Re: Pre-Construction Notification for Nationwide Permit 12
North Marine Town Center -Utility Line Extension
Onslow County, North Carolina
USACE AID: SAW-2009-01308
Dear Mr. Bailey:
JUI~ 3 2011
Southern Environmental Group, Inc. (SEGi), on behalf of Bailey & Associates, Inc. (herein after referred
to as the "Applicant"), is submitting the attached Pre-Construction Notification (PCN) and accompanying
documentation, with hopes the Department of the Army will issue approval to utilize Nationwide Permit
12, for the proposed temporary impact of 34.7 linear feet of low quality stream and 0.03 acre of riparian
wetlands. The impact to the unnamed tributary and abutting wetlands is necessary to facilitate the
extension of a water line and will be limited to 15' wide. The water line is intended to service the
proposed development of the Applicant's tract of land, located across the street from the impact area,
which is at the intersection of Highway 17 and State Road 1406 (Piney Green Road), in Jacksonville,
Onslow County, North Carolina.
At this time, the NC Department of Transportation (DOT) is in the process of purchasing the parcel, on
which the proposed impacts are to take place. Work will not begin, on the impact parcel, until the transfer
of ownership has taken place. The Applicant is in the process of obtaining the necessary DOT permits for
the proposed commercial development, including the encroachment into the DOT's right-of--way for the
purpose of the water line extension. It is not anticipated that the work will take longer than a day to
complete. Work will be performed in the dry and the area will be restored to its original grade and contour
promptly upon completion of the work. Due to the nature of the impacts, the Applicant is not proposing
compensatory mitigation with this request approval. Wetland impacts are not anticipated with the
development of the commercial property.
In summary, the Applicant is seeking DA authorization, in the form of a Nationwide Permit 12, to
temporarily impact 34.7 linear feet of stream and 0.03 acre of riparian wetland, for the purpose of
extending a water line. SEGi feels the project, as proposed, meets the general and regional conditions of
NWP 12 and anticipates the approval will be granted without delay. However, should you have questions

or concerns regarding any part of this correspondence or the accompanying documentation, please feel
free to contact our office at 910.452.2711. Thank you, in advance, for your time and assistance with this
project. We look forward to hearing from you.
Sincerely,

Work will be done in the dry and sediment and erosion control measures will be in place prior to land disturbing activities
taking place. Time taken to work within the stream itself will be kept to a minimum.

Charlie,
As you are aware, this encroachment has been reviewed by our Utilities Unit in Raleigh for its
impacts on the U-3810 project. The line was designed to be 5' from the proposed RMI that was
referenced in your email. The only change pertaining to the encroachment would be to provide
an addendum to reflect the new pipe lengths once the R/V1l has been acquired. Contact with
questions or comments. SDG

Steven,
I spoke with Hugh Thompson about the ROW purchasing at the intersection of US 17 and Piney
Green. He felt this Acquisition would be forthcoming (30 days but no later than the end of
June). As you and I discusses our existing encroachment has been reviewed and at that time the
proposed ROW was shown on the plan. There may need to be some modification or addendum
to the existing encroachment paperwork but as far as the plans go this has been accounted for in
the review.
Can you confirm or add to this?
Thank you,
Charlie
