable Water. For these reasons,
we believe that the unnamed tributaries of South Shoal Creek and Rocky Ford Creek are
Relatively Permanent Waters and are under the jurisdiction of the U.S. Army Corps of
Engineers. In order to make the needed safety improvements to SR 1145, it will be necessary
to impact waters of the United States in the Hiwassee River Basin. Specifically, NCDOT is
requesting to replace and/or extend six culverts.

accomplish the work.
