Dear Mr. Gibson: This letter is in reference to the request for a change in control of access at Access Point 94 on the Second Bridge to Oak Island project in Brunswick County. NCDWQ's Individual Certification No. 3608 issued for the subject project on February 19, 2007 references a Memorandum of Understanding (MOU) entered into by NC Department of Transportation, Federal Highway Administration, US Environmental Protection Agency, and NC Department of Environment and Natural Resources. This MOU requires unanimous agreement by all parties for any requests made for breaks in the existing control of access other than those approved in the original MOU. Access Point 44 was approved in the original MOU. . On February 8, 2011, the NCDOT Control of Access Review Committee approved a request to modify Access #4 to provide better traffic movements into and out of Access Point #4 (see attached Alternative F). The proposal does not create a new access point and will require only minor modification to the width of the existing break in control of access. As such, NCDENR agrees with the proposed modification to the break in control of access as shown in the attached Alternative F drawing dated February 15, 2011.
