PROJECT SUMMARY: The applicant proposes to improve the Manns Harbor boat basin by: • Maintenance dredging 1,200 feet of channel, • Installing 122,102 SF of asphalt driveway/parking areas, • Constructing a kayak launch facility, • Installing 840 feet of bulkhead and 600 feet of 6-foot wide shore side dock, and • Reconfiguring two existing boat ramps into three new boat ramps. Proiect Setting The subject property is bordered by a large basin and channel to the south, old US 64/264 immediately to the north, the Croatan Sound to the east, and a lot containing a derelict commercial fish house to the west. Properties north of US 64/264 include a small Dare County park which provides fishing pier access to the Croatan Sound and large tracts of wetlands owned by the U.S. Fish and Wildlife Service. Water depths in the basin range from 1-foot along the shoreline to 30 feet in the middle of the basin. Water depths in the channel connecting the basin to the western shoreline Croatan Sound are 2-6 feet deep. The Joint Waters of the basin and the Croatan Sound are classified as SC (Fish Propagation). The basin area is closed to shell fishing, but the Croatan Sound is open to shell fishing. Elevations on the lot range from zero along the shoreline of the basin to approximately six feet above NWL at the northern edge of the property along US 64/264. The majority of the property is elevated two to three feet above NWL however. The eastern third of the property is comprised of a large area of Coastal Wetlands and U.S. Army Corps of Engineers Section 404 wetlands vegetated with Black Needlerush (Juncus roemerianus), Common Reed (Phragmites australis), and Salt Reed Grass (Spartina Cynosoroides). A "T-shaped," man-made canal, approximately 50 feet wide and 1-2 feet deep separates the large wetland area from the western two-thirds of the property. The northern and western shorelines of the canal contain the dilapidated remains of a 5-foot wide shore-side dock that has collapsed into the canal. A two-foot tall erosion escarpment located along the canal shoreline is vegetated with Wax Myrtle (Myrica species), Common Reed (Phragmites australis), and Salt bush (Baccharis species). Field Investigation Report WRC - Manns Harbor Boating Access Site, Dare County Page 3 The central third of the property is a large relatively flat area vegetated with indigenous weeds and grasses that contains dirtlgravel sections that are utilized as driving/parking areas for the 24 existing slips located along the northern edge of the adjacent basin. The shoreline adjacent to the slips has been hardened with 300 feet of wooden bulkhead and equipped with a 6-foot wide dock which extends water-ward over the bulkhead. Existing mooring pilings create the 24 slips which are oriented perpendicular to the bulkhead. Water depths in the slips are 3-4 feet deep. An additional 64 feet of bulkhead separates the slips from a 125-foot by 75-foot area of U.S. Army Corps of Engineers Section 404 wetlands located immediately to the east of the slips. The western third of the property is also a large relatively flat area with dirtlgravel sections that are utilized as driving/parking areas. The irregular shoreline in this area contains a 30-foot by 90-foot extension off the large basin, two boat ramps, and approximately 175 feet of shore-side dock. The basin extension and docking area have also been hardened with wooden bulkhead, and equipped with a 6-foot wide dock which extends water-ward over the bulkhead. The two boat ramps are each approximately 20 feet wide and are separated by a low three-foot wide finger pier. The ramps are merely extensions of the dirt/gravel parking area which has been graded to create a very gently sloping entrance into the adjacent basin. Commercial fishermen routinely utilize the docks around the boat ramps and frequently store large piles of crab pots on the adjacent shoreline. Proiect Description The applicant proposes to hydraulically dredge 1,200 feet of channel connecting the large basin to the Croatan Sound from current depths of 2-6 feet to a final dredge depth of 6 feet. These efforts will produce approximately 3,275 cubic yards (CY) of dredge spoils. The spoils will be pumped into a 135-foot wide by 400-foot long containment area that will be constructed on the uplands portion of the site north of the area with the existing 24 boat slips. The earthen berms that will be constructed from on-site materials will be 25 feet wide and 4 feet tall, with 3:1 slopes on the sides of the structure. Dredge effluent will be pumped into the east end of the structure and will exit the west end and discharged into the 30-foot by 90-foot basin extension located immediately to the east of the existing boat ramps. After the dredging is complete, approximately 2,700 CY of compatible dredge spoils will be spread across upland portions of the site prior to the installation of 122,102 SF of asphalt driveway and parking areas. Excess and incompatible spoil material will be disposed of at the Dare County construction and debris landfill in Manns Harbor. The actual parking surface will be constructed with 8-inches of ABC gravel and 3-inches of asphalt. The spoil fill, gravel, and asphalt will raise the level of the driveway and parking areas approximately 2-3 feet above current grade. The water dependent structures the applicant proposes to construct include a kayak launch area, replacement bulkheads and docks, and redesigned boat ramps. The canoe/kayak launch area will be installed to the west of the "T-shaped" canal separating the large wetland area on the eastern portion of the lot from the western two-thirds of the property. The Americans with Disabilities Act (ADA) accessible launch area will consist of a concrete sidewalk leading to a 6-foot wide by 16-foot long floating dock which connects to a 6-foot wide by 40-foot long "L- shaped" head to the floating dock. The floating dock will be anchored on the uplands so that Field Investigation Report WRC -Manes Harbor Boating Access Site, Dare County Page 4 only the 6-foot by 40-foot portion of the structure will be located beyond normal water level (NWL). A 10-foot wide by 36-foot long sand ramp will also be installed adjacent to the ADA accessible structure to provide additional canoe/kayak launching capabilities. The sand ramp will extend six feet beyond NWL to facilitate launching/retrieving efforts. The applicant proposes to improve the area containing the 24 existing boat slips by replacing the 297-foot wooden bulkhead with a vinyl bulkhead. The associated 6-foot wide dock will also be replaced, but will be placed landward of the new bulkhead. No new mooring pilings will be installed. The 64-foot bulkhead situated east of the boat slips will also be replaced, but because of the adjacent U.S. Army Corps of Engineers Section 404 wetlands, it will be installed as free-standing bulkhead (i.e., no dead men will be installed) to avoid wetland fill. The two existing gravel boat ramps and the 30-foot by 90-foot extension off the large basin will be combined and reconfigured to create a new facility containing three new boat ramps. The three new concrete ramps will be 15 feet wide and 70 feet long and will be separated by two 8- foot wide by 60-foot long floating docks. The expansion of the boat ramp area will consume 2 of the 24 adjacent slips, reducing the number of available slips in this area to 22. The final portion of the redevelopment is the area west of the new boat ramps. In this area 200 feet of wooden bulkhead will be replaced with vinyl bulkhead and 200 feet of new 6-foot wide dock will be installed. An additional 125 feet of vinyl bulkhead and 57 feet of dock will also be installed to expand the docking area and create aloading/unloading area. A 24-foot wide by 38-foot long platform will also be installed at the end of the new loading lanes. 9. ANTICIPATED IMPACTS It is anticipated that the proposed project will have the following impacts: • Maintenance dredging the channel to the Croatan Sound and the construction of the boat ramps will require the excavation of 33,925 SF of Estuarine Water /Public Trust AECs and will create approximately 3,511 CY of spoil material. • Installation of the new bulkheads and boat ramps will require the filling of 3,585 SF of Estuarine Water /Public Trust AECs with approximately 317 CY of material. • The proposed kayak launch, boat ramps, and loading dock platform structures will shade an additional 1852 SF of Estuarine Water /Public Trust AECs. • Approximately 4,075 CY of material will be utilized to fi1188,195 SF of Estuarine Shoreline AEC, while an additiona13,270 CY of material will be utilized to fill 106,350 SF of upland portions of the site. • The proposed development will result in 129,201 SF of impervious surface which will dramatically increase the storm water run-off from the site. • Portions of the impervious surface will drain into the U.S. Army COE wetlands located east of the existing 24 boat slip area. • The dredging of the access channel, installation of the bulkheads, and the construction of the boat ramps will temporarily increase the turbidity of the water within the existing basin. • No maps were available to determine the location of nearby archeological sites. COA~~TAL P~IIANAGEMENT ;i~n~~-!?FIBETH CITY NCWRC proposes the renovation of the Manns Harbor Boating Access Area in Dare County. NCWRC acquired the property through WAMI funds that were applied for by Dare County. The site is currently operating as a public boating and commercial boating/docking facility. The property was previously owned by Outdoor Properties LLC and acondo/townhouse development named Harbor Pointe had been planned in 2007 but never constructed. Another known past use of the site was a hotel. The site is just west of the US 264 Bridge in Manns Harbor. The site is on the Croatan Sound on a manmade basin and accesses Croatan Sound by an existing access channel. The basin was constructed sometime between 1961 and 1966 (see enclosed older NOAA Navigation Charts). The existing site has 2 boat ramps that are in very poor condition, large gravel parking areas, 24 perpendicular marina slips, a large amount of docks parallel to the shoreline (many of which are broken and in unusable condition), and bulkheads along a large portion of the shoreline. A concrete block area is next to the ramp area was previously the location of fuel tanks. The existing use of the site is a mix of commercial fishing and recreational boaters. Parking is undelineated and many commercial users leave equipment and trailers wherever desired. The parking lot is very flat and low and floods frequently. None of the existing facilities are ADA-compliant. Wetlands exist on the site. Wetlands were delineated by both DCM and USACE staff in January 2011. No impacts to wetlands are proposed as part of this renovation. Some parking lot runoff from Phase 1 will sheetflow into the 404 wetland at the southeast corner of the property. Existing water depths within the basin vary widely. There is a large hole that is 30' deep. Depths not part of that hole are generally -4' - -6'. The mouth of the basin heading out into Croatan Sound is shallower with depths being -2' - -3' in some places. The access channel has been maintenance dredged multiple times with permits on record back to 1974 and additional interior basin dredging was also previously permitted (list enclosed as CAMA Application attachment). At the channel marker in the sound depths are -6' or more. Off of the manmade basin is a T-shaped manmade canal with depths about -1' - -2'. This basin also has derelict docks along about half of its shoreline. Derelict docks and dock remnants along shorelines are to be removed as part of the redevelopment. In order to improve waterfront access to the boating public and preserve the traditional use of the site by commercial fishing, NCWRC plans to redevelop this site into 3 distinct areas. Phase 1 is a recreational boating area with 3 launch ramps, 80 vehicle/trailer parking spaces, new bulkhead and shoreline docks, and leaving 22 of the perpendicular marina slips intact (decrease of 2 from 24 existing). None of the existing marina slip piles are proposed to be replaced. Phase 2 is a commercial fishing area with 20'x20' storage spaces for fishing gear and/or boat trailers, new shoreline bulkheads and docking, a drive- up access to the shoreline docking, and a direct driveway to the ramp area. Behind the drive-up lanes is a 38'x24' wood platform dock to allow room for equipment and give access to adequate water depths. Proposed Phase 2 docking provides length for 10 parallel boat slips (same as 10 existing). Phase 3 is a kayak/small vessel launch area with single-car parking. All parking and driveway areas would be asphalt. All proposed facilities will be ADA-compliant. Due to existing flooding problems at this low-lying site, the upland development involves raising the elevation of the parking lot. Fill material will raise the site and be graded to form the parking lot subgrade. The parking lot will be constructed of an 11" pavement structure - 8" ABC and 3" Asphalt.. A total of 7,345 yd3 of fill material will be used to construct the upland development. Of that total, 2,700 yd3 will be subgrade fill and 4645 yd3 will be the 11"pavement structure. The total fill proposed within the CAMA 75' AEC is 4,075 yd3. As a subset of the AEC total, the total fill proposed within the CAMA 30' Buffer is 830 yd3. 3270 yd3 will be placed in the uplands area outside of the AEC. Ramp construction will involve placing the rock ramp base, consisting of rip rap and No. 57 stone, in place and then pushing concrete slabs into place with a bulldozer. The rock ramp base will be constructed using an excavator from dry ground. The excavator will place and prepare the rock ramp base to a slope of 14%. Long-arm excavators with a reach of up to 75'-long can be rented in addition to construction equipment already owned by NCWRC. The concrete ramp slabs will be poured on high ground and pushed into place with a bulldozer after the slabs have cured. Parts of the ramp above NWL will then be formed and poured in place after the under-water portions are in place. Due to the large percentage of the non-vegetated areas being gravel and packed parking, this project is being proposed as a Stormwater Redevelopment project. Of the proposed 129,201 ft2 of impervious surfaces, 122,102 ft2would be asphalt. NCWRC proposes to hydraulic dredge within the basin and the previously maintained access channel out to the Channel Marker to a depth of -6'. Channel Marker "2" has been in its current location since sometime between 1966 and 1970 (see enclosed old NOAA Navigation Charts). The proposed dredging will be within the footprint of previously permitted maintenance dredging and within the manmade basin. An EFH Assessment was submitted for review by NMFS as supplement this permit application in regards to proposed maintenance dredging. The EFH Consultation concluded this proposed project would have minimal adverse effect on federally-managed EFH species. A copy of the EFH has been included with this CAMA application packet for reference and also submitted directly to US Army Corps of Engineers. The grassed earth dike around the proposed .hydraulic dredge spoil area will be constructed with bulldozers. The dikes will have a height of 4' and side slopes of 3:1. The dike will be constructed of material on the site. Material will be cleared of woody debris. Dikes will be constructed and compacted in 1' lifts. Prior to that the site consisted of an at least partially man-made marina basin approximately 1100 ft x 400 ft wide, a 50ft wide access channel to the sound, piers, boat ramp, a motel , and a bait and tackle shop. The property has been used for spoil disposal several times in the past. The North Carolina Wildlife Resources Commission (NCWRC) provides free boating access areas statewide at over 200 locations. NCWRC's network of public boating access areas are constructed, operated, and maintained with funds received from annual motorboat registration frees. There is a statewide effort to reduce the loss of public access to coastal waterways because of private development. The State of North Carolina's efforts to improve and secure public water access were again reaffirmed in 2007 with the creation of the Waterfront Access and Marine Industry (WAMI) Fund. The fund's creation affirms the statewide interest to "acquire waterfront properties or develop facilities to provide, improve, or develop public and commercial waterfront access." This project property was purchased with.WAMI funds to preserve the existing traditional use of access by commercial and recreational boaters and subsequently received an additional WAMI construction grant to be used after a project redevelopment plan has received all necessary permits and approvals. Project Description Manns Harbor, NC is a small town in northeastern NC. It is in mainland Dare County. The project site is located on US 264 just west of the old US 64 bridge. The project site property has been previously developed and used as a dredge spoil disposal site. At this time it is majority unorganized gravel parking. There are 2 existing boat ramps in poor condition. Bulkheads, which are broken in many locations, stabilize a majority of the shorelines. Coastal and 404 wetlands exist on the property at locations where there are no bulkheads and at areas that were not previously filled or developed. Traditional users of the site are commercial and recreational boaters. None of the existing facilities are ADA- Accessible. Existing site conditions are shown below. Old CAMA Permits issued by NC Division of Coastal Management (NCDCM) •document maintenance dredging of the channel in 1974, 2001, and 2004. In 2001 additional interior dredging within the manmade basin was also permitted to a depth of -7'. Submerged land of the manmade basin and access channel is almost entirely designated by NC Division of Marine Fishers (NCDMF) as "without shell." Mapping categories found at the project site include D-Subtidal Soft Non- vegetated w/o Shell, X-Intertidal Hard Non-vegetated w/o Shell, H-Subtidal Firm Non-vegetated w/o Shell, and L-Subtidal Hard Non-vegetated w/o Shell. A small shoreline along a wetland portion of the property is designed as "Shell„ and is mapped as W-Intertidal Hard Non-vegetated Shell but in the summer of 2010 NCWRC staff did not observe existing oyster beds at that location. The manmade basin is designated as a Prohibited Shellfish Harvesting Area by NCDMF. The scope of the renovation includes 3 new boat ramps that meet accepted design standards, floating docks between the ramps to aid in launching and retrieving of boats, replacement of existing bulkheads and Manna Harbor BAA EFH Assessment, Page 4 shoreline docks, a sandy kayak launch with floating dock, and maintenance dredging of the existing access channel to a depth of -6'. All proposed facilities will be ADA-Accessible. The upland development will consist of 3 distinct use areas - a vehicle/trailer parking lot for recreational boaters, ashort-term storage area for commercial boaters and their gear, and asingle-car parking lot and sandy kayak/small vessel launch. The proposed redevelopment site plan is shown below. Due to existing flooding issues in the gravel parking areas, the proposed parking lot elevations will be raised. No impacts to wetlands on the site are proposed. No excavation in the basin for ramp construction will be necessary as water depths are currently 5' or greater in ramp location. Maintenance dredging of the access channel is proposed for a channel 30' in width and 1100' in length resulting in a volume of 3275 cubic yards. The 1100' feet in channel length is comprised of 900' of channel maintenance dredging that was previously done under CAMA Permits an additional 200' of interior manmade basin dredging to connect back to the existing -6' contour. The proposed dredging area is shown below. All dredged material will be temporarily spoiled and de-watered on-site outside of the 75' CAMA Area of Environmental Concern. Material that is suitable fill will be used to construction parking lot subgrade. NCWRC has coordinated with Dare County Public Works Department for material that is not suitable backfill will be hauled to Dare County's East Lake Landfill. N>S.~ 11 . k~' w:~~:4' ~' ~T ~ Project Impact Assessment The assessment area for this proposed project includes the upland property owned by NCWRC, the manmade basin off of Croatan Sound, the access channel in the Croatan Sound leading out to the existing "2" Channel Marker. This project is a proposed redevelopment of property that is already developed and maintenance dredging of a channel and manmade basin .that have been maintained consistently. In the summer of 2010 while conducting a water depth survey by motorboat, NCWRC staff observed vegetation in the water near the western shoreline of the property where there are not currently bulkheads but did not observe any vegetation in the water in front of existing bulkheads, ramps, or the access channel. The proposed upland parking lots and driveways will reduce the overall area of impervious surfaces at the site and create 30' vegetated areas between non-water dependent impervious surfaces and the Croatan Sound basin. Grassed depressions and landscaping elements are also incorporated into the design at the recommendation of NC Division of Water Quality (NCDWQ}. This project will require a Stormwater Permit Redevelopment Exemption from NCDWQ. Manns Harbor BAA EFH Assessment, Page 6 The proposed waterfront elements; bulkheads, shorelines docks, and boat ramps; are all in locations that was previously been stabilized and excavated. Derelict docks and bulkhead remnants will be removed from areas with coastal wetlands and therefore no new impacts to wetlands or intertidal areas are proposed. All waterfront development and development within NCDCM's 75' Area of Environmental Concern will follow existing regulations and will require a CAMA Major Permit. The proposed dredging is entirely within the previously maintained channel and the manmade basin. The widest permitted footprint of maintenance dredging of the channel was 50'. The proposed footprint of maintenance dredging for this project is 30'. NCWRC staff did not observe any vegetation in the water within the proposed dredging area so no new impacts to Submerged Aquatic Vegetation are proposed. Essential Fish Habitat Designation Essential Fish Habitat (EFH) is defined as "those waters and substrate necessary to fish for spawning, breeding, feeding, or growth to maturity." In North Carolina, EFH is designated by the South Atlantic Fisheries Management Council (SAFMC) and Mid-Atlantic Fisheries Management Council (SAFMC) in their Fisheries Management Plans (FMP). Salt marshes and estuaries along our coast serve as nursery grounds for 90% of fisheries. North Carolina designates nursery areas to protect the fragile ecosys#ems. NC Divison of Marine Fisheries (NCDMF) has designated about 230 mil of fishery nursery area throughout North Carolina, dividing habitats in the cateorgies of Primary Nursery Area, Secondary Nursery Area, and Special Secondary Nursery Area. All 3 categories of nursery habitat are considered to be EFH. The Croatan Sound and manmade basin at the project location are not designed as a nursery area by NCDMF. Estuarine Emergent Wetlands Estuarine Wetlands are defined as "tidal wetlands in low-wave energy environments, where the salinity is greater than 0.5 parts per thousand." Estuarine marsh sediments are usually muddy with high organic matter content. Some of the most productive and valuable wetlands are coastal marshes. These habitats are important for fish and invertebrate spawning and juvenile development. Estuarine emergent wetland habitats are located along the Croatan Sound and manmade basin at the project site. On 1/12!2011 staff from NCDCM and United States Army Corps of Engineers (USAGE) visited the site and delineated coastal and 404 wetlands on the project property. The construction footprint of the proposed project does not include any of the wetlands. Manns Harbor BAA EFH Assessment, Page 10 Submerged Aquatic Vegetation Submerged Aquatic Vegetation (SAV) habitat is defined as "estuarine waters vegetated with one or more species of submered vegetation such as eelgrass {Zostera marina), shoalgrass (Halodu/e wrightii~, and widgeon grass (Ruppia maritime). These vegetation beds occur in both subtidal and intertidal zones and may occur in isolated patches or cover extensive areas. North Carolina sees shifts in SAV presence throughout the year as it is the southernmost extension for some cold-adapted species and the northernmost extension of warm-adapted species. At the proposed project site, vegetation in the water was only observed along 1 shoreline at the western end of the property. This shoreline is currently not stabilized, has coastal wetlands along it, and also has remnants of docks along portions of it. This shoreline is not proposed to be stabilized with bulkhead or have new docks or dredging take place in front of it. At a 12/16/2010 NC Department of Environmental and Natural Resources (NCDENR) interagency scoping meeting, since it was determined that no new footprint of impacts was proposed and the only observed vegetation in the .area was not in the construction footprint, a formal SAV survey may not be recommended. It was recommended that NCWRC coordinate with a representative from NMFS for a final determination on the need for an SAV survey. Phone conservation and emails with NMFS came to the conclusion that an formal SAV survey for this proposed project would not be needed beyond NCWRC staff's observations at the site. As no SAV habitat will be impacted or lost during proposed construction, impacts to species utilizing this EFH are not anticipated. Estuarine Water Column Estuarine Water Column habitat is defined as "the medium of transport for nutrients and migrating organisms between river systems and the open ocean." The Croatan Sound at the project location fits this definition as it connects the Albermarle Sound and all of its contributing rivers and creeks to the Atlantic Ocean via Oregon Inlet. The manmade basin does not connect any other river systems into the Sound or Ocean. Because of the variety of habitats that can occur within the Estuarine Water Column habitat in Croatan Sound, a variety of fish species inhabit these environments. The eastern end of the existing basin access channel to the Channel Marker is within the EFH. However, dredging proposed of the channel is maintenance dredging and not a new impact. The channel is currently in use Manes Harbor BAA EFH Assessment, Pege 11 and boat traffic enters and exits and basin daily. The dredging footprint was minimized to the greatest practical extent. Any in-water construction moratoriums or recommended measures such as turbidity curtains included in project permits will be followed during construction. Short-term impacts may occur during dredging operations. As the construction footprint does not create a new impact within the estuarine water column habitat, long-term adverse impacts to species utilizing this EFH are not anticipated. Conservation Measures The proposed redevelopment project was designed with avoidance and minimization measures to prevent and limit any adverse impacts to natural habitats, including EFH. The boat ramps and bulkheads are only proposed at locations with previously stabilized shorelines. The boat ramps are proposed at a location with existing depths adequate to launch boats so that minimal excavation/fill for ramp construction will be needed. No new upland development or shoreline stabilization is proposed in any location that would impact wetlands. Landscaping and parking lot designs will prevent stormwater runoff from proposed upland development from running directly into wetlands. The proposed dredging is limited to maintenance dredging of the existing access channel and interior dredging within the manmade basin. The proposed channel width is 30' which is less than previous maintenance dredging footprints of up to 50' in width. In the narrow part of the channel opening, maintenance dredging of the channel is shifted slightly south instead of in the center to avoid the small area of potential shell habitat that NCDMF classifies as "W"-Intertidal Hard Vegetated Shell. Summary Three types of EFH geographic habitat occur within the project assessment area: Estuarine Emergent Wetlands, Submerged Aquatic Vegetation, and Estuarine Water Column.
